Legal basis: Measures for the Supervision and Administration of Drug Circulation
Article 19 For drugs that require low-temperature refrigeration in the drug instructions, pharmaceutical production and marketing enterprises shall use low-temperature refrigeration facilities and equipment for transportation and storage in accordance with relevant regulations.
If the pharmaceutical supervisory and administrative department finds that a pharmaceutical production or trading enterprise violates the provisions of the preceding paragraph of this article, it shall immediately seal up and detain the drugs involved and deal with them according to law.
Article 26 When storing drugs, medical institutions shall formulate and implement the system of drug storage and custody, and take necessary measures such as cold storage, anti-freezing, moisture-proof, light-proof, ventilation, fire prevention, insect prevention and rat prevention to ensure the quality of drugs.
Medical institutions should store drugs and non-drugs separately; Chinese herbal medicines, Chinese herbal pieces, chemicals and Chinese patent medicines should be stored separately and classified.
Thirty-ninth pharmaceutical production and wholesale enterprises, in violation of the provisions of Article 19 of these measures, fail to transport drugs in accordance with the low temperature and cold storage conditions stipulated in the drug instructions, give a warning and order them to make corrections within a time limit; If no correction is made within the time limit, a fine of 5000 yuan or more and 20 thousand yuan or less shall be imposed; If the relevant drugs are confirmed as counterfeit and inferior drugs according to law, they shall be punished in accordance with the relevant provisions of the Drug Administration Law.
Pharmaceutical production and wholesale enterprises, in violation of the provisions of Article 19 of these measures, fail to store drugs in accordance with the low temperature and cold storage conditions stipulated in the drug instructions, and shall be punished in accordance with the provisions of Article 79 of the Drug Administration Law; If the relevant drugs are confirmed as counterfeit and inferior drugs according to law, they shall be punished in accordance with the relevant provisions of the Drug Administration Law.
