Article 1 In order to prevent and control the environmental pollution of the catering industry, protect and improve the living environment and ecological environment, and promote the sustainable development of social economy, these Measures are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Water Pollution Prevention Law of People's Republic of China (PRC), the Air Pollution Prevention Law of People's Republic of China (PRC) and other relevant provisions, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the prevention and control of environmental pollution of catering industry and its supervision and management activities within the administrative area of this Municipality.

Organs, enterprises and institutions, social organizations and other canteens shall be implemented with reference to these measures. Article 3 The catering industry as mentioned in these Measures refers to the industry mainly engaged in catering, cooking, processing and consumer services. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership of the prevention and control of environmental pollution in the catering industry, establish and improve the assessment and coordination mechanism, urge the relevant departments to perform their supervision and management duties according to law, and incorporate the required work funds into the fiscal budget at the same level. Article 5 The competent department of ecological environment administration shall exercise unified supervision and management over the prevention and control of environmental pollution in the catering industry.

Where laws, regulations and rules stipulate that the discharge, collection and disposal of restaurant sewage, domestic garbage and kitchen garbage shall be supervised and managed by the relevant administrative departments, it shall be implemented in accordance with relevant regulations. Article 6 The market supervision and management department shall be responsible for the industrial and commercial registration and food business license management of catering operators, and establish a list of catering operators' information and a dynamic management database.

The competent department of urban drainage administration shall be responsible for the management of drainage license of catering industry according to law, and establish inspection records.

The urban management department is responsible for the supervision and management of domestic garbage and kitchen garbage in the catering industry, and the illegal occupation of roads shall be dealt with according to law.

Other relevant administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of the prevention and control of environmental pollution in the catering industry. Seventh catering operators are responsible for the prevention and control of environmental pollution in the catering industry, and should carry out pollution control work in accordance with the requirements of relevant laws, regulations and standards, and accept the supervision and management of relevant departments.

Citizens, legal persons and other organizations have the right to report the environmental pollution caused by the catering industry to relevant departments. Article 8 It is strictly forbidden to build, rebuild or expand catering industry projects that produce oil fume, odor and waste gas in the following areas or places:

(1) Residential buildings;

(two) the commercial and residential complex building is not equipped with a special flue;

(3) The commercial floor adjacent to the residential floor in the commercial-residential complex;

(four) the main buildings of museums, libraries, archives and exhibition halls;

(five) drinking water source protection areas, nature reserves, ships, docks and other water facilities within the scope of Dianchi River management, and other prohibited areas that need special protection. Ninth new construction, renovation and expansion of catering projects, catering operators should log in to the online filing system of environmental impact assessment registration form before the restaurant is completed and put into operation, and truthfully fill in the environmental impact registration form of construction projects; If the operator, business project and business area change before putting into business activities, it shall go through the filing formalities again.

Catering operators shall be responsible for the authenticity, accuracy and completeness of the contents of the environmental impact registration form of construction projects. Article 10 Where catering operators discharge sewage into urban drainage facilities, they shall build corresponding pretreatment facilities such as oil separation and slag separation in accordance with technical specifications, and meet national and local discharge standards; In areas not covered by urban drainage facilities, sewage treatment facilities should be built by themselves, and they can only be discharged after reaching the national and local sewage discharge standards. Restaurant operators regularly clean and maintain sewage (pre-) treatment facilities to ensure normal operation. Article 11 When catering operators discharge oil fume and waste gas, they shall set up gas collection hoods, exhaust pipes and exhaust fans in accordance with the specifications, and take measures such as installing oil fume purification facilities, so as to meet the national and local air pollutant emission standards. It is strictly forbidden to discharge lampblack without special flue and lampblack purification facilities, and it is strictly forbidden to discharge lampblack to urban drainage facilities. Twelfth catering operators should take measures such as sound insulation and noise reduction to ensure that noise emission and vibration control meet national and local standards. Thirteenth catering operators shall, in accordance with the provisions, hand over the kitchen waste to the licensed units for treatment, and collect the domestic waste separately, store it at designated places, and make it daily. Article 14 Catering operators shall regularly clean and maintain pollution prevention facilities and equipment, establish maintenance ledgers to ensure the normal operation of pollution prevention facilities and equipment, and it is strictly forbidden to dismantle or leave pollution prevention facilities and equipment idle without authorization. Fifteenth is strictly prohibited in the county (city, district) people's government banned open-air barbecue food or provide a venue for open-air barbecue. Sixteenth catering operators should give priority to the use of natural gas, liquefied petroleum gas, electricity or other clean energy, and prohibit the use of high-pollution fuels such as heavy oil and coal, and all kinds of combustible wastes and their stoves in high-pollution fuel no-burn areas. Seventeenth in violation of the provisions of the first, second and third items of Article 8 of these measures, the county (city, district) ecological environment administrative department shall order it to make corrections within a time limit; Those who refuse to make corrections shall be closed down and fined between 20,000 yuan and 65,438+10,000 yuan. Eighteenth in violation of the provisions of the fourth paragraph of Article 8 of these measures, the county (city, district) ecological environment administrative department shall order it to make corrections within a time limit and impose a fine of 50000 yuan to 65438 yuan.
