Legal Basis: Article 40 of the Environmental Protection Law of the People's Republic of China
The State promotes clean production and resource recycling.
The relevant departments of the State Council and local people's governments at all levels shall take measures to promote the production and use of clean energy.
Enterprises shall give priority to the use of clean energy, and adopt processes and equipment with high resource utilization rates and low pollutant emissions, as well as waste utilization technologies and harmless treatment technologies for pollutants, so as to reduce the generation of pollutants.
Article 41
Facilities for the prevention and control of pollution in construction projects shall be designed, constructed and put into operation at the same time as the main project. The facilities for the prevention and control of pollution shall conform to the requirements of the approved environmental impact assessment documents and shall not be removed or left unused without authorization.
Article 42
Enterprises, institutions and other producers and operators emitting pollutants shall take measures to prevent and control pollution and hazards to the environment caused by waste gases, waste water, waste residue, medical waste, dust, malodorous gases, radioactive substances as well as noise, vibration, optical radiation and electromagnetic radiation generated in the course of production and construction or other activities.
Enterprises and institutions that emit pollutants should establish an environmental protection responsibility system to clarify the responsibilities of unit heads and relevant personnel.
Key emissions units should be in accordance with the relevant provisions of the state and monitoring specifications for the installation and use of monitoring equipment, to ensure the normal operation of monitoring equipment, save the original monitoring records.
It is strictly prohibited to discharge pollutants illegally through concealed pipes, seepage wells, seepage pits, irrigation or tampering, falsification of monitoring data, or improper operation of pollution prevention and control facilities to avoid supervision.
