Primary School Management Regulations

Chapter I General Provisions

Article 1 In order to strengthen the standardized management within the elementary school, to fully implement the education policy, and to comprehensively improve the quality of education, the regulations are formulated in accordance with the Education Law of the People's Republic of China **** and the State of China, as well as other relevant education laws and regulations.

Second Article The elementary school referred to in these regulations are institutions for the implementation of general primary education for children organized by the government, enterprises, public organizations, social groups, other social organizations and individual citizens in accordance with the law.

Article 3 Primary schools implement compulsory primary education. The duration of elementary school is six or five years. Provinces, autonomous regions and municipalities directly under the Central Government may determine the number of years of study in elementary school in their own administrative regions in accordance with the actual situation.

Article 4 Elementary schools shall carry out the policy that education must serve the modern construction of socialism, must be combined with productive labor, and must cultivate builders and successors of the socialist cause who are fully developed morally, intellectually and physically.

Article 5 Elementary school education shall be connected with pre-school education and education at the lower secondary school level; it shall lay the foundation for education at the lower secondary school level through the implementation of educational and teaching activities on the basis of pre-school education and through the lively and active development of the educated.

Article 6 The objectives of elementary school education are: initial love of the motherland, love of the people, love of labor, love of science, love of socialism, ideological feelings; the sense of abiding by social morality, collective consciousness and civilized habits of behavior; good will, character and lively and cheerful personality; self-management, the ability to distinguish between right and wrong.

To have the basic knowledge and skills of reading, writing, expression and calculation, to understand some general knowledge of life, nature and society, to have the preliminary ability of observation, thinking, hands-on operation and study, and to develop good study habits. To learn the methods of reasonable exercise and body care, to develop the habit of hygiene, and to have a healthy body and preliminary ability to adapt to the environment. To have a wide range of interests and a healthy love of beauty.

Article 7 The basic language of instruction in elementary school shall be Chinese characters. Schools shall promote the use of Putonghua and standardized characters. Schools enrolling predominantly ethnic minority students may use the language and script common to their own or local ethnic groups for teaching, and shall offer language courses at appropriate grades in accordance with the actual situation.

Article 8 Primary schools shall implement the principal's responsibility system, and the principal shall be fully responsible for the administrative work of the school. In rural areas, the system of responsibility of the principal of the central primary school may be implemented as appropriate.

Article 9 Primary schools, in accordance with the principle of "hierarchical management and division of responsibility", implement education under the leadership of the local people's government.

Chapter II enrollment and school registration management

Article 10 of the elementary school enrollment of children aged 6 years old, the conditions are not available in the region, can be delayed until the age of 7 years. Elementary school start in the fall. Elementary school shall, in accordance with the provisions of the Compulsory Education Law and its implementing rules, under the leadership of the local government, organize the enrollment of school-age children in their service areas on time and in their immediate vicinity without examination. The service area of an elementary school shall be determined by the competent educational administrative department.

Article 11: Primary schools shall adopt the system of teaching in classes, which shall be organized in the form of a single class, or in duplicate if conditions are not favourable. The number of teaching classes shall not exceed 45.

The size of the school should be conducive to teaching, students' physical and mental health, ease of management, and improve the efficiency of the school.

Article XII of the elementary school for students who are unable to continue their studies due to illness (must have a certificate from a designated medical unit) can be permitted to take a break from school after approval by the relevant departments. If a student is absent from school for more than three months, the school may, upon his resumption of study, assign him to the appropriate grade according to his actual academic ability and after consulting himself and his parents or other guardians.

Article 14 Primary schools may allow students who have excellent academic performance and who have reached the level of academic ability of higher grades in advance to be promoted to the corresponding grades in advance, and at the same time report them to the competent authorities in charge of education for the record.

Article 15 Primary schools shall commend students who have excellent academic performance, criticize and educate students who have made mistakes, and give warnings, serious warnings and demerits to the very few students who have made more serious mistakes.

Elementary schools may not expel students.

Article 16 Primary schools shall prevent students who have not completed the prescribed years of compulsory education from dropping out of school, and if they find that a student has dropped out of school, they shall immediately report it to the competent authorities, and cooperate with the relevant departments to reinstate him or her in school in accordance with the law, and to do a good job of it.

Article 17 Specific measures for the management of school registration in elementary school shall be formulated by the provincial education administrative departments.

Chapter III: Education and Teaching

Article 18 The main task of elementary school is education and teaching. All other work should be conducive to the principle of education and teaching work.

Article 19 Elementary schools shall carry out educational and teaching work in accordance with the curriculum plan and syllabus issued by the national or provincial education administrative departments.

In their educational and teaching work, elementary school shall give full play to the overall function of subject classes and activity classes, educate students in moral, intellectual, physical, aesthetic and labor education, and lay the foundation for the all-round development of students.

Article 20 Elementary schools shall actively carry out research on education and teaching, use educational theories to guide educational and teaching activities, and actively promote the results of scientific research and successful experience.

Article 21 Elementary schools shall place moral education in an important position, the principal is responsible for, and the staff participate in, teaching, management and service.

School education should be combined with family education and social education.

Article 22 Elementary schools shall set up a class teacher in each teaching class, responsible for managing and guiding the work of the class. Class teacher teachers should be in close contact with teachers of all subjects, students' parents, to understand the students' thinking, morality, behavior, academics and other aspects of the situation, coordination and cooperation in the implementation of education for students.

The classroom teacher must write a comment on the student's conduct every semester.

Article 23 Primary schools shall focus on positive education for students, affirming achievements and progress, pointing out shortcomings and deficiencies, without irony, sarcasm, rough pressure, and strictly prohibit corporal punishment and corporal punishment in disguise.

Article 24 Teaching in elementary school shall be geared to all students, adhering to the principle of teaching students according to their aptitude and giving full play to the main role of the students; emphasis shall be placed on the teaching of basic knowledge and the training of basic skills, stimulating interest in learning, and fostering the correct learning methods and habits.

Article 25 Elementary schools shall arrange school work in accordance with the school calendar issued by the educational administrative department. Elementary schools shall not suspend classes at will; if classes must be suspended in special circumstances, the principal shall decide to suspend classes for one day or less and report it to the county administrative department of education for the record; if more than one day or less than three days, it shall be approved by the people's government at the county level.

Primary schools shall not organize students to participate in commercial celebrations, performances and other activities, and other social activities should not affect the teaching order and the normal work of the school.

Article 26 of the elementary school to rationalize the arrangement of work and rest time. Students in school daily for educational activities in grades five and six up to six hours, other grades should be appropriately reduced. After school, evenings and holidays shall not be arranged for students to make up or new classes.

After-school homework content should be selected, the difficulty should be moderate, the number should be appropriate, and the relevant regulations should be strictly enforced to ensure that the students' academic burden is appropriate.

Article 27 The teaching materials used in elementary school shall be validated by the national or state-authorized provincial textbook validation department. Experimental and vernacular teaching materials shall be approved by the relevant educational administrative departments before they are used.

Primary schools shall not require the unified organization of students to buy all kinds of learning materials. The use of learning aids and other students to strengthen the guidance.

Article 28 of the elementary school shall, in accordance with the requirements of the curriculum plan and syllabus through a variety of forms, assess the quality of teaching. The examination subjects at the end of the semester for language and mathematics, and other subjects through the usual examination to assess the results.

The examination for graduation from elementary school shall be set by the school (in rural areas, under the guidance of the county-level education administration department, the central elementary school of the township), and the subjects of the examination shall be language and mathematics.

Schools are required to establish scientific criteria for comprehensively assessing the quality of education in terms of morality, intelligence and physical fitness, and are not allowed to use examination results to rank classes and students, or as the sole criterion for measuring the quality of teaching and evaluating the teaching work of teachers.

Article 29 Primary schools shall emphasize physical education and aesthetic education.

Schools shall strictly implement the regulations promulgated by the state on school sports work, through physical education classes and other forms of physical activity to enhance students' physical fitness. Schools should ensure that students have one hour of physical activity every day.

Primary schools should have good music and art classes, and other subjects should also give play to the function of aesthetic education from the characteristics of their own subjects. Aesthetic education should be combined with the students' daily life, put forward dress, instrument, language, behavior and other aesthetic requirements, and cultivate healthy aesthetic interests.

Article 30 Elementary schools shall strengthen labor education for students, cultivate their love of labor, love of working people, the idea of cherishing the fruits of labor, and cultivate the ability to engage in self-service, domestic work, public welfare work and simple production work, and develop a habit of labor.

Article 31 Elementary schools shall strengthen the guidance of students' extracurricular and out-of-school activities, pay attention to the contact with students' families, children's palaces (homes, stations) and youth science and technology museums (stations) and other out-of-school activities, carry out useful activities, and arrange for a good after-school life of students.

Schools organizing students to participate in competitions and awards, to follow the relevant provisions of the education administration.

Chapter IV Personnel

Article 32 Elementary schools may have principals, vice-principals, directors, teachers and other personnel according to their establishment.

Article 33 The principal of an elementary school is the administrative head of the school. The principal shall have the qualifications prescribed by the state and shall be appointed or employed by the school setter or the setter's higher authority; the vice-principal and the director of teaching (general affairs) and other personnel shall be nominated by the principal and shall be appointed or employed in accordance with the relevant prescribed authority and procedures. The headmaster of a primary school set up by a non-government organization shall be reported to the competent educational administrative department for the record.

Principals shall strengthen the study of educational policies and regulations, educational theory, strengthen their own cultivation, improve the level of management, according to the law on the implementation of school management. His main duties are:

Article 34 The principal of an elementary school shall fully respect the democratic rights of the teaching staff and listen to their opinions and suggestions on the work of the school; when necessary, they may reflect them directly to the competent authorities, and no organization or individual may obstruct them.

Article 35 Primary school teachers shall have the qualifications prescribed by the state, enjoy and fulfill the rights and obligations prescribed by law, abide by the professional ethics, and complete the work of education and teaching.

Article 36 Elementary schools shall strengthen the management of the teaching force, in accordance with the relevant provisions of the state to implement the teacher qualifications, positions, appointment system, the establishment and improvement of business assessment files. To strengthen teachers' ideological and political education, professional ethics education, and establish the spirit of professionalism. Outstanding teachers who conscientiously fulfill their duties should be rewarded.

Article 37 of the elementary school shall attach importance to the continuing education of teachers, the development of teacher training program, and actively create conditions for teachers to further their education. Teachers should be based on the needs of the school work, in-service-based, self-study-based, the subject taught.

Article 38 The other personnel of elementary school shall have the appropriate political and business qualities, and their specific qualifications and duties by the educational administrative departments or schools in accordance with the relevant provisions of the State.

Chapter V Administrative Work

Article 39 Elementary schools can be set up according to the size of the teaching, general affairs and other work in charge of the organization or personnel, to assist the principal to do a good job (larger schools can also set up the grade level group), the specific duties of the school to develop.

Article 40 of the elementary school if the size of the larger, can be set up by the principal to convene, the heads of departments to participate in the School Affairs Committee, to study and decide on major school matters.

Article 41 Elementary schools shall establish a system of staff (representative) assemblies to strengthen democratic management and democratic supervision. The general assembly may be convened at regular intervals without a permanent body.

Article 42 The organization of the Chinese ****production Party in elementary school plays a political core role. The principal shall rely on the Party's school (local) grass-roots organizations and give full play to the role of trade unions, **** Youth League, Young Pioneers and other organizations in the work of the school.

Article 43 Elementary schools shall establish and improve systems for educational research, business records, financial management, safe work, study and meetings.

Schools shall establish staff rosters, student rosters and other statistical forms and tables, and regularly report them to the competent educational administrative department.

Article 44 Primary schools shall be subject to the inspection, supervision and guidance of the administrative department of education or the competent higher authority, and shall report truthfully on their work and reflect the situation.

At the end of the school year, the school shall report its work to the educational administrative department or the higher competent department, and major problems shall be reported at any time.

Chapter VI School Buildings, Equipment and Funding

Article 45 The conditions and funding of elementary schools shall be provided by the school organizers. Their standards shall be set by the people's governments at the provincial level.

Elementary schools shall have school buildings, grounds, facilities, teaching instruments and library materials that meet the prescribed standards.

Article 46 Primary schools shall manage the use of school buildings, grounds, etc., in compliance with the relevant regulations, and shall not change their use without the approval of the competent authorities.

The school buildings shall be repaired and maintained regularly, and the use of dangerous buildings shall be stopped immediately when they are found and reported to the higher authorities. For the encroachment of school buildings and Yangdi, the school can reflect to the higher authorities of the violator according to the law, up to the people's court to file a lawsuit.

Primary schools should make good plans for campus construction, purify, green and beautify the campus, improve campus culture and form a good environment for educating people.

Article 47 Elementary schools shall strengthen the management of teaching instruments, equipment, library materials, recreational and sports equipment and sanitary facilities, establish and improve the system, and improve the efficiency of use.

Article 48 Public elementary schools shall be exempt from tuition and may charge miscellaneous fees as appropriate. Elementary school fees are charged in strict accordance with the fees set by the people's governments at the provincial level and the standards and methods set by the people's governments at the county level and above.

Article 49 The elementary school can be held in accordance with the relevant provisions of the school-run industry, from the school's actual organization of teachers and students work and thrift. It is strictly prohibited to take the practice of apportioning money and goods to students instead of work and study.

Elementary schools may accept social donations in accordance with relevant state regulations.

Article 50 Primary schools shall scientifically manage and rationally use school funds to improve the efficiency of use. They shall establish a sound system for the management of funds, and their budgets and final accounts shall be submitted to the school council or the general assembly of teachers and staff for consideration, and shall be subject to the supervision of the higher-level financial and auditing departments.

Chapter VII Health Care and Safety

Article 51 Elementary schools shall conscientiously implement national regulations and policies on school health, and establish and improve the school health system. There should be a person in charge of this work (schools with conditions should have a school nurse's office), to establish student health card, according to the conditions of regular or irregular physical examination.

Article 52 of the elementary school environment, school buildings, facilities, books, equipment, etc. should be conducive to the physical and mental health of students, education, teaching arrangements in line with the physiological and psychological characteristics of students.

The environmental hygiene and teaching hygiene conditions in schools shall be continuously improved, health education shall be carried out, good hygiene habits shall be cultivated among students, and infectious diseases, common diseases and food poisoning shall be prevented.

Article 53 Elementary schools shall strengthen school safety, develop safety education according to local conditions, and train teachers and students to save themselves and protect themselves. Where the organization of students to participate in cultural and sports activities, social practice, excursions, labor, etc. should take proper precautions to ensure the safety of teachers and students.

Chapter VIII school family and society

Article 54 The elementary school shall work with the street, the villagers' committee and the nearby institutions, groups, troops, enterprises and institutions to establish community education organizations, mobilize all sectors of society to support the school work, optimize the environment. Elementary schools shall also give full play to their own strengths to serve the spiritual civilization of the community.

Article 55 Primary schools shall take the initiative to establish contact with students' families, and use parent schools and other forms of guidance to help students' parents create a favorable environment for family education.

Elementary schools may set up parent committees to enable them to understand the work of the school, to help the school to solve the difficulties encountered in running the school, and to focus on reflecting the opinions and suggestions of students' parents.

The parents' committee works under the guidance of the principal.

Chapter IX Others

Article 56 The rural township central elementary school shall, under the guidance of the county education department, play the role of a model school, a teaching and research center, and a base for further training, and lead to the overall improvement of the quality of education in local elementary school.

Article 57 Primary schools undertaking educational and pedagogical reforms may, after reporting to the relevant departments for approval, adjust some of the requirements in these regulations according to actual needs.

Chapter X Bylaws

Article 58 Elementary schools shall formulate their own bylaws in accordance with the provisions of the Education Law of the People's Republic of China and these Regulations, taking into account the actual situation of their schools.

Article 59 These regulations are mainly applicable to urban elementary school and elementary school above the level of complete elementary school in rural areas, while other types of elementary school and institutions implementing primary education and institutions may refer to them for implementation.

The educational administrative departments of provinces, autonomous regions and municipalities directly under the central government may formulate implementation measures in accordance with these Regulations.

Article 60 These Regulations shall come into force on the date of promulgation.
