Hebei Province, the implementation of the Chinese People's **** and the State Road Traffic Safety Law Measures

Chapter I General Provisions

Article 1 According to the "Chinese People's **** and the State Road Traffic Safety Law" and the "Chinese People's **** and the State Road Traffic Safety Law" and "Regulations for the Implementation of the Road Traffic Safety Law", combined with the actual situation in this province, the formulation of these measures.

Article 2 These Measures shall apply to vehicle drivers, pedestrians, riders and units and individuals related to road traffic activities within the administrative area of this province.

Article 3 The people's governments at or above the county level shall strengthen road traffic safety, increase the investment in road traffic safety infrastructure and scientific and technological management tools, improve the modernization of road traffic safety management, to ensure that the road traffic safety work and economic construction and coordinated development.

People's governments at or above the county level shall establish a road safety coordination mechanism and accountability system for road safety; in the road safety work has made outstanding contributions to the citizens, legal persons and other organizations to be commended, rewarded.

Township (township) people's government shall supervise the implementation of road traffic safety units, timely elimination of traffic safety hazards.

Article 4 The traffic management departments of the public security organs of the people's governments at or above the county level are responsible for the management of road traffic safety in their administrative regions.

The competent departments of agriculture (agricultural machinery) of the people's governments at or above the county level are responsible for the registration of tractors traveling on the road and the issuance of registration certificates, license plates, travel permits, safety and technical inspection marks, as well as the driver's examination and driver's license issuance, validation and management of the use of management.

The people's governments at or above the county level, such as transportation, construction, planning, urban management, supervision and management of production safety, quality and technical supervision, industrial and commercial administration, environmental protection, health, supervision, education, finance and pricing and other departments shall, in accordance with their respective responsibilities, to do a good job in the work related to road traffic safety.

Article 5 of the press, radio, television, Internet and other news media should be often road safety publicity and education, timely release of road safety public service announcements, road safety information and road safety management measures.

Chapter II Vehicles and Drivers

Article 6 Driving a motor vehicle on the road, in addition to complying with the relevant provisions of road traffic safety laws and administrative regulations, shall also comply with the following provisions:

(a) shall not be hung with other than the legal motor vehicle license plate;

(VII) shall not be installed, the use of photoelectric equipment affecting road traffic safety, loud speakers, high-power audio and other devices.

Article 7 of the end-of-life motor vehicle recycling enterprises in the recycling of end-of-life motor vehicles, should be registered in the end-of-life motor vehicle owner's identification and motor vehicle license plate number, engine number, car driver number and other information, and to the owner of the motor vehicle to the end-of-life automobile recycling certificate.

Article 8 In accordance with the law should be registered non-motorized vehicles, by the public security organs of the traffic management department after registration, before they can be on the road.

The types of non-motorized vehicles that should be registered in accordance with the law shall be prescribed by the provincial people's government in accordance with the actual situation in the province.

Article IX police cars, fire engines, ambulances, engineering rescue vehicles to install and use sirens and sign lamps, shall be reported to the provincial public security organs of the traffic management department for approval, to obtain the use of documents.

Article X pick up and drop off primary and secondary school students and kindergarten children of the school bus driver, should have more than three years of driving experience in the corresponding type of safe driving.

Article XI of the public security organs and traffic management departments and their traffic police to deal with road traffic safety violations, should record the motor vehicle driver's road traffic safety violations, cumulative demerit points, administrative penalties and road traffic accidents and other information, and to the motor vehicle driver and his unit, the insurance agency and the relevant departments to provide.

The public security organs of the traffic management department shall provide network query, cell phone text messaging query, telephone query and traffic police to help query and other ways to facilitate the relevant units and individuals to query traffic safety information.

Article XII of the public security organs of the traffic management department should be centralized traffic management business places to set up information query window or electronic query device, conditions can be on the Internet to establish a traffic management information home page, to facilitate public inquiries for motor vehicle registration and application for motor vehicle driver's license, and other relevant provisions and related information.

Article XIII of the public security organs of the traffic management department to implement the time limit for vehicle licensing public commitment system. Chapter III Road Access Conditions

Article 14 The administrative department in charge of planning in the approval of large-scale construction along urban roads, as well as other major construction projects, shall, in conjunction with the public security organs of the traffic management department of the traffic impact assessment, does not meet the requirements of road safety, smooth flow of traffic, shall be adjusted.

Article 15 of the new construction, reconstruction and expansion of roads, traffic safety facilities should be designed at the same time as the road, while construction, while acceptance, while put into use.

The sidewalks of major urban roads, should be set up to facilitate the disabled access to the blind, curb ramps.

Article XVI of the urban roads, traffic signals, traffic signs, traffic markings and traffic barriers and other traffic safety facilities, by the local public security organs of the traffic management department is responsible for setting and maintenance. Units and individual self-built road traffic safety facilities that allow the passage of social motor vehicles, by the unit or individual is responsible for setting and maintenance.

Article XVII of the road authorities shall enter and exit the national highways, provincial highways and county roads at the intersection of the obvious location, set up standardized warning signs, give way signs, markings and deceleration devices.

Article XVIII of the project construction needs to interrupt the highway, national highways, provincial highways, traffic management shall obtain the consent of the provincial public security organs of the traffic management department; the need for half closed, shall obtain the consent of the municipal public security organs of the traffic management department.

In case of traffic congestion or other emergencies, the public security organs of the traffic management department may require the temporary suspension of road construction operations, temporary restoration of access.

Article 19 of the public security organs of the traffic management department in the urban roads to designate parking spaces, shall seek the views of the competent departments of urban roads in writing, and according to the changes in traffic flow, the use of parking spaces to adjust the time. Other units and individuals shall not set up or remove parking spaces on urban roads, or set up parking barriers in parking spaces.

Article 20 The people's governments at or above the county level shall, in accordance with the development of urban and rural areas and the transportation needs of residents, give priority to the development of public **** transportation, convenient for urban and rural residents to travel.

Opening up, adjusting the public **** car, coach and tourist bus routes, stations, the relevant competent authorities for approval shall be heard before the public security organs of the traffic management department and residents along the route.

The public security organs of the traffic management department in conjunction with the relevant departments, according to the local traffic conditions, you can set up temporary parking sites for cabs on major urban roads. In the city roads with temporary parking sites, cabs are not allowed to stop outside the site to pick up and drop off passengers.

Chapter IV Road Traffic Regulations

Section I General Regulations

Article 21 In the event of large-scale mass activities, extensive construction and other circumstances, the public security organs and traffic management departments need to take measures to restrict traffic or make decisions directly related to the public's road traffic activities, shall be announced to the public in advance.

Article 22 in the restricted area or section of the motor vehicle really need to pass, shall be accompanied by the public security organs of the traffic management department issued by the pass, and in accordance with the specified time, area, route.

Article 23 of the motor vehicle shall be traveling in the motorway. In the same direction of the road to set up more than two motor vehicle lanes, freight motor vehicles, large passenger motor vehicles, low-speed goods vehicles, three-wheeled vehicles, tractors, wheeled special-purpose machinery vehicles, empty cabs and internship drivers driving motor vehicles, should be in the slow lane, motorcycles should be in the most right-hand lane. Non-motorized vehicles shall drive in non-motorized lanes; on roads without non-motorized lanes, they shall drive on the right side of the carriageway.

Pedestrians should walk in the sidewalk; if there is no sidewalk, they should walk by the side of the road.

Article 24 The local people's governments at or above the county level may, in accordance with the road traffic situation in the central area of the city, impose restrictions on large trucks, motorcycles, human-powered tricycles and motorized tricycles entering the central area of the city, and the contents of the restrictions shall be decided and announced after a hearing.

Section 2: Regulations on the Movement of Motor Vehicles

Article 25 A motor vehicle may borrow a lane or change lanes when it does not interfere with the normal movement of other vehicles, but it shall abide by the following provisions:

(1) Letting the vehicle moving in the borrowed lane go first;

(2) Driving in order in sequence without changing lanes frequently;

(3) Vehicles moving in the slow-speed lane shall be in the slow-speed lane, but the vehicle in the slow-speed lane shall be in the slow-speed lane. (C) Slow lane driving vehicles, in the fast lane does not interfere with the normal operation of the vehicle, allowed to borrow the lane overtaking, but overtaking immediately after the return to the original lane;

(D) left and right lanes of the vehicle to the same lane change, the left lane of the vehicle to let the right lane of the vehicle to go first;

(E) fast lanes of the vehicle below the minimum speed required to drive, and in time to change to the slow lane. (e) If a vehicle traveling in the fast lane is traveling below the minimum speed limit, change to the slow lane in time.

Article 26 In the time specified by the traffic management department of the public security organs, the bus-only lanes are allowed to transport primary and secondary school students and kindergarten children on school buses; in case of traffic control, traffic congestion and other circumstances, under the direction of traffic police, other vehicles can borrow the bus-only lanes.

Article 27 The maximum speed of a motor vehicle in the same direction of two or more motor vehicle lanes and not set the speed limit signs, markings of the road, in the city of closed motor vehicle roads for ninety kilometers; in the city of unsealed motor vehicle roads for sixty kilometers; in the highway for eighty kilometers.

Article 28 The road in front of schools, kindergartens, nursing homes, hospitals do not have crossing facilities, shall be demarcated pedestrian crossing lines, set up signs.

Motor vehicles encounter blind people, walking disabled, pregnant women, elderly or children, should stop and give way.

Article 29 A motor vehicle turning on the road, changing lanes, overtaking, turning or stopping by the side of the road, shall turn on the turn signal one hundred meters to fifty meters in advance.

Article 30 When a motor vehicle drives into or out of a road, it shall give way to pedestrians and vehicles traveling normally on the road; when it drives into or out of a road with a main road or a side road, the motor vehicle driving into the main road shall give way to vehicles traveling normally on the main road and out of the main road.

Article 31 Motor vehicles shall slow down when traveling on roads that are waterlogged, muddy or prone to dusty traffic and pedestrians and vehicles.

Article 32 It is forbidden to carry people in the trailers, semi-trailers, flatbed trucks, crane trucks, automatic dump trucks and tractor trailers.

Article 33 A motor vehicle towing a broken down motor vehicle on the road shall comply with the following provisions:

(1) The driver of the towing vehicle and the towed vehicle has obtained a motor vehicle driver's license for more than one year;

(2) When towing at night with a soft connection, reflective markings are set on the towing device;

(3) Where a road is divided into two or more motor vehicle lanes in the same direction, the driver shall not be allowed to carry a person in the trailer of a tractor. If there are two or more motor vehicle lanes in the same direction, the vehicle shall be driven in the slow lane;

(d) If the road is equipped with side roads, the vehicle shall be driven on the side roads;

(e) A fully mounted trailer or a motor vehicle carrying dangerous goods shall not tow a broken down motor vehicle.

Article 34 Motor vehicles parked on the road, temporary parking shall comply with the following provisions:

(a) If there is no parking lot or traffic signs, markings provided for on-road parking spaces, park in a location that does not impede the flow of traffic;

(b) Parked in the direction of the downstream direction, the body of the vehicle immediately adjacent to the line of the right-hand edge of the road, not more than thirty centimeters;

(c) At night when there are no street lamps or in case of fog, rain, snow, sand and dust and other low visibility meteorological conditions, turn on the hazard warning flashers, lights and rear lamps;

(d) public **** cars close to the curb, in order, in a single row in and out of the parking site, shall not be parked outside the site to pick up and drop off passengers.

Article 35 Driving a test vehicle on the road shall comply with the following provisions:

(1) The driver shall obtain a motor vehicle driver's license for a period of one year or more;

(2) Driving at the time and on the route designated by the public security organs and the traffic management department;

(3) No passengers who are not related to the test vehicle shall be allowed to ride on the test vehicle;

(4) The brake test shall not be conducted. Brake test.

Article 36 Freight motor vehicles carrying easily spilled, scattered loads, shall use closed cargo compartments or other means of sealing tightly.

Article 37 Cargo motor vehicles carrying over-limit non-disintegrable carriers shall, in accordance with the requirements of the public security organs of the traffic management department, to take measures to ensure traffic safety, the required road survey and traffic organization and diversion costs, paid by the carrier.

Article 38 The tractor is prohibited on urban expressways, motor vehicle-only roads and main roads of national and provincial highways with side roads. Roads that prohibit the passage of tractors, at the entrance shall be set up a clear sign of prohibition.

Tractors need to pass through the restrictions on the passage of the road for the transfer operation, with the driver's license obtained in accordance with the law and the passage of documents.

Section III non-motorized vehicles, pedestrians and occupants of the passage regulations

Article 39 Driving a non-motorized vehicle shall comply with the following provisions:

(a) in the non-motorized lane in the downward direction;

(b) shall not enter the urban expressway and motor vehicle-only roads;

(c) with the neighboring non-motorized vehicles traveling at a safe distance, the vehicle width of one meter or more, the driver shall indicate a turn. Non-motorized vehicles with a body width of one meter or more shall not run in parallel;

(d) Avoid pedestrians when driving on roads mixed with pedestrians or passing through pedestrian crossings;

(e) Do not drive or stop in the non-motorized vehicle no-drive zones at intersections;

(f) Turn on turn signals before turning and making U-turns if turn signals are provided;

(g) The brake shall not fail and shall not be driven on the road. Failure of the brake shall not be on the road;

(h) bicycles shall not carry persons who have reached the age of twelve years, and persons under the age of sixteen years shall not be allowed to drive bicycles;

(ix) driving human tricycles shall not be more than two people, and motorized wheelchair vehicles for the disabled can only be accompanied by a companion.

Article 40 Pedestrians on the road shall not do the following:

(1) sit, lie down, stay, play, sell, send articles, advertisements, or beg or ask for property on the carriageway;

(2) cross, straddle, or sit on the road separating facilities;

(3) herd livestock on the roads in the center of the city of large and medium-sized cities, and on the roads reserved for motor vehicles.

Pedestrians walking on the sidewalk in case of obstacles can not pass, you can borrow the adjacent carriageway, passing vehicles should avoid.

Article 41 The following provisions shall be observed when riding a motor vehicle:

(1) No one shall get into or out of a motor vehicle before it stops;

(2) No one shall pickpocket a vehicle, get into or out of a vehicle through a window, or stop a motor vehicle at a place where it is prohibited to stop;

(3) No one shall ride in a motor vehicle when he knows that the driver of the motor vehicle has been drinking;

(4) No one shall ride in a two-wheeled motorcycle when the driver of the motorcycle is drunk;

(5) No one shall ride in a two-wheeled motorcycle when he knows that the driver of the motorcycle is drunk; and (d) Riding on a two-wheeled motorcycle shall be on the rear seat of the driver.

Section 4: Special Provisions for Highways

Article 42 In case of natural disasters, adverse weather conditions, construction or traffic accidents that seriously affect traffic safety, the traffic management department of the public security organs may take traffic control measures such as limiting the speed of vehicles, changing lanes, temporarily interrupting the passage, or closing the highway. Take traffic control measures, shall promptly inform the relevant departments, and set up traffic signs, announcements.

Article 43 In addition to the implementation of highway traffic safety management or traffic accident handling tasks of police cars, fire engines, ambulances, engineering rescue vehicles, motor vehicles traveling on the highway in the event of traffic congestion ahead, the vehicle stops to queue up or slow moving, should be parked in order to wait and drive. May not be on the right shoulder or emergency lane driving, parking.

Article 44 In the highway motor vehicle breakdown or in the event of the carrier spilled, floating and driver, passenger sudden illness and other emergency needs to be stopped immediately, shall be on the right shoulder or emergency lane parking.

Chapter V Traffic Accident Prevention and Handling

Article 45 The people's governments at or above the county level shall formulate contingency plans to cope with natural disasters, adverse meteorological conditions and other emergencies affecting road traffic safety. Public security, transportation, construction, health, environmental protection, as well as other relevant departments, shall develop specific implementation programs.

Article 46 State organs, enterprises, institutions, social groups and other organizations shall establish and implement the unit within the road traffic safety prevention responsibility system, and into the comprehensive management of social security assessment:

(a) the establishment of the motor vehicle belonging to the driver of the road traffic safety education and training, assessment and management system;

(b) the establishment of this unit (B) the establishment of the unit of the use of motor vehicles belonging to, maintenance, repair, inspection system, to keep the vehicle in line with national safety standards;

(C) professional transport units and motor vehicles should be equipped with traffic safety personnel.
