The marketing of edible agricultural products in this province, the formulation of local standards for the quality and safety of edible agricultural products, and the release of information related to the safety of edible agricultural products shall abide by these regulations. Article 3 The people's governments at or above the county level shall be responsible for the supervision and administration of food safety within their respective administrative areas, uniformly lead, organize and coordinate the supervision and administration of food safety and the response to food safety emergencies within their respective administrative areas, and perform the following duties:
(a) the food safety work into the national economic and social development plan, and the food safety work funds included in the fiscal budget at the corresponding level;
(two) to establish and improve the supervision and management mechanism of the whole process of food safety, which combines administrative supervision, self-discipline of producers and operators and social supervision;
(three) improve the implementation of food safety supervision and management responsibility system, food safety into the government's annual work target assessment;
(4) Strengthen the capacity building of food safety inspection and testing, equip food safety inspection and testing equipment and facilities, build a public platform for food safety inspection and testing, realize information exchange, and provide technical support for food safety risk monitoring and food safety supervision and management;
(five) other duties as prescribed by laws and regulations.
Township people's governments and sub-district offices shall be responsible for the food safety work in their respective jurisdictions, and shall establish a food safety management deliberation and coordination mechanism, be equipped with full-time management personnel, and establish a team of food safety coordinators or information officers to focus on assisting in the social supervision of food safety in their respective jurisdictions.
The village (neighborhood) committee shall assist the local people's government in food safety supervision and management, and report the food safety situation in a timely manner. Article 4 The Food Safety Committee of the people's government at or above the county level shall undertake the following duties:
(1) To analyze the food safety situation in this region, and study, deploy, coordinate and guide the food safety work in this region;
(two) establish and improve the coordination and linkage mechanism, comprehensive supervision and management system;
(three) to supervise and inspect the implementation of food safety supervision and management responsibilities;
(4) Other duties as prescribed by the people's government at the corresponding level.
The Food Safety Committee has an office responsible for daily work. Article 5 People's governments at all levels and relevant food safety supervision and management departments shall establish a food safety control mechanism, strengthen the publicity of food safety laws and regulations and food safety knowledge, and raise public awareness of food safety. Article 6 The market supervision and management department shall be responsible for the supervision and management of food production and operation, the marketing of edible agricultural products and the production activities of food-related products.
The administrative department of health shall undertake the supervision and management responsibilities such as food safety risk monitoring, formulation and publication of local food safety standards, filing of food safety enterprise standards, centralized disinfection of tableware, etc.
Agricultural and rural administrative departments are responsible for the quality and safety supervision and management of edible agricultural products before they enter the market or production and processing enterprises.
Other relevant food safety supervision and management departments shall, in accordance with their respective duties or the provisions of the people's government at the corresponding level, do a good job in food safety supervision and management. Seventh people's governments at or above the county level shall establish and improve the reward system for food safety reporting, and encourage and support the reporting of illegal activities in food production and operation; Reward those who provide clues to illegal acts and verify them. Chapter II General Provisions Article 8 The administrative department of health of the provincial people's government shall, in conjunction with the relevant departments of market supervision and management, agriculture and rural administration at the same level, formulate and implement a plan for building food safety risk monitoring capacity and establish a food safety risk monitoring system according to the needs of the country and the province. Article 10 The relevant food safety supervision and management departments at or above the county level shall strengthen the guidance and supervision on the training of food production and marketing enterprises, and conduct relevant training for the responsible persons, food safety managers and employees of food production and marketing enterprises according to their respective responsibilities. Eleventh food practitioners health examination items and other matters by the health administrative department of the provincial people's government in conjunction with the relevant departments to develop and publish. The list of medical and health institutions that carry out health examination shall be determined and published by the health administrative department of the people's government at or above the county level in accordance with the principles of openness, fairness, merit-based and convenience. Twelfth to encourage food producers and operators to establish a sales management system for food near the shelf life, set up relatively independent sales areas, and set up eye-catching signs to inform consumers; For foods that have deteriorated or exceeded the shelf life, the sales shall be stopped immediately and destroyed in time, and a destruction record ledger shall be established. The preservation period of the destruction record ledger shall not be less than 2 years.
The market supervision and management department shall regularly check the destruction and record of expired and deteriorated food.
