Advertisements in the form of publishing or broadcasting signed articles shall be labeled as advertisements or declared as advertisements. Article 10 News media organizations publishing advertisements in the form of public participation in consulting activities, knowledge quizzes and other forms shall not instruct others to carry out deceptive and misleading propaganda in the capacity of consumers and users.
Advertisements stipulated in the preceding paragraph involving the promotion of medicines, medical devices and health care products shall not draw conclusions on the diagnosis of the condition of the participants, or suggest that those whose condition is unknown should use the medicines or medical devices they promote. Article 11 The use of data in news media advertisements shall comply with the following provisions:
(1) The data shall be labeled with the source;
(2) Qualifications affecting the comparability and validity of the data shall be labeled;
(3) Data not released or recognized by the functional departments of the State Council shall not be used as the basis for regional, national or international ranking in advertisements;
(4) Data not released or recognized by the functional departments of the People's Government below the provincial level shall not be used as the basis for regional, national or international ranking;
( (D) Data released or recognized by people's governments below the provincial level and their functional departments shall not be used as the basis for regional ranking in advertisements. Article XII of the news media advertisements involving the price of goods or services, should be perfect price-related transactions. If not stated, the price shall be the price at which consumers and users can obtain goods with usual usage functions or services of usual items without having to bear additional prices or expenses. Article 13 Non-well-known trademarks, non-famous brand title granted by the relevant functional departments of the State Council shall not be claimed as international or Chinese famous brand in advertisements.
Non-famous trademarks, non-provincial people's governments and their authorized functional departments granted the title of local famous brands, shall not be claimed as local famous brands in advertisements.
News media advertisements shall not contain information on international awards not recognized by the state. Article 14 It is prohibited to set the right of interpretation in advertisements. Article 15 Advertisements promoting equipment, technology, seeds, seedlings, breeding animals, breeding birds and breeding beasts shall not contain contents analyzing or predicting the market supply and demand situation and economic effects of products produced by using such equipment, technology, seeds, seedlings, breeding animals, breeding birds and breeding beasts.
The advertisements stipulated in the preceding paragraph indicating the recovery of products shall specify the period of recovery, price, quantity, product quality requirements and other contents. Article 16 Real estate advertisements shall conform to the following provisions:
(1) They shall not contain the contents of feudal superstitions such as feng shui and divination;
(2) The advertisements for the sale of real estate shall be marked with the pre-sale and sales permit approving authority and the document number;
(3) The location of the real estate development and construction project shall be expressed in terms of the actual distance of the existing traffic arterials from the location of the project to a particular reference indicated;
(d) The transportation, commercial, cultural, educational and municipal facilities involved in the construction project shall be indicated if they are under planning or construction;
(e) Where the construction project involves environmental greening content, it shall be consistent with the planning and design or the actual construction;
(f) Where photographs of the architectural design models or renderings are used, they shall be indicated;
(g) (vii) Where the starting price is indicated, it shall be indicated;
(h) Where the price of the project is indicated, it shall be indicated. ) Where the starting price is indicated, the maximum price shall be indicated at the same time. Article 17 prohibits the following advertisements:
(1) tobacco advertisements;
(2) advertisements that alarm the public such as horror, sensationalism, etc.
(3) advertisements that harm the physical and mental health of minors;
(4) advertisements contrary to social morality and good manners;
(5) other advertisements prohibited by laws and regulations. Chapter III Advertising Business Article 18 News media organizations engaged in advertising business activities, must be registered in accordance with the law, and receive the "Advertising Business License", and its advertising business should be handled by its agencies specializing in advertising business. Article 19 To obtain an Advertising Business License, the following conditions shall be met:
(1) a specialized advertising agency;
(2) funds, professional and technical personnel, equipment and venues suitable for advertising business;
(3) full-time or part-time financial personnel;
(4) an advertising Examiner;
(v) other conditions stipulated by laws and regulations.
