Yanbian Korean Autonomous Prefecture Provisional Provisions on Supporting the Military and Families
Article 1 In order to further strengthen the work of supporting the military and families, and to promote the unity of the military and government and the military and the people, the provisions are formulated in accordance with the Regulations on the Pensions and Preferential Treatment for Servicemen and Regulations on the Support of the Military and the Families of Jilin Province, and other relevant laws and regulations, and taking into account the actual situation of our state.
Article 2 The People's Liberation Army active military personnel (hereinafter referred to as "active military personnel"), military personnel with disabilities serving in or out of active duty, demobilized military personnel, veterans, and the survivors of martyrs of the revolution, the survivors of military personnel sacrificed in the line of duty, the survivors of military personnel who died of disease, and the family members of active military personnel shall be given preferential treatment in accordance with the provisions of this regulation.
Article 3 The principle of combining government and society in the work of supporting the troops and their families shall be implemented, and the units and individuals related to the work of supporting the troops and their families in the state shall abide by these provisions.
Article 4 The people's governments at all levels shall strengthen the leadership of the work of supporting the troops and their families, convene regular meetings on the work of supporting the troops and their families, discuss and decide on major matters of the work of supporting the troops and their families, and increase the investment in the military supply stations directly serving the troops, as well as the psychiatric hospitals for soldiers who have been restored to the military, the honorary hospitals, and the memorial gardens for the martyrs to perfect the relevant infrastructures. On major holidays, anniversaries and other important times, should often visit the garrison units to help solve practical difficulties.
Article 5 The people's governments at all levels and the relevant departments shall fully support the troops to complete the combat readiness training, exercises, tests and other tasks, and assist in solving the problems of supply of food, oil, coal, water, electricity, gas and other difficulties. The troops training, living, camping, etc. need to requisition land, should be given priority to solve, requisition fees and other building approval fees to implement the lowest standard.
Article VI of the people's governments at all levels and the relevant departments shall strictly implement the "Law on the Protection of Military Facilities". Development and construction involving military facilities, should seek the views of the troops in advance, consultation and settlement. Destruction of military facilities, theft of military supplies and to the barracks nuisance trouble, shall be dealt with seriously according to law.
Article VII The people's governments at all levels shall set up to safeguard the legitimate rights and interests of military personnel consulting service station, in line with the principle of convenience to the military, coordinate the judicial department to give priority to handle, properly resolve "military-related cases".
Article VIII active-duty military personnel with valid documents, disabled military personnel with the "Chinese people's **** and the disabled military personnel card" priority to buy bus tickets, train tickets, air tickets, which disabled military personnel to enjoy a 50% reduction in the normal fare preferential treatment, the certificate for free rides within the city of the public **** car (except vans).
Active military personnel and disabled military personnel visiting parks, museums and other places are exempted from admission fees on the basis of their military officer's card, soldier's card or revolutionary disabled military personnel's card.
Article IX In support of local construction and disaster relief work in the military region or above authorities commended and honored with first-class merit active-duty military personnel, demobilization and transfer to stay in the state, priority will be given to the resettlement.
Article 10 If an active-duty soldier receives awards for meritorious service in the army, the township (town), street and the unit in which the military subordinate lives may give certain material incentives. The people's government of the county (city) in which the active-duty soldiers of the foreign troops stationed in Yanzhou are located shall issue a certain amount of condolence money if their families are affected by a disaster.
Article 11 During the period of active service of conscripts, the people's governments of the local counties (cities) shall grant preferential treatment to their families. The standard of preferential treatment for the families of conscripts with agricultural household registration shall not be less than the actual per capita income of farmers in the previous year in the local township (town), while those with urban household registration shall be implemented in accordance with the relevant provisions of the State, and the preferential treatment shall be resolved by the local government or the society as a whole. During the period in which urban veterans are to be resettled, the people's governments of counties (cities) shall issue subsistence allowances in accordance with standards not lower than the minimum subsistence guarantee for local urban (town) residents.
Article 12 After urban conscripts leave active service, they shall be resettled with a Non-Agricultural Preferential Resettlement Certificate. If a person voluntarily applies for self-employment and meets the conditions, the people's government of the county (city) will give a one-time economic compensation of at least 6,000 yuan to 8,000 yuan.
Article 13 For rural conscripts who have made meritorious achievements in the army, they shall enjoy the preferential treatment pension for the current year, on the basis of which, according to the honorary certificates of first-, second-, and third-class merit issued by the army, the preferential treatment pension shall be issued in accordance with the standard of the local rural cost-of-living expenses for the previous year at 100%, 50%, and 30% of the amount of the preferential treatment pension. For urban conscripts who have made meritorious achievements in the army, on the basis of the honorary certificates issued by the army for first-, second-, and third-ranking merits, additional preferential treatment payments shall be made at the rate of 30%, 20%, and 10% of the standard of the local town's consumer spending for the previous year.
Article 14 Priority shall be given to the resettlement of retired soldiers who have been awarded first or second class merit in the army and who have been honored by the authorities above the military region, and who conform to the resettlement policy. Urban retired soldiers who voluntarily seek their own employment shall enjoy a one-time economic compensation paid by the local people's government, with an increase of 20% on top of this.
Article 15 meets the conditions for resettlement and I voluntarily apply for self-employment conscripts, where the county (city) labor security department for unemployment registration, free skills training for them. Self-employed urban retired soldiers engaged in self-employment (except for construction, entertainment and advertising, sauna, massage, cybercafé, oxygen bar), from the date of receipt of the tax registration certificate, exempted from business tax, urban maintenance and construction tax, education surcharges and personal income tax for three years.
Article XVI in the countryside disabled soldiers, demobilized soldiers, veterans, survivors of martyrs, the survivors of military personnel killed in the line of duty, the survivors of deceased military personnel and other key beneficiaries, living in genuine difficulties, the person applies for the transfer of agriculture to non-agricultural procedures for their agricultural transfer, and give priority to the urban residents of the minimum subsistence guarantee procedures, eligible for inclusion in the scope of urban residents' medical insurance.
Article 17: During the period of compulsory military service, local housing arrangements must be included in the housing population. In the rural areas, when the preferential object to build housing, their township (town) and the land and resources departments to give priority to preferential arrangements.
Article XVIII of the officers and non-commissioned officers not accompanying the army family members of the unit to allocate housing, to be treated as dual-career. Where the unit does not have the ability to build housing, priority should be given to provide housing funds.
Article XIX of the family members of officers eligible to accompany the army, the labor and personnel departments in accordance with the principle of professional counterparts, the convenience of life resettlement, shall not be placed in the shutdown, semi-suspension of production enterprises. Children of officers in active service shall be given preference for employment under the same conditions when they participate in local recruitment.
Article 20 If the family members accompanying the army seek self-employment, the relevant departments shall actively create conditions for them, give priority to them, and exempt them from the relevant fees within three years.
Article 21 The children of active-duty military personnel should be enrolled in nursery school, school in accordance with the principle of proximity and convenience, priority in nursery school, school enrollment, the specific program developed by the county (city) education department. Children of soldiers who died in the line of duty, children of soldiers who died of illness, children of soldiers with revolutionary disabilities from level 1 to level 4 are admitted at a lower rate of 10 points when applying for admission to ordinary high schools and secondary vocational schools, and children of active-duty military personnel are admitted at a lower rate of 20 points when applying for admission to ordinary high schools and secondary vocational schools, and at the same time shall not be charged any fees other than those stipulated by the people's government of the province.
Article 22 When the family members of border guard soldiers take leave to visit their relatives, 15 days of leave shall be added on top of the prescribed leave. If a soldier is unable to visit his family on vacation due to his work, his family members shall be allowed to take an additional vacation, and his unit shall pay his salary as usual.
Article 23 For eligible cadres who have been transferred to the army, people's governments at all levels and departments shall actively accept the resettlement and ensure that the resettlement tasks are completed. Serving in leadership positions above the regiment level and served a minimum number of years in the military rehabilitation cadres, generally arranged for the corresponding leadership positions, there are difficulties, can be arranged for the corresponding non-leadership positions.
Article 24 These provisions shall be implemented from the date of issuance. Other cases may refer to the provisions of the relevant documents that have been issued.
