I. Scope of Tax Exemption for Imported Equipment
(1) For the equipment imported for self-use within the total investment amount of the foreign investment projects conforming to the Encouraged and Restricted Category B of the Catalogue of Industrial Guidance for Foreign Investment and transfer of technology, except for the commodities listed in the Catalogue of Imported Commodities Not Exempted from Tax for Foreign Investment Projects, they shall be exempted from the payment of tariffs and import-related value-added tax.
Equipment imported for self-use under foreign government loans and loans from international financial organizations, and non-value-added imported equipment supplied by foreigners for processing trade shall be exempted from customs duties and import-related value-added tax, except for the commodities listed in the Catalogue of Imported Commodities Not Exempted from Duty for Foreign Investment Projects, in accordance with the above paragraph.
(2) For domestic investment projects in line with the Catalogue of Industries, Products and Technologies Currently Encouraged by the State, the equipment imported for self-use within the total amount of investment shall be exempted from tariffs and import-related value-added taxes, except for the commodities listed in the Catalogue of Imported Commodities Not Exempted from Duty for Domestic Investment Projects.
(3) For projects conforming to the above provisions, the technology, ancillary parts and spare parts imported with the equipment in accordance with the contract shall also be exempted from customs duty and import-related value-added tax.
(d) The State Council shall decide on the tax exemptions and reductions for imported equipment outside the scope of the above provisions.
Two, the management of imported equipment tax exemption
(a) investment projects
