Heilongjiang Province Construction Project Quality Supervision and Management Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the quality supervision and management of construction projects, ensure the quality of construction projects, protect the safety of people's lives and property, and safeguard the legitimate rights and interests of citizens, legal persons and other organizations, according to the "People's **The Construction Law of the People's Republic of China" and the "Construction Project Quality Management Regulations" of the State Council and other relevant laws and regulations are formulated in conjunction with the actual conditions of this province. Article 2 Anyone who engages in new construction, expansion, reconstruction of construction projects as well as construction project quality supervision and management activities within the administrative region of this province must abide by these regulations. Article 3 The term “construction projects” as mentioned in these regulations refers to civil engineering, construction projects, line, pipeline and equipment installation projects and building decoration projects. The term "responsible entity for construction project quality" as mentioned in these Regulations refers to the construction, survey, design, construction, project supervision, project inspection, construction drawing review and other units that have legal responsibility for the quality of construction projects. The term "quality behavior" as mentioned in these Regulations refers to the behavior of each responsible entity in fulfilling statutory quality responsibilities and obligations during the construction process of construction projects. Article 4 The construction administrative departments at or above the county level implement unified supervision and management of the quality of construction projects within their respective administrative regions, and their affiliated construction project quality supervision and management agencies (hereinafter referred to as the project quality supervision agencies) are specifically responsible for the supervision and management of construction project quality. The Provincial General Administration of Agricultural Reclamation, its branches, the Provincial General Administration of Forestry Industry, and the Forestry Administration are responsible for the quality supervision and management of construction projects in reclamation areas and state-owned forest areas. Their affiliated project quality supervision agencies are specifically responsible for the quality supervision and management of construction projects. In terms of business, we accept the guidance and supervision of the provincial construction administrative department. Administrative departments such as transportation and water conservancy shall be responsible for the supervision and management of the quality of construction projects in their respective administrative regions according to the division of responsibilities. The establishment of a professional engineering quality supervision agency shall conduct assessments in accordance with relevant national regulations and file with the provincial construction administrative department. Article 5 The project quality supervision agency shall perform the following responsibilities: (1) Implement laws and regulations related to construction project quality; (2) Implement national and provincial norms and standards related to construction project quality; (3) Responsible for the quality of construction projects Supervise the quality behavior of the subject; (4) Implement hierarchical supervision and business guidance for lower-level project quality supervision agencies; (5) Organize construction project quality law enforcement inspections; (6) Inspect and spot-check the physical quality of construction projects; (7) Participate in construction projects Handle quality accidents; (8) Mediate quality disputes between construction projects under construction and during the warranty period, and accept complaints about the quality of construction projects; (9) Supervise completion acceptance activities of construction projects, and handle completion acceptance filing procedures for construction projects. Article 6 The provincial construction administrative department is responsible for the qualification management and personnel qualification assessment of construction project quality inspection units in the province, and the provincial project quality supervision agency is responsible for the specific organization and implementation of the work. Article 7 When performing supervision and management duties, the project quality supervision agency has the right to take the following measures: (1) require the inspected unit to provide documents and information related to the quality of the construction project; (2) enter the construction site of the inspected unit for inspection; ( 3) When problems affecting the quality of construction projects are discovered, order corrections; (4) Investigate and punish violations of laws, regulations and rules related to the quality of construction projects in accordance with the law. Article 8 People's governments at all levels shall encourage and guide the adoption of advanced technologies in construction projects and promote the use of energy-saving and environmentally friendly materials. Chapter 2 Construction Project Quality Supervision Registration Article 9 Before obtaining a construction project construction license or start-up report, the construction unit shall go through the construction project quality supervision registration procedures with the project quality supervision agency where the construction project is located, and submit the following documents: (1) ) Construction project construction contract; (2) Construction unit, the person in charge of the construction unit and the composition of the project organization; (3) Qualification certificates of project leaders and technical personnel at the construction site and job certificates of quality inspection personnel; (4) Construction organization design ; (5) Construction drawing design document review report and approval letter; (6) Written certification documents for passing the fire protection design review of construction projects; (7) Other documents stipulated by relevant laws and regulations. If construction project supervision is implemented, the following documents must also be submitted at the same time: (1) Construction project supervision contract; (2) Registration practice certificate of on-site construction project supervision personnel; (3) Person in charge and organizational composition of the construction project project of the supervision unit; ( 4) Construction project supervision planning. Article 10 The project quality supervision agency shall complete the construction project quality supervision registration procedures within one working day from the date of receipt of the construction project quality supervision registration qualification documents submitted by the construction unit.

If the construction project quality supervision and registration procedures are not fulfilled, the construction administrative department shall not issue a construction license, and the relevant departments shall not issue a start-up report. Article 11: After completing the construction project quality supervision registration procedures, the project quality supervision agency shall promptly formulate a "Construction Project Quality Supervision Work Plan" and determine the personnel responsible for supervision. Before implementing quality supervision on a construction project, the project quality supervision agency shall deliver the "Construction Project Quality Supervision Work Plan" to the construction unit, construction unit and supervision unit, and make technical disclosures to relevant units. Chapter 3 Supervision of Construction Project Quality Behavior Article 12 During the construction process of construction projects, special supporting construction projects such as public security fire protection, civil air defense, environmental protection, gas, heating, water supply and drainage, electrical, information, intelligence, elevators, etc. It should be designed, constructed and accepted simultaneously with the main construction project of the construction project.
