Gansu Province, the implementation of the "Regulations on the Administration of Medical Institutions" approach

Chapter I General Provisions Article 1 In order to strengthen the management of medical institutions, promote the development of health undertakings, to protect the health of citizens, according to the State Council issued the "Regulations on the Management of Medical Institutions" (hereinafter referred to as the Regulations) and the Ministry of Health issued the "Regulations on the Implementation of Medical Institutions" (hereinafter referred to as the Rules) of the relevant provisions of the actual situation of the province, the formulation of these measures. Article 2 These Measures shall apply to all levels and types of medical institutions engaged in disease diagnosis, treatment and related medical activities within the jurisdiction of this province.

Family planning technical services, forensic technical identification and other related institutions outside the scope of business to carry out diagnostic and therapeutic activities; blood centers, central blood stations, single plasma stations; drug dependence treatment hospitals (stations, institutes) and other diagnostic and therapeutic institutions must be based on the measures, apply for the establishment of the corresponding category of medical institutions. Article III of the People's Liberation Army and the People's Armed Police Force in Gansu outside the establishment of medical institutions, by the people's governments above the county where the health administrative departments in accordance with the "Regulations," the "Rules" and the management of these Measures; establishment of medical institutions open to the community must be approved by the people's governments above the county where the record of the health administrative departments. Article 6 the people's government above the county level health administrative department is the competent authority to approve the establishment of medical institutions, other units and individuals do not have the right to approve the establishment of medical institutions. Article VII of medical institutions set up approval authority is divided as follows:

A provincial health administrative department is responsible for the approval of medical institutions:

(a) beds in more than 100 general hospitals and beds in more than 60 Chinese medicine hospitals, Chinese and Western medicine hospitals, ethnomedicine hospitals, convalescent hospitals, rehabilitation hospitals, maternity and child health care hospitals, first aid stations;

(b) a variety of specialized Disease Control Institutions;

(iii) Provincial Medical Institutions;

(iv) Medical Institutions set up with beds founded by the Central Government in Gan and the provincial departments and enterprises;

(v) Drug Dependence Treatment Institutions, Institutes and Stations;

(vi) Blood Centers, Central Blood Stations, and Mono-Precipitation Plasma Stations;

(vii) The Chinese People's Liberation Army and the Chinese People's Armed Police Force in Gan set up beds outside the establishment of medical institutions.

Two, prefecture, state and municipal health administrative departments are responsible for the approval of medical institutions:

(a) general hospitals with fewer than 100 beds (excluding 100) and hospitals of traditional Chinese medicine with fewer than 60 beds (excluding 60), ethnomedicine hospitals, rehabilitation hospitals, and women's and children's health care centers;

(b) nursing homes;

(c) central health centers

(4) comprehensive outpatient clinics, specialized outpatient clinics, Chinese medicine outpatient clinics, Chinese and Western medicine outpatient clinics, ethnic medicine outpatient clinics, clinics, Chinese medicine clinics, ethnic medicine clinics, health centers, health care centers, and health stations within the cities (towns) of the counties (cities and districts);

(5) the central government in Gansu and provincial departments and enterprises and institutions directly under the central government. Founded by the medical institutions without beds;

(F) the Chinese People's Liberation Army and the Chinese People's Armed Police Force stationed in Gansu outside the establishment of medical institutions without beds;

(VII) the provincial health administrative department for approval (excluding the provincial health administrative department of the province and the central government enterprises and institutions founded in Gansu) of the medical institutions of the preliminary examination.

County (city, district) health administrative department responsible for the approval of medical institutions:

(A) township (township) health centers, comprehensive outpatient clinics, specialized outpatient clinics, Chinese medicine outpatient clinics, Chinese and Western medicine clinics, ethnomedicine outpatient clinics;

(B) clinics, Chinese medicine clinics, clinics of ethnomedicine, clinics, clinics, clinics, health centers, health clinics, health clinics, health stations, nursing station;

(C) the provincial health administrative department for approval (not including provincial health administrative departments and central enterprises founded by the Gan. /p>

(3) Article 7 above, except for paragraph 2, item 7 of the preliminary examination and approval of the establishment of medical institutions;

(4) other medical institutions. Article 8 shall not apply for the establishment of a medical institution if there are any of the circumstances listed in Article 12 of the Rules and the following:

(1) the staff of medical institutions of all levels and types, retirees retired due to illness; those who are on leave without pay (except for those who have set up a medical institution in a township or a district below a township);

(2) those who have been dismissed from their official positions by a medical institution within six years, or who have completed the period of probation within two years, or who have been subjected to disciplinary actions of demotion, reduction in rank or above; and demotion, demotion or more punishment for less than 2 years, as well as unauthorized departure for less than 5 years of medical personnel;

(3) individuals suffering from infectious diseases have not yet recovered or other health reasons are not suitable for the practice of medicine. Article IX in the city (including county-level towns) to set up outpatient clinics, clinics, health clinics (rooms) individuals must have the following conditions:

(a) by the physician practice of technical assessment, obtain the "Physician License";

(b) obtain the "Physician License" or the title of physician, in the second level or above, engaged in the clinical work of the same specialty for more than five years;

(c) Permanent household registration and identity card in the town in which they live.

In the general townships and villages to set up clinics, outpatient clinics, health centers (rooms) of the conditions of the individual:

(a) obtain a physician's certificate, physician's title or by the provincial people's government health administrative department of the technical assessment, to obtain the "Physician (Doctor) Certificate of Competence";

(b) obtain the "Physician License" or obtain the physician's title in the first level of the above medical institutions Engaged in the same professional clinical work for more than 3 years; obtain the "medical doctor practice certificate" or obtain the title of medical doctor, in a medical institution above the first level engaged in the same professional clinical work for more than 5 years;

(c) have in the county (city, district) permanent household registration and identity card.
