Measures for the Administration of Temporary Inbound and Outbound Goods by the Customs of the People's Republic of China*** and the State of China (2017)

Chapter I General Provisions Article 1 In order to standardize the supervision of Customs on temporary inbound and outbound goods, these Measures are formulated in accordance with the provisions of the Customs Law of the People's Republic of China*** and the State of China (hereinafter referred to as the Customs Law), the Regulations on Import and Export Tariffs of the People's Republic of China*** and the State of China (hereinafter referred to as the Customs Tariff Regulations) as well as relevant laws and administrative regulations. Article 2 The Customs on the temporary entry, temporary exit and within the prescribed period of re-export, re-export of goods in the management of the application of these Measures. Article 3 The temporary entry and exit of goods referred to in these Measures include:

(1) in exhibitions, fairs, conferences and similar activities in the exhibition or use of goods;

(2) cultural and sports exchanges used in performances, competitions, supplies;

(3) news reporting or filming of movies, television programs using instruments, equipment and supplies;

(4) instruments, equipment and supplies used in scientific research, teaching and medical activities;

(5) means of transportation and special vehicles used in the activities listed in subparagraphs (1) to (4) of this paragraph;

(6) samples of goods;

(7) instruments, equipment and supplies used in charitable activities;

(8) instruments, equipment and supplies used in the installation, commissioning, testing and repair of equipment;

(9) instruments, equipment and supplies used in the production of sports and sports exchange activities;

(10) instruments, equipment and supplies used in the production of movies and television programs;

(ix) Packaging materials for goods;

(x) Self-driving vehicles and their supplies for tourism;

(xi) Equipment, instruments and supplies for engineering construction;

(xii) Products, equipment and vehicles for testing;

(xiii) Other temporary inward and outward cargoes as specified by the General Administration of Customs. Other temporary inbound and outbound goods as stipulated by the General Administration of Customs.

The use of goods temporarily imported documents (hereinafter referred to as "ATA documents") is limited to the temporary entry of goods China's accession to the international conventions on the temporary import of goods specified in the goods. Article 4 The tax collection and management of goods temporarily imported or exported shall be carried out in accordance with the relevant provisions of the Customs Tariff Regulations. Article 5 Except for the international treaties and agreements concluded or participated by China, as well as national laws, administrative regulations and regulations of the General Administration of Customs, temporarily imported or exported goods shall be exempted from the inspection of license documents. Article VI temporary entry and exit of goods in addition to depreciation or loss arising from normal use, shall be reshipped in accordance with the original condition of reshipping out of the country, reshipping into the country. Chapter II Supervision of Temporary Inbound and Outbound Goods Article 7 The holder of ATA Document Register and the consignee or consignor of temporary inbound and outbound goods under non-ATA Document Register (hereinafter referred to as the "holder, consignee or consignor") may submit the "Application for Confirmation of Temporary Inbound and Outbound Goods" to the competent Customs authority prior to declaration to apply for examination and confirmation of whether the goods in question belong to temporary inbound and outbound goods, and to confirm whether the goods in question belong to temporary inbound and outbound goods. The licensee, consignee or consignor can submit the "Application for Confirmation of Temporary Import and Export of Goods" to the competent Customs office before declaration, and apply for the examination and confirmation of whether the goods concerned are temporary import and export goods and go through the relevant formalities. Article 8 The holder of ATA Documentary Book shall submit to the Customs the valid ATA Documentary Book as well as relevant commercial documents or supporting materials. Article IX ATA Documentary Book under the temporary exit of goods, by the China Council for the Promotion of International Trade (China Chamber of International Commerce) to the General Administration of Customs to provide a general guarantee.

Except as otherwise provided, the consignee or consignor of goods temporarily entering or leaving the country under the ATA Document Book should be in accordance with the relevant provisions of the competent Customs to provide security. Article X temporary entry and exit of goods shall be re-exported within six months from the date of entry and exit or re-exported into the country.

Due to special circumstances require an extension of the period, the licensee, the consignee or consignor shall apply for an extension of the competent Customs formalities, the extension of up to three times, each time the extension of the period of no more than six months. Expiration of the extension period should be reshipped out of the country, reshipped into the country or for import and export procedures.

Temporary inbound and outbound goods used in national key projects, national scientific research projects, as well as to participate in the exhibition period of 24 months or more exhibits, in the preceding paragraph of the extension of the expiration of the extension period is still required to be extended, by the competent Customs under the approval of the Customs. Article 11 If the temporary inward and outward goods need to extend the period of reshipment into or out of the country, the licensee, consignee or consignor shall apply for the extension formalities to the competent Customs before the expiration of the specified period and submit the "Application Form for Extension of Temporary Inward and Outward Shipments of Goods" as well as the relevant materials. Article XII of temporary entry and exit of goods can be reshipped out of the country, reshipped into the country, reshipped out of the country, reshipped into the Customs to retrieve the original temporary entry and exit of goods declaration of electronic data for the relevant procedures.

The holder of the ATA document book shall hold the ATA document book to the re-export, re-export into the Customs for the relevant procedures. Article XV of the Customs through risk management, credit management and other means of temporary entry and exit of business supervision and management. Article XVI of temporary entry and exit of goods due to force majeure causes damage, can not be reshipped out of the original state, reshipped into the country, the licensee, the consignee or consignor shall promptly report to the competent Customs, can be issued by the relevant departments for reshipped out of the country, reshipped into the country for the formalities; due to force majeure reasons for the loss of the Customs by the competent Customs verification can be considered as the goods have been reshipped out of the country, reshipped into the country.

Temporary entry and exit of goods due to force majeure other reasons for damage or loss, the licensee, consignee or consignor shall be in accordance with the relevant provisions of the import and export of goods for customs formalities.
