Gansu Province solid waste pollution prevention and control regulations

Chapter I General Provisions Article 1 In order to prevent and control the pollution of the environment by solid wastes, conserve and reasonably utilize resources, safeguard public health, maintain ecological security, promote the construction of ecological civilization, and promote high-quality and sustainable development of the economy and society, in accordance with the "Chinese People's Republic of China *** and the State of Solid Waste Pollution Prevention and Control of the Environment Law," "the Chinese People's Republic of China *** and the State Environmental Protection Law," and other laws, administrative regulations, and in conjunction with the actuality of this province, the Formulate these regulations. Article 2 The prevention and control of environmental pollution by solid wastes in the administrative area of this province shall be governed by these Regulations.

The prevention and control of environmental pollution by radioactive solid wastes shall not be subject to these Regulations.

The prevention and control of pollution by liquid wastes shall be governed by these Regulations; however, the prevention and control of pollution by wastewater discharged into water bodies shall be governed by the relevant laws and regulations and shall not be governed by these Regulations.

Laws and administrative regulations on the prevention and control of environmental pollution by solid wastes have been stipulated, in accordance with its provisions. Article 3 The prevention and control of environmental pollution by solid wastes adhere to the principles of minimization, resource utilization and harmlessness.

Any unit or individual shall take measures to reduce the generation of solid waste, promote the comprehensive utilization of solid waste and reduce the hazardous nature of solid waste. Article 4 solid waste pollution prevention and control of the environment adhere to the principle of responsibility for pollution.

Generation, collection, storage, transportation, utilization, disposal of solid waste units and individuals, should take measures to prevent or reduce solid waste pollution of the environment, the environmental pollution caused by the responsibility according to law. People's governments at or above the county level shall incorporate the prevention and control of solid waste pollution into national economic and social development planning, ecological and environmental protection planning, and formulate and implement economic and technological policies and measures conducive to the prevention and control of solid waste pollution.

Encourage and support the resourceful utilization and harmless disposal of solid wastes, improve the comprehensive utilization rate of solid wastes, and minimize the amount of solid wastes landfilled and dangerous.

Encourage and support scientific research, technological development, and informationization in the prevention and control of solid waste pollution and environment, and promote advanced prevention and control technologies, production processes and equipment.

Encourage and support all kinds of social investment bodies to participate in solid waste treatment and disposal project investment, construction and operation. Article 6 The competent department of ecological and environmental management of solid waste pollution prevention and control of the environment within the administrative region to implement unified supervision and management.

The competent departments of the people's governments at or above the county level in charge of development reform, industry and information technology, public security, natural resources, housing and urban-rural construction, transportation, water conservancy, agriculture and rural areas, commerce, health, emergency management, market supervision, education, environmental health, postal services and other competent departments are responsible for supervision and management of prevention and control of solid waste pollution of the environment within their respective areas of responsibility. Article 7 Promote green and low-carbon lifestyles and consumption patterns, guide the public to enhance awareness of ecological environmental protection, do a good job of classifying household garbage, and participate in the prevention and control of solid waste pollution of the environment. Article 8 The provincial people's government and the people's governments of the relevant provinces, autonomous regions and municipalities directly under the Central Government to establish cross-regional solid waste pollution of the environment, joint prevention and control mechanism, coordinating and coordinating cross-regional cooperation in the prevention and control of solid waste pollution, and promoting the prevention and control of solid waste pollution.

The relevant departments of the provincial people's government and the relevant departments of the people's governments of the relevant provinces, autonomous regions and municipalities directly under the Central Government to establish solid waste pollution environment communication and coordination mechanism, consulting to solve the specific issues of cross-regional cooperation in the prevention and control of solid waste pollution environment.

Encourage the province's administrative area of cities (states), counties (cities, districts), in accordance with the principle of proximity, regional cooperation, the establishment of solid waste pollution of the environment, joint prevention and control mechanisms, the construction of centralized disposal of solid waste facilities and sites, and to strengthen the management of solid waste information **** enjoyment and linkage of law enforcement. Article 9 The people's governments at all levels shall strengthen the prevention and control of solid waste pollution of the environment, and in accordance with the principle of division of authority, arrange the necessary funds for the following matters:

(1) scientific research and technological development for the prevention and control of solid waste pollution of the environment;

(2) classification of household garbage;

(3) construction of centralized solid waste disposal facilities;

(4) Major infectious disease outbreaks and other emergencies generated by the emergency disposal of medical waste and other hazardous waste;

(e) other matters relating to the prevention and control of environmental pollution by solid waste.

Use of funds should be strengthened performance management and audit supervision to ensure the effectiveness of the use of funds. Article 10 of the ecological and environmental authorities and other departments responsible for the supervision and management of solid waste pollution prevention and control of the environment shall be announced to the community to report complaints and channels.

Any unit or individual has the right to illegally dumping, transferring, disposing and storing solid wastes and other illegal acts causing environmental pollution complaints.

Reported departments should be dealt with in a timely manner and the informant's information shall be kept confidential; to the real name and verification of the report, and given a reward.

The informant reported the unit, the unit shall not terminate, change the labor contract or other means of retaliation against the informant.
