What property can not be mortgaged

The property that cannot be mortgaged includes land ownership, the right to use collectively owned land such as homesteads, self-reserved land, self-reserved mountains, and other property that has been seized and detained in accordance with the law, as well as other property that cannot be mortgaged as stipulated by laws and administrative regulations.

The following properties may not be mortgaged:

1, land ownership;

2, the right to use collectively owned land such as homesteads, self-reserved land, and self-reserved mountains, except for those that can be mortgaged as stipulated by the law;

3, educational facilities, medical and healthcare facilities, and other public welfare facilities of schools, kindergartens, and medical institutions, etc., which are set up for public welfare purposes by nonprofit legal persons.

4, property whose ownership or right of use is unknown or disputed;

5, property that has been seized, detained or supervised in accordance with the law;

6, other property that cannot be mortgaged as stipulated by laws and administrative regulations.

Property that can be mortgaged are:

1. Buildings and other land attachments;

2. Right to use land for construction;

3. Right to use sea area;

4. Production equipment, raw materials, semi-finished products, products;

5. Buildings, ships, aircraft under construction;

6, Transportation means;

7. Other properties not prohibited from being mortgaged by laws and administrative regulations.

To summarize, the mortgage is ultimately to dispose of the subject matter of the price of priority compensation, so in principle, transferable property can be mortgaged, non-transferable property can not be mortgaged.

The following properties may not be mortgaged:

(1) property of which the ownership or the right of use is not clear or is disputed;

(2) property that has been seized, detained, or supervised in accordance with the law;

(3) other properties which may not be mortgaged as stipulated by the laws and administrative regulations. (c) Other properties that laws and administrative regulations stipulate shall not be mortgaged.
