Regulations on the Development of Chinese, Tibetan and Mongolian Medicine in Qinghai Province (2020 Amendment)

Chapter I General Provisions Article 1 In order to inherit and carry forward the traditional medicine of the motherland, promote the development of traditional Chinese medicine, Tibetan medicine and Mongolian medicine (hereinafter referred to as Chinese, Tibetan and Mongolian medicine), and to protect the health of the people, the Regulations are formulated in accordance with the relevant laws and regulations, and in the light of the actual situation of this province. Article 2 These Regulations shall apply to the medical treatment, prevention, rehabilitation, health care, education and scientific research activities of Chinese, Tibetan and Mongolian medicine and other traditional medicine within the administrative area of this province. Article 3 The development of traditional Chinese, Tibetan and Mongolian medicine shall adhere to the principles of protection, support and innovation, inherit and develop the characteristics and advantages of traditional Chinese, Tibetan and Mongolian medicine, and modernize traditional Chinese, Tibetan and Mongolian medicine by applying modern science and technology. Article 4 The administrative department of health of the provincial people's government shall be in charge of the development of Chinese, Tibetan and Mongolian medicine throughout the province.

The health administrative departments of the people's governments at or above the county level are responsible for the development of Sino-Tibetan-Mongolian medicine in their respective administrative areas. Other relevant departments shall, in accordance with their respective responsibilities, do a good job in the development of Chinese, Tibetan and Mongolian medicine. Article 5 The people's governments at or above the county level, the relevant departments and organizations may, in accordance with the relevant provisions of the state and the province, carry out foreign exchanges and cooperation in Chinese, Tibetan and Mongolian medicine. Article 6 The people's governments at or above the county level and the administrative departments of health and wellness shall commend or reward units and individuals who have made outstanding contributions to the development of Chinese, Tibetan and Mongolian medicine. Chapter II Guarantee Measures Article 7 The people's governments at or above the county level shall incorporate the development of Chinese, Tibetan and Mongolian medicine into the national economic and social development plan, reasonably allocate resources for Chinese, Tibetan and Mongolian medicine in accordance with the needs of economic and social development and regional health planning, and gradually improve the management and service system of Chinese, Tibetan and Mongolian medicine in terms of medical treatment, education and scientific research. Article 8 The people's governments at or above the county level shall, with the development of the national economy, gradually increase their investment in the cause of Chinese, Tibetan and Mongolian medicine.

Chinese, Tibetan and Mongolian medicine fees and special funds shall be earmarked for specific purposes, and no unit or individual shall retain or misappropriate them. Article 9 The people's governments at or above the county level and the relevant departments shall incorporate the capital construction of Chinese, Tibetan and Mongolian medical institutions into urban and rural construction planning. Article 10 The people's governments at or above the county level shall strengthen Chinese, Tibetan and Mongolian medicine in rural and pastoral areas, give full play to the driving and guiding role of county Chinese, Tibetan and Mongolian medicine hospitals, and encourage township health centers and rural doctors to use Chinese, Tibetan and Mongolian medicine to prevent and treat illnesses. Article 11 encourages social forces within and outside the province to donate and invest in the development of Chinese, Tibetan and Mongolian medicine. Foreign organizations and individuals are encouraged to develop the cause of Chinese, Tibetan and Mongolian medicine through donations, cooperation and joint ventures. Article 12 When the relevant departments of the people's governments at or above the county level carry out the following activities, a certain proportion of experts in Chinese, Tibetan and Mongolian medicine shall take part in them:

(1) the establishment of projects for scientific research in Chinese, Tibetan and Mongolian medicine, appraisal of the results of such research and the evaluation of prizes;

(2) the appraisal of the professional and technical positions of Chinese, Tibetan and Mongolian medicine;

(3) the comprehensive evaluation of the Chinese, Tibetan and Mongolian medical, educational and scientific research organizations;

(4) the evaluation of medical incidents in Chinese, Tibetan and Mongolian medicine; (5) the development of the Chinese, Tibetan and Mongolian medicine industry. (D) Chinese, Tibetan and Mongolian medicine medical malpractice appraisal. Chapter III Medical Institutions and Personnel Article 13 The health administrative departments of the people's governments at or above the county level shall take measures to gradually bring the floor space, business premises, personnel structure, medical equipment, management level, and technical quality of Chinese, Tibetan, and Mongolian medical institutions up to the standards prescribed by the state or the province. Article 14 Chinese, Tibetan and Mongolian medical institutions shall insist on focusing on Chinese, Tibetan and Mongolian medicine, strengthening the construction of specialties, and improving the level of medical technology and the quality of comprehensive services. Article 15 The opening of Chinese, Tibetan and Mongolian medical institutions shall, in accordance with the provisions of the State Council's "Regulations on the Administration of Medical Institutions", be examined and approved by the health administration department of the people's government at or above the county level and registered to practice before they can practice.

Practitioners of Chinese, Tibetan and Mongolian medicine must obtain practicing certificates and register with the administrative department of health before engaging in medical, preventive and health care activities. Article 16 Chinese, Tibetan and Mongolian medical institutions shall enjoy social health resources on an equal footing with Western medical institutions.

The medical insurance administration department shall include non-profit Chinese, Tibetan and Mongolian medical institutions in the designated units for medical insurance services.

Chinese, Tibetan and Mongolian medical preparations approved for development in accordance with national standards may be included in the drug catalog of basic medical insurance for urban workers and used clinically in their own units. Article 17 In assessing the professional and technical positions of famous and old Chinese, Tibetan and Mongolian physicians, the title assessment organizations shall pay attention to the assessment of the basic theories and clinical level of Chinese, Tibetan and Mongolian medicine. Chapter IV Education and Scientific Research Article 18 The health administrative departments of the people's governments at or above the county level shall work together with the administrative departments of education, science and technology to strengthen the education and scientific research of Chinese, Tibetan and Mongolian medicine. Article 19 Chinese, Tibetan and Mongolian medical education institutions shall strengthen the teaching of basic theories of Chinese, Tibetan and Mongolian medicine, emphasize the summarization of the practical experience of Chinese, Tibetan and Mongolian medicine, and train Chinese, Tibetan and Mongolian medical professionals and technicians with professional theories and practical experience in Chinese, Tibetan and Mongolian medicine. Article 20 The health administrative departments of the people's governments at or above the county level shall establish a system of continuing education for Chinese, Tibetan and Mongolian medicine professionals, and train leaders and young and middle-aged technical backbones in Chinese, Tibetan and Mongolian medicine. Chinese, Tibetan and Mongolian medicine personnel with a low cultural level shall improve their cultural knowledge and professional theory through continuing education. Article 21 encourages Chinese, Tibetan and Mongolian medicine specialists with high academic level or rich practical experience to carry out teacher training in accordance with the relevant provisions of the state and the province, and to take disciples to teach them. Article 22 encourages social forces to open schools of Chinese, Tibetan and Mongolian medicine.

Social forces to open schools of Chinese, Tibetan and Mongolian medicine must have the national or provincial provisions of the school conditions, the provincial health administrative department review and approval, reported to the provincial education administrative department for approval.
