Decision of the Standing Committee of the Hainan Provincial People's Congress on Amending the Regulations on Earthquake Prevention and Disaster Reduction in Hainan Province (2007)

I. Articles 2 and 3 are merged into Article 2, which is amended to read as follows: "These Regulations shall apply to earthquake and volcano monitoring and forecasting, disaster prevention, emergency rescue, restoration and reconstruction, and other earthquake prevention and disaster reduction activities within the administrative area of this province."

The relevant provisions of these Regulations, "earthquake" is amended to "earthquake, volcano". Article 5 is changed to Article 4, and the second and third paragraphs are merged into one paragraph as the second paragraph, which is amended as follows: "The Seismological Bureau of the People's Government of the same level shall be the administrative department for earthquake prevention and disaster reduction in the provinces, cities, counties and autonomous counties." Third, Article 6 is changed to Article 5, and amended to read: "The people's governments at or above the county level shall incorporate the work of earthquake prevention and disaster reduction into the planning of national economic and social development, and shall arrange for funding in accordance with the needs of the work of earthquake prevention and disaster reduction, which shall be included in the annual financial budgets of the governments at this level. The overall level of funding should be gradually increased in line with the development of the national economy and the growth of fiscal revenues.

"The administrative departments of the people's governments at or above the county level in charge of earthquake prevention and disaster reduction participate in the preparation and validation of urban and rural planning at the same level." Fourth, Article 8 was changed to Article 6, and amended to read: "The people's governments at all levels and their relevant departments shall strengthen publicity and education on earthquake prevention and disaster reduction, popularize the knowledge of earthquake prevention and disaster reduction, encourage and support scientific and technological research on earthquake prevention and disaster reduction, and popularize the application of advanced scientific research results.

"The news media shall take various forms to carry out publicity and education on knowledge of earthquake prevention and disaster reduction, and enhance citizens' awareness of earthquake prevention and disaster reduction.

"Schools should include knowledge of earthquake prevention and disaster reduction in their educational content, and conduct the necessary training in earthquake prevention and disaster reduction.

"The last week of July each year for the province's earthquake prevention and disaster reduction publicity week." V. Delete the second paragraph of Article VII. Sixth, Article 10 was changed to Article 9, and add a paragraph as paragraph 3: "The administrative department for earthquake prevention and disaster reduction should strengthen the marine seismic monitoring, in the implementation of the monitoring of earthquakes that may cause tsunamis, it should be timely notification of the monitoring of the administrative department of the ocean to assist the administrative department of the ocean to do a good job in monitoring and forecasting of earthquakes and tsunamis. " Seventh, Article 16 and Article 17 are merged into Article 15, amended to read: "The people's governments of the places where earthquake and volcano monitoring stations are located shall strengthen the protection of earthquake and volcano monitoring facilities and their observation environment. No unit or individual shall jeopardize earthquake and volcano monitoring facilities and their observation environment. The provincial administrative department for earthquake prevention and disaster reduction, in conjunction with the people's governments of the cities, counties and autonomous counties where the earthquake and volcano monitoring facilities are located, shall, in accordance with the relevant national standards, delineate the scope of protection of the observational environment, and report it to the provincial people's government for the record, and notify the relevant departments.

"New construction, alteration and expansion of construction projects shall follow the national standards on environmental protection of earthquake and volcano observation, so as to avoid causing harm to earthquake and volcano monitoring facilities and their observation environment. For construction projects within the scope of earthquake and volcano observation and environmental protection, the relevant departments of urban and rural planning and other relevant departments shall, before approving the project, obtain the prior consent of the administrative department responsible for earthquake prevention and disaster reduction, and if the administrative department responsible for earthquake prevention and disaster reduction does not give its consent, the project shall not be constructed. Construction of national key projects, in accordance with the relevant provisions of the State.

"Within the scope of environmental protection for earthquake and volcano observation, in addition to the construction activities stipulated in the preceding paragraph, it is prohibited to set up wireless signal transmitting devices, vibration operations and reciprocating mechanical movements, quarrying, mining, blasting and other activities which may affect the observation of earthquakes and volcanoes." Eight, Article 20 was changed to Article 18, amended to read: "The administrative department for earthquake prevention and disaster reduction of the people's government at or above the county level is responsible for the evaluation of the seismic safety of construction sites within the administrative area and the management and supervision of the seismic fortification requirements. The provincial administrative department in charge of earthquake prevention and disaster reduction carries out the validation of the results of the relevant seismic safety evaluation in accordance with national regulations." Nine, Article 21 and Article 22 are merged into Article 19, amended to read: "New construction, expansion and alteration of construction projects must meet the requirements for earthquake-resistant defenses.

"The following construction projects must be evaluated for seismic safety, and based on the results of the evaluation to determine the seismic requirements:

"(1) highways and railroads, large-scale overpasses, a single span of more than 100 meters or multiple spans with a total length of more than 500 meters of the bridge;

"(ii) Important stations of railroad trunk lines, major construction projects of railroad hubs;

"(iii) Expressways, high-speed railroads, viaducts, urban light railroads, underground railroads;

"(iv) Tunnel projects with a length of more than 1,000 meters;

"(E) international and domestic airports in the air terminal building, air traffic control building, large hangar projects;

"(F) annual throughput ≥ 1 million tons of port projects or more than 10,000 tons of berths, more than 20,000 tons of dockyard projects;

"(VII) Ⅰ level hydraulic buildings and dams of large reservoirs of 100 million cubic meters or more;

"(viii) thermal power projects with a total installed capacity of ≥300,000 kilowatts, and ≥200,000 kilowatts of hydropower projects;

"(ix) pivotal substation projects of 500,000 volts or more;

" (x) important buildings such as joint stations, compressor houses, pumping stations of pressurized gas stations of large oil and gas fields, receiving and storage facilities for crude oil, natural gas and liquefied petroleum gas, oil and gas pipelines and pipeline first and last stations, and pressurized pumping stations;

"(xi) offshore oil and natural gas production platforms and drilling platforms;

" ( (XII) broadcasting center, television center above the municipal districts of the differential station, transmitter, host building;

"(XIII) long-distance telecommunication hubs above the county level, postal hubs, satellite communications earth station, program-controlled telephone terminals bureau, local network convergence bureau, emergency communications housing and other postal communications projects;

" (xiv) the main facilities of urban water supply, oil storage, gas projects;

"(xv) large-scale grain and oil processing plants and more than 150,000 tons of large-scale grain depots;

"(xvi) general hospitals or hospitals with more than 300 beds of outpatient buildings, ward buildings, medical buildings, medical technology buildings, important medical equipment rooms and central blood stations, etc.

"(xvii) urban sewage treatment plants and seawater desalination projects;

"(xviii) nuclear power plants, nuclear reactors, and nuclear heating devices;

"(xix) important military facilities;

"(xx) projects prone to serious secondary disasters of flammable, explosive and highly toxic substances;

"(xxi) large industrial and mining enterprises, large and medium-sized chemical and petrochemical production enterprises, large and medium-sized refineries of the main production equipment and its control system of the building, the production of highly toxic, flammable and explosive substances in the plant and its control system of the building;

"(xxii) annual output of more than 1 million tons of cement, more than 1 million cases of glass and other building materials industry projects;

"(xxiii) the peak acceleration of ground vibration of 0.05g and above the region of the hard, medium-hard site and the height of ≥ 80 meters, or the peak acceleration of ground vibration of 0.10g and above the region of the hard, medium-hard site, or the peak acceleration of ground vibration of 0.10g and above the height of ≥ 80 meters. Acceleration 0.10g and above in the region of medium-soft, soft sites and height ≥ 60 meters of high-rise buildings;

"(xxiv) provinces, municipalities and various types of disaster relief and emergency command facilities and disaster relief supplies reserve depot;

"(xxv) large theaters, large stadiums, large commercial service facilities, more than 8,000 square meters of teaching buildings and student apartment buildings, as well as museums and other public **** building to store national first- and second-class precious cultural relics;

"(26) the state must be evaluated for seismic safety of other projects;

"(27) the provincial government believes that should be evaluated for seismic safety of other projects. (xxvii) other projects for which the provincial government considers that seismic safety evaluation should be conducted.

"Industrial and civil construction projects other than those stipulated in the preceding paragraph shall be seismically defended in accordance with the ground shaking parameter zoning map issued by the state. If the construction unit needs the administrative department for earthquake prevention and disaster reduction to provide the requirements for seismic defenses, the administrative department for earthquake prevention and disaster reduction shall provide them in accordance with the law, and shall not charge a fee.''
