Article 2 (Meaning of Related Terms)

The term "kitchen waste" as mentioned in these Measures refers to the kitchen waste and waste cooking oil generated in activities such as food processing, catering service and unit feeding outside the daily life of residents.

The kitchen waste mentioned in the preceding paragraph refers to food residues and food processing wastes; The waste edible oils and fats mentioned in the preceding paragraph refer to animal and vegetable oils and fats that can no longer be eaten and various oil-water mixtures. Article 3 (Scope of Application)

These Measures shall apply to the collection, transportation, disposal and related management activities of kitchen waste within the administrative area of this Municipality. Article 4 (Administrative Department)

Shanghai City Appearance and Environmental Sanitation Bureau (hereinafter referred to as Shanghai City Appearance and Environmental Sanitation Bureau) is responsible for the management of kitchen waste disposal in this city; The district/county city appearance and environmental sanitation management department (hereinafter referred to as the district/county city appearance and environmental sanitation department) is responsible for the daily management of kitchen waste disposal within its jurisdiction.

The relevant administrative departments of environmental protection, industry and commerce, public security, agriculture, economy, food hygiene, quality and technical supervision of this Municipality shall, according to their respective responsibilities, coordinate the implementation of these measures. Article 5 (Reduction and Recycling)

The city advocates reducing the amount of kitchen waste by listing clean vegetables and improving processing technology.

This Municipality encourages the resource utilization of kitchen waste. Article 6 (Subject of Obligation)

Food processing units, catering business units, canteens and other kitchen waste generating units (including individual industrial and commercial households, the same below) shall undertake the obligation of collection, transportation and disposal of kitchen waste. Article 7 (Generation of declarations)

The kitchen waste producing unit shall declare the type and quantity of the kitchen waste of the unit to the local district and county city appearance and environmental sanitation department every year. Article 8 (Collection Requirements)

The kitchen waste generating unit shall set up standard kitchen waste collection containers in accordance with the Provisions of Shanghai Municipality on the Establishment of Urban Environmental Sanitation Facilities; Where waste edible oils and fats are produced, anti-pollution facilities such as oil-water separators or grease traps shall be installed in accordance with the relevant provisions of environmental protection management.

The kitchen waste generating unit shall separate the kitchen waste from the non-kitchen waste; Kitchen waste and waste cooking oil in kitchen waste should be collected separately.

The kitchen waste generating unit shall keep the kitchen waste collection container intact and in normal use. Article 9 (Self-collection, Transportation and Disposal)

If the kitchen waste generating unit collects and transports the kitchen waste by itself, it shall meet the conditions stipulated by the Municipal Bureau of City Appearance and Environmental Sanitation, and file with the district and county city appearance and environmental sanitation departments before the first collection and transportation.

Where a kitchen waste producing unit uses microbial treatment equipment to dispose of kitchen waste by itself, the microbial treatment equipment shall go through relevant formalities with the Municipal Bureau of City Appearance and Environmental Sanitation or the district/county competent department of city appearance and environmental sanitation in accordance with the provisions of the Regulations of Shanghai Municipality on the Administration of City Appearance and Environmental Sanitation.

Except in the case of collecting, transporting and disposing on its own according to the provisions in the first and second paragraphs of this article, the kitchen waste shall be collected, transported and disposed by the collection, transportation and disposal units specified in Articles 10 and 13 of these Measures. Article 10 (Receiving and Transportation Units)

The domestic waste collection and transportation unit determined by the Municipal Bureau of City Appearance and Environmental Sanitation or the district/county city appearance and environmental sanitation department is the kitchen waste collection and transportation unit in the same area, and is responsible for the collection and transportation of kitchen waste in this area. Article 11 (Requirements for Collection and Transportation)

When a unit engaged in the collection and transportation of kitchen waste collects and transports kitchen waste, the type and quantity of kitchen waste collected and transported shall be confirmed by the kitchen waste generating unit.

When a unit engaged in the collection and transportation of kitchen waste sends the kitchen waste to the disposal unit, the disposal unit shall confirm the type and quantity of the kitchen waste delivered.

Food waste should be transported in a sealed manner, and no dripping or spilling is allowed during transportation.

Food waste transportation equipment and tools should be kept clean and intact. Article 12 (Receiving and Shipping Account)

Units engaged in the collection and transportation of kitchen waste shall establish a collection and transportation record account, and declare the source, type, quantity and disposal unit of kitchen waste collected and transported in the last quarter to the district/county city appearance and environmental sanitation department every quarter. Article 13 (Disposal Unit)

The kitchen waste disposal unit shall be determined by the competent department of city appearance and environmental sanitation at the county level through bidding; The disposal unit of waste edible oil is determined by the Municipal Bureau of City Appearance and Environmental Sanitation through bidding. The disposal unit of waste edible oil shall have the conditions for closed disposal in the whole process in the processing technology.

The city appearance and environmental sanitation bureau and the district/county appearance and environmental sanitation department shall announce to the public the names, disposal types, business premises and other matters of the kitchen waste disposal units and waste edible oil disposal units (hereinafter referred to as the kitchen waste disposal units) determined through bidding. Article 14 (Disposal Requirements)

Units engaged in the disposal of kitchen waste shall carry out harmless disposal in accordance with the standards for the disposal of urban domestic waste, and maintain the city appearance and environmental sanitation around the disposal site.

Units engaged in the disposal of kitchen waste shall, in accordance with the provisions of the state and this Municipality on environmental protection, take effective pollution prevention and control measures in the process of disposal; When using microbial agents to dispose of kitchen waste, we should use microbial agents that have obtained environmental safety permission and take corresponding safety control measures in accordance with the provisions of the Measures for the Administration of Environmental Safety in the Use of Microbial Agents in Shanghai.
