Chapter 1 General Provisions Article 1 In order to standardize administrative penalties for radio management, these regulations are formulated in accordance with the "Radio Management Regulations of the People's Republic of China" (hereinafter referred to as the "Regulations"). Article 2 The term "radio management penalties" as mentioned in these regulations refers to the administrative penalties imposed by radio management agencies for violations of the "Regulations". Article 3 Radio management penalties shall follow the principles of legality, fairness, and a combination of punishment and education. Article 4 These regulations shall apply to radio management penalties imposed on units and individuals (including foreign institutions and foreigners), unless otherwise provided by relevant laws, regulations, and rules. Article 5 Citizens, legal persons and other organizations have the right to defend themselves against administrative penalties imposed; those who are dissatisfied with administrative penalties have the right to apply for administrative reconsideration or initiate administrative litigation in accordance with the law. Chapter 2 Behavior and Punishments Article 6 Whoever sets up or uses a radio station (station) without the approval of the radio regulatory agency or the agency entrusted or authorized by the national radio regulatory agency shall have the equipment seized or confiscated, and may also be fined not more than 5,000 yuan. be fined or have their station license revoked.

Anyone who violates the regulations on the management of the establishment and use of radio stations (stations) and commits any of the following acts shall be given a warning and may be fined not more than 1,000 yuan; if the circumstances are serious, the equipment shall be sealed or confiscated and the equipment may be fined. A fine of not more than 5,000 yuan shall be imposed:

(1) Although the radio station (station) has been approved for establishment and use by the radio regulatory agency, it fails to obtain the People's Republic of China and the State Radio Station License within the prescribed time ;

(2) The procedures for the establishment and use of radio stations (stations) are incomplete or have expired, and formal procedures have not been completed within the prescribed time limit after being urged;

(3) Ships, The standard radio station on a motorcycle or aircraft fails to obtain the radio station license of the People's Republic of China and the State Council or register with the radio management agency in accordance with the regulations;

(4) The amateur radio station fails to apply for station establishment approval in accordance with the regulations Procedures or procedures are incomplete;

(5) Violating radio station call sign management regulations by compiling and using radio station call signs;

(6) Violating radio station license management regulations by lending, altering, or forging Radio station license or use of invalid radio station license;

(7) Using unapproved radio stations in emergency situations and failing to report in time;

(8) Deactivation or cancellation of radio stations Afterwards, the relevant procedures are not completed within the specified time;

Article 7 Whoever develops, produces, or imports radio transmitting equipment and commits any of the following acts shall be given a warning or fined not more than 1,000 yuan; if he fails to change after repeated admonitions and the impact is serious, the equipment shall be seized or confiscated, the illegal gains shall be confiscated, and a fine of not more than 1,000 yuan may be imposed. A fine of not less than RMB 5,000 but not more than RMB 5,000 shall be imposed;

(1) Developing radio transmission equipment without the approval of the national radio regulatory agency;

(6) The imported radio transmission equipment has not been reported to the national radio regulatory agency or the provincial, autonomous region, or municipality radio Approved by the regulatory agency;

(7) The frequency, frequency band and relevant technical indicators of the imported radio transmission equipment do not comply with the relevant national radio management regulations.

Article 8 Anyone who interferes with legal radio services and commits any of the following acts shall be given a warning or fined not more than 1,000 yuan; if the circumstances are serious and he intentionally interferes with legal radio services and causes a major communication accident, the equipment shall be sealed or confiscated, and may be combined with A fine of not less than 1,000 yuan but not more than 5,000 yuan will be imposed, and the radio station license will be revoked:

(1) The radio equipment installed and used does not comply with radio management technical standards and relevant regulations, causing harmful interference to radio services;

(4) Using substandard industrial, technological, medical equipment and other non-radio equipment to cause harmful interference to radio services;
