If construction waste is hazardous waste, it shall be disposed of in accordance with relevant laws and regulations. Article 3 The disposal of construction waste shall follow the principles of reduction, recycling and harmlessness, and whoever produces it shall be responsible. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the construction and comprehensive utilization of construction waste disposal sites into the national economic and social development plans, formulate plans for the prevention and control of environmental pollution caused by construction waste, organize the establishment of an information platform for the management and service of construction waste disposal, establish a joint meeting system, and coordinate the handling of major issues in the management of construction waste disposal. Fifth city management department is responsible for the supervision and management of the city's construction waste disposal; County (city, district) urban management department is responsible for the management of construction waste disposal in this area according to its responsibilities.
Housing and urban and rural construction, transportation, water conservancy, agriculture and rural areas are responsible for the supervision and management of construction waste disposal at the construction site according to their respective responsibilities.
The transportation department is responsible for investigating and dealing with traffic violations such as overloading of construction waste transport vehicles according to law.
The traffic administrative department of the public security organ shall be responsible for the traffic safety management of construction waste transport vehicles and their drivers, and investigate and deal with traffic violations such as speeding and overloading of construction waste transport vehicles according to law.
Development and reform, finance, natural resources planning, ecological environment, emergency management, administrative examination and approval services and other departments shall, in accordance with their respective responsibilities, do a good job in the management of construction waste disposal. Article 6 No unit or individual may dump, scatter or pile up construction waste without authorization, or mix hazardous waste, industrial waste, domestic waste and other toxic and harmful waste into construction waste, or set up abandoned sites for receiving construction waste without authorization. Seventh any unit or individual has the right to report the illegal disposal of construction waste. Chapter II Discharge, Transportation and Consumption Article 8 The project construction unit shall formulate a treatment plan for construction waste, take pollution prevention measures, and report it to the county (city, district) urban management department for the record.
The project construction unit shall promptly remove solid wastes such as construction waste generated in the process of project construction, and use or dispose of them in accordance with the provisions of the urban management department. Ninth construction waste transport units and construction units of construction waste disposal sites shall apply to the administrative examination and approval service department for construction waste disposal certificates according to law.
When a transport unit applies for the transportation of construction waste, it shall provide the following materials: an application form for the approval of construction waste disposal (transportation); Business license of enterprise legal person; Road transport business license, vehicle driving license.
When applying for operating a construction waste disposal site, the construction unit shall provide the following materials: "Application Form for Approval of Construction Waste Disposal (Disposal)"; Proof of site ownership and land use; General plan, orientation schematic diagram, approach road map, site layout, and acceptable types of construction waste identification map; Classified disposal scheme of construction waste and recycling scheme of waste concrete, metal and wood.
The administrative examination and approval service department shall make a decision on whether to approve or not within twenty days from the date of accepting the application. If approved, the applicant shall be issued with a construction waste disposal certificate; If it is not approved, it shall inform the applicant in writing and explain the reasons. Article 10 Construction units shall classify construction waste according to the following requirements: (1) Construction waste shall be disposed of in the disposal site; (2) The engineering mud is pretreated by mud pretreatment facilities and then enters the disposal site for disposal; (three) engineering waste, decoration waste and demolition waste, after classification, enter the disposal sites and resource utilization enterprises for disposal and utilization. Eleventh construction units should be equipped with construction waste management personnel at the construction site, and strengthen the management of the construction site in accordance with the following provisions: (1) set up a rigid enclosure that meets the standards; (two) according to the classification requirements of classified collection and stacking of construction waste; (three) timely backfill engineering muck, removal of construction waste, can not be timely backfill or removal, take cover, compaction, spraying, watering, temporary greening and other dust prevention measures; (four) the implementation of mud separation, standardized discharge of engineering mud, conditional drying treatment; (five) hardening the entrance and exit roads of the construction site, equipped with vehicle washing equipment to ensure that the transport vehicles are clean and tidy; (six) in accordance with the provisions of the installation of online video monitoring facilities; (seven) other requirements stipulated by laws, regulations and rules.
Before the completion of the construction project, the construction unit shall remove all the construction waste generated by the project. Twelfth demolition project construction units should be equipped with construction waste management personnel at the construction site, and strengthen the management of the construction site in accordance with the following provisions: (1) set up a standard hard enclosure; (two) according to the classification requirements of classified collection and stacking of construction waste; (three) the implementation of recycling measures for construction waste that can be recycled; (four) timely removal of construction waste, can not be removed in time, take cover, compaction, temporary greening and other dust prevention measures; (five) other requirements stipulated by laws, regulations and rules.
