(1) theaters and dance halls, karaoke halls (rooms), music cafes (rooms), video screening halls (rooms), and amusement halls;
(2) stadiums (venues) of sports competitions;
(3) reading rooms in libraries, and display halls in museums, art galleries, and exhibition halls;
(4) the public ****places where smoking is prohibited shall be supervised and managed by the units where they are located. p>
(d) more than 200 square meters of stores (field) and shopping places;
(e) public **** transportation and its waiting room;
(f) medical institutions, waiting rooms, treatment rooms, wards;
(g) institutions, organizations, troops, schools, enterprises and institutions of the classroom, auditorium, conference halls (rooms) and air-conditioning equipment with the office
(viii) childcare institutions for young children, indoor children's activities;
(ix) air-conditioned food and beverage halls (rooms), business premises;
(x) according to the actual needs of the Municipal People's Government to determine other no-smoking places.
Prohibition of smoking in public **** places, conditions may be set up smoking areas. Article IV in the non-smoking public **** place as well as urban roads, squares and all other public **** places and buildings, are prohibited to set up tobacco advertising. Article 5 The press, radio, television, education, culture, health, environmental protection and sanitation and other departments and organizations such as workers, youth, women and other organizations shall actively carry out smoking is hazardous to health and discourage smoking social propaganda. It is prohibited to use radio, movies, television, newspapers and periodicals to publish tobacco advertisements. Article 6 The unit where smoking is prohibited shall fulfill the following duties:
(1) formulate and implement the unit's management system and penalties for smoking, and impose a fine of 20 yuan on smokers who fail to listen to the warnings given to them within the scope of the prohibition of smoking;
(2) do a good job of publicizing and educating the prohibition of smoking;
(3) set up conspicuous no-smoking signs within the premises where smoking is prohibited; and (c) Setting up conspicuous no-smoking signs;
(d) not to set up smoking utensils in no-smoking places, and not to set up signs and articles with tobacco advertising. Article 7 In a no-smoking place, passive smokers have the right to demand that smokers in the place stop smoking. Citizens have the right to demand that the unit in which a no-smoking place is located fulfill the duties in items 3 and 4 of Article 6 of these Interim Provisions. Citizens have the right to report violations of this Interim Provision to the City or District Health Bureau. Article 8 On the World No Tobacco Day on May 31 every year, enterprises selling cigarettes (including individual stalls) stop selling cigarettes for one day. Article 9 The health administrative department shall impose penalties on the units that are located in places where smoking is prohibited in violation of these provisional regulations in accordance with the following provisions:
(1) Anyone who violates the first and second subparagraphs of Article 6 of these provisional regulations shall be warned and given a deadline to make corrections; and anyone who does not stop smoking within the scope of the prohibition of smoking shall be punished with a fine of 500 yuan.
(2) Anyone who violates the third and fourth subparagraphs of Article 6 of the Provisional Regulations shall be sentenced to a fine of not less than 500 yuan and not more than 1,000 yuan.
(3) For violation of the provisions of Article 8 of these provisional provisions, a fine of 500 yuan or more than 1,000 yuan or less shall be imposed. Article 10 For violation of this Interim Provision, the use of radio, film, television, newspapers and periodicals to publish tobacco advertisements, or the setting up of tobacco advertisements on public *** places and buildings, the advertising supervision and management authorities shall order the advertisers, advertisers and advertisers who bear the responsibility to stop publishing them, confiscate the costs of the advertisements, and impose fines not less than one and not more than five times of the costs of the advertisements, as well as order the setters to dismantle the advertisements or forcibly dismantle it. Article 11 When administrative penalties are imposed, a decision on administrative penalties shall be issued. Fines shall be issued with receipts for fines uniformly printed by the Hangzhou Finance Bureau. All fines shall be paid to the Treasury. Article XII of the refusal and obstruction of health management personnel to carry out their duties in accordance with the law, without the use of violence, threatening methods, by the public security department in accordance with the "People's Republic of China * * * and the State Public Security Administration Punishment Ordinance"; constitutes a crime, shall be investigated for criminal responsibility. Article 13 If the parties concerned are not satisfied with the administrative penalty decision, they may, in accordance with the law, apply to the people's government at their own level for reconsideration, or bring a lawsuit directly to the people's court. Failure to apply for reconsideration, or to bring a lawsuit to the people's court, and does not fulfill the penalty decision, the authority that made the penalty decision to apply for compulsory execution by the people's court. Article 14 Health administrators shall strictly abide by the law and discipline, and enforce the law impartially. For favoritism, solicitation and acceptance of bribes, perverted enforcement of the law, shall be given administrative sanctions; constitutes a crime, shall be investigated for criminal responsibility. Article 15 The provisional provisions of the Legal Affairs Bureau of the Hangzhou Municipal People's Government shall be responsible for interpretation. Article XVI of the provisional provisions of September 20, 1995 shall come into force.
