Measures for the Employment of Persons with Disabilities in Jiangxi Province

Article 1 In order to promote the employment of persons with disabilities, to protect the labor rights of persons with disabilities, according to the "Chinese People's Republic of China *** and the State Protection of Persons with Disabilities Act", the State Council "Regulations on the Employment of Persons with Disabilities" and "Jiangxi Province, the implementation of the "Chinese People's Republic of China *** and the State Protection of Persons with Disabilities Act" Measures" and other relevant laws, regulations, and the actual situation in the province, to formulate the present approach. Article 2 The authorities, organizations, enterprises, institutions and private non-enterprise units (hereinafter collectively referred to as employers) within the administrative area of this province shall, in accordance with the laws, regulations and the provisions of these Measures, fulfill their responsibilities and obligations to support the employment of persons with disabilities. Article 3 The people's governments at or above the county level shall incorporate the employment of persons with disabilities into the national economic and social development plans of their administrative regions, and formulate preferential policies and specific support and protection measures to create conditions for the employment of persons with disabilities. Article 4 Social organizations and individuals are encouraged to help and support the employment of persons with disabilities through a variety of channels and in a variety of forms, and persons with disabilities are encouraged to find employment through job applications and other forms of employment. Discrimination against persons with disabilities in employment is prohibited.

Persons with disabilities shall improve their own quality and enhance their employability; they shall abide by the labor discipline of the employer and abide by professional ethics. Article 5 The working committee for the disabled of the people's governments at or above the county level is responsible for organizing, coordinating, guiding and supervising the relevant departments to do a good job in the employment of the disabled.

Related departments of the people's governments at or above the county level, such as human resources and social security, civil affairs, finance, taxation, industry and commerce, and the judiciary, do a good job of employing people with disabilities within their respective areas of responsibility. Article 6 the federations of persons with disabilities at all levels in accordance with the laws and regulations, or accept the government entrusted, is responsible for the employment of persons with disabilities in the specific organization and implementation and supervision. The employment service agencies for the disabled belonging to the federations of the disabled at all levels are specialized agencies assisting the government and the relevant departments in providing comprehensive services for the employment of the disabled, and are responsible for providing the disabled with vocational guidance, job placement, vocational training and other services.

Trade unions, ****productivist youth unions and women's federations shall, within the scope of their respective work, do a good job of promoting the employment of the disabled. Article 7 Employing units shall arrange for the employment of persons with disabilities in accordance with the ratio of 1.5% of the total number of employees on duty in the unit, and provide them with appropriate types of work and positions. Employers are encouraged to arrange for the employment of persons with disabilities in excess of the prescribed ratio; appropriate incentives shall be given to those who exceed the prescribed ratio.

If an employer employs persons with disabilities across regions, it shall be counted as part of the number of employees with disabilities it arranges for; if it arranges for the employment of one blind person or one severely physically disabled person, it shall be counted as two. Persons with disabilities who have retired, retired or are not in employment shall not be counted in the number of employees with disabilities arranged. Article 8 encourages and supports the establishment of welfare enterprises for the disabled, blind massage institutions, industrial (agricultural) therapeutic institutions, auxiliary workshops and other welfare units and other employers who concentrate on the disabled.

Service industries with massage business and medical institutions with massage departments shall give priority to blind persons with appropriate massage qualifications. Article 9 Employers shall actively arrange for the employment of persons with disabilities, and shall not set restrictive conditions that discriminate against persons with disabilities in new hiring, except for special positions. Persons with disabilities who meet the medical examination standards for civil servant recruitment or institutional recruitment, and who are physically capable of performing their duties normally, shall enjoy the same treatment as other persons. Article 10 The employer shall, in accordance with the provisions of the basic old-age insurance, medical insurance, unemployment insurance, industrial injury insurance, maternity insurance and other social insurance for disabled workers, to provide working conditions and labor protection suitable for their physical condition, and according to the actual needs of the workplace, labor equipment and living facilities for the necessary modifications.

Employers shall not discriminate against workers with disabilities in terms of promotion, grading, appraisal of titles, remuneration, life benefits, rest and vacation, and social insurance. Article 11 The people's governments at or above the county level shall take measures to support and develop public welfare posts suitable for the employment of persons with disabilities, and include persons with disabilities who are difficult to employ in the scope of persons with difficulties in employment, giving priority to the provision of employment assistance.

People's governments at or above the county level to invest in or support the development of public welfare positions such as farmhouse, urban sanitation, landscaping, public **** parking lots, kiosks, community service points, shall give priority to persons with disabilities for employment. Article 12 The people's governments at or above the county level and their relevant departments shall determine the products and projects suitable for the production and operation of persons with disabilities, and give priority to the production or operation of the employing units with concentrated arrangements for persons with disabilities, and determine certain products to be produced exclusively by the employing units with concentrated arrangements for persons with disabilities in accordance with the characteristics of their production.

Protection policies shall be implemented for products produced by enterprises founded by persons with disabilities and by employers who have centralized arrangements for persons with disabilities, and the Government shall give priority to their procurement and use under the same conditions. Article 13 encourages and supports persons with disabilities to choose their own jobs and start their own businesses. Where persons with disabilities are engaged in self-employment, the relevant departments of industry and commerce, taxation and health shall give priority to issuing relevant licenses and exempting them from administrative fees; city management departments shall provide preferential care in terms of sites and stalls; water supply and power supply enterprises shall give preferential treatment in terms of water and electricity tariffs; and where qualified persons with disabilities apply for small-scale guaranteed loans, the government guarantee agencies and financial institutions shall give priority to providing guarantees and loans for them. Article 14 The people's governments at all levels shall raise funds from various sources to organize and support rural persons with disabilities to engage in planting, farming, handicrafts and other forms of productive work.

Related departments, financial institutions and rural grass-roots organizations shall, in accordance with their respective responsibilities, provide assistance to rural persons with disabilities who are engaged in agricultural production and work in such areas as production services, technical guidance, supply of agricultural materials, purchase of agricultural by-products and credit.
