Regulations on the Development of Tibetan Medicine in Gannan Tibetan Autonomous Prefecture of Gansu Province

Chapter I. General Provisions Article 1 These regulations are formulated in accordance with the Law of the People's Republic of China on Regional National Autonomy, the Law of the People's Republic of China on Drug Administration, the Law of the People's Republic of China on Practicing Physicians, and other relevant laws and regulations, and in the light of the actual situation of the prefecture, for the purpose of inheriting and carrying forward the science of Tibetan medicine and developing Tibetan medicine, as well as giving full play to the role of Tibetan medicine in the medical and preventive health care undertakings. Article 2 These Regulations shall apply to all those who are engaged in the activities of medical treatment, prevention, health care, education, scientific research, production, operation and management of Tibetan medicine within the administrative area of the Autonomous Prefecture. Article 3 The people's governments at all levels in the Autonomous Prefecture shall carry out the policy of giving equal importance to Tibetan (Chinese) and Western medicine, and shall implement the policy of protecting, supporting and developing Tibetan medicine. Article 4 In developing the cause of Tibetan medicine, it is necessary to inherit and carry forward the characteristics and advantages of Tibetan medicine, absorb and apply advanced science and technology and means, promote the development of the theory and practice of Tibetan medicine, and gradually realize the standardization, scientification and modernization of the work of Tibetan medicine. Article 5 The people's governments at all levels in the autonomous prefectures shall strengthen their leadership of the work of Tibetan medicine, incorporate the development of the cause of Tibetan medicine into national economic and social development plans and regional health plans, and organize their implementation. Article 6 The health administrative departments of the autonomous prefectures and counties (cities) shall be the supervisory and management departments of the work of Tibetan medicine in the administrative regions, and shall be equipped with full-time and part-time management personnel, and shall be responsible for the organization and implementation of these Regulations.

The departments of propaganda, planning, finance, personnel, labor security, education, science and technology, industry and commerce, price, and public security of the autonomous prefectures and counties (cities) shall, in accordance with their respective duties, *** with the work of developing Tibetan medicine. Chapter II Development and Guarantee Article 7 The people's governments at all levels in the Autonomous Prefecture shall, year by year, increase their investment in the cause of Tibetan medicine, improve the working conditions of Tibetan medicine institutions, and guarantee the carrying out of normal work, the rate of which shall not be less than the rate of increase of normal financial expenditures.

The people's governments at all levels in the autonomous prefectures shall set up special funds for the development of Tibetan medicine and incorporate them into their budgets, focusing on key projects such as medical treatment, teaching, scientific research and the production of Tibetan medicines in Tibetan medicine, and gradually increasing them with the development of the economy.

The working capital of township health centers with Tibetan medicine practice should reach 15-30% for Tibetan medicine.

Social groups, organizations and individuals are encouraged to finance the development of Tibetan medicine, to establish a fund for the development of Tibetan medicine, and to actively utilize foreign capital and donations for the development of Tibetan medicine.

The funds for the cause of Tibetan medicine, infrastructure fees and special funds for Tibetan medicine shall be earmarked for specific purposes, and no unit or individual shall misappropriate or retain them. Article 8 The financial departments of the autonomous prefectures and counties (cities) shall actively encourage and support the development and utilization of Tibetan medicine, and the return portion of the value-added tax, income tax and other taxes on Tibetan medicinal products levied by the tax authorities shall be fully utilized on the development and utilization of Tibetan medicine. Article 9 The people's governments of the autonomous prefectures and counties (cities) and the departments concerned shall list Tibetan medical institutions and pharmacies as designated medical institutions and designated pharmacies for the provision of social medical insurance services. Article 10 The people's governments at all levels in the autonomous prefectures and the relevant departments shall attach importance to the protection and rational development and utilization of the resources of wild Tibetan medicinal herbs, and shall strictly prohibit indiscriminate mining, abusive fishing and digging.

Attaching importance to the processing of Tibetan medicines, improving the quality of Tibetan medicines, encouraging the research and creation of Tibetan medicinal products, developing the Tibetan medicinal industry, and turning resource advantages into economic advantages. Article 11 The people's governments at or above the county level set up Tibetan medical institutions in accordance with regional health planning. Encouragement is given to the construction of medical institutions specializing in Tibetan medicine with distinctive features.

The counties which have not set up Tibetan medicine institutions must set up Tibetan medicine departments and Tibetan pharmacies in their county-level general hospitals.

Central health centers must set up Tibetan medicine departments (rooms) and Tibetan pharmacies.

Township health centers shall be equipped with a certain number of Tibetan medicine personnel and necessary medical devices and equipment to provide Tibetan medicine medical services.

Rural doctors in village health centers (rooms) shall master the basic knowledge of Tibetan medicine and the Tibetan medical diagnosis and treatment techniques for common and frequent diseases. Article 12 The people's governments at all levels in the autonomous prefectures shall support the cause of Tibetan medicine in farming (herding) villages, incorporate the cause of Tibetan medicine in farming (herding) villages into the planning of the development of medical and health care in farming (herding) villages, and gradually improve the network of Tibetan medicine medical services in farming (herding) villages.

The establishment of a system of counterpart support for agricultural (pastoral) village Tibetan medicine medical work by Tibetan medicine organizations at or above the county level. Encouraging Tibetan medicine personnel to work in farming (pastoral) villages and at the grassroots level. New technologies and treatments are actively promoted. Article 13 The people's governments at all levels in the autonomous prefectures and the departments concerned shall strengthen the protection, organization, development and utilization of Tibetan medical literature. They shall set up academic organizations of Tibetan medicine, carry out international and inter-regional exchanges and cooperation in Tibetan medicine, and promote academic, talent and technical exchanges. Article 14 encourages the support of qualified Tibetan medicine institutions to open and carry out Tibetan medicine window clinics and other Tibetan medicine technical cooperation programs inside and outside the province in accordance with the relevant provisions. Article 15 encourages support for vertical and horizontal unification between Tibetan medical institutions, taking the road of grouping and scaling up. Article 16 The people's governments of the autonomous prefectures and counties (cities) shall, with regard to the promotion of Tibetan medical personnel in professional and technical positions, appropriately increase the number of professional and technical positions in health institutions. The promotion assessment focuses on the work ability and performance of medical personnel, the requirements of the title foreign language and title computer application examination results shall be appropriately relaxed.

Article 17 The health administrative departments of autonomous prefectures and counties, in conjunction with the relevant departments, shall organize Tibetan medicine experts and related personnel to participate in the evaluation or appraisal of the following projects:

(1) the establishment, appraisal and achievement evaluation of scientific research projects in Tibetan medicine;

(2) the evaluation of professional and technical positions and qualifications in Tibetan medicine;

(3) the evaluation of Tibetan medicine medical care, education, scientific research and the production institutions of Tibetan medicine;

(4) the evaluation of the qualification of Tibetan medicine personnel; and assessment;

(d) technical appraisal of medical accidents in Tibetan medicine.
