Project Management Measures of Interim Measures for the Completion and Acceptance of State-Invested Land Development and Consolidation Projects

Chapter I General Principles

Article 1 In order to strengthen the management of land development and consolidation projects in our province using provincial and national financial special funds, and to ensure the dynamic balance of the province's total arable land, these measures are formulated in accordance with the "Measures for the Implementation of the Shanxi Provincial <Chinese People's **** and Territorial Land Management> and the Interim Measures on Management of the National Investment Land Development and Consolidation Projects" and other relevant laws, regulations and policies, taking into account the actual situation of the province. Interim Measures" and other relevant laws and regulations and policies, combined with the actual situation in this province, the formulation of this approach.

Article 2 These measures apply to the use of provincial and national financial special funds for land development and consolidation projects (hereinafter referred to as "projects"), including key projects, demonstration projects and subsidized projects.

Article 3 Land development and consolidation should follow the following principles:

(1) in line with the overall land use planning, land remediation planning and local agricultural development and rural construction planning;

(2) in line with the requirements of ecological environmental protection, and to promote the sustainable use of land resources;

(3) in order to promote the modernization of agriculture and the urban and rural integrated development as the guide. Adhering to the strict arable land protection and saving and intensive land use system, vigorously promoting the construction of high-yield and stable-yield basic farmland as the focus of farmland improvement, further improving rural production and living conditions, and promoting farmers' income, agricultural efficiency and rural development;

(d) adapting to local conditions and resolving problems before difficulties;

(e) technically feasible and economically reasonable;

(f) focusing on land preparation and land reclamation, and moderate development of unutilized land;

(vii) focusing on key projects, supplemented by demonstration projects and subsidy projects. The projects shall be tilted to the main grain-producing areas in the province, to the basic farmland protection zones, and to the planning areas of major projects;

(viii) after the implementation of the project, the arable land in the project area shall be prioritized to the basic farmland protection zones, and shall not be changed to another use in principle, except for the needs of the major construction projects approved by the state and the province;

(ix) the project management shall implement the unification of the rights, obligations and liabilities.

Article 4 of the provincial land and resources department is the province's land development and consolidation industry authorities, is responsible for research and development of project policies and regulations, technical standards, industry norms and supplemental arable land annual plan, the implementation of the project verification and filing of the database; responsible for land development and consolidation project validation, inspection, acceptance and other management. The technical and transactional work in the implementation of project management is entrusted to the specialized provincial land consolidation agencies.

The municipal land and resources bureaus are responsible for the organization and declaration of land development and consolidation projects within their jurisdictions, supervision and management, and approval of project implementation plans; they are responsible for the review of projects with an investment amount of less than 15 million yuan, the research and demonstration of the completion and acceptance of the projects, and the results will be reported to the provincial department for approval and filing.

The county-level Land and Resources Bureau is responsible for the project declaration and the organization, implementation and management of land development and finishing projects under its jurisdiction; it is responsible for submitting the project feasibility study, project preliminary design and budget report, and self-checking and handing over of the project after completion.

Article V Project funding and use of management should be consistent with the Ministry of Land and Resources, "Interim Measures for Funding Management of Land Development and Consolidation Projects", "Interim Measures for Financial Management of Reimbursable Use Fees for New Construction Land in Shanxi Province" and other relevant regulations. Project funds shall be earmarked and accounted for exclusively. Land and resources departments at all levels and land development and consolidation agencies should establish a sound fund management system.

Chapter II Project Declaration and Establishment

Article 6 The project shall be jointly declared by the land and resources departments at county level and the finance departments at the same level, and shall be declared to the provincial land and resources department and the finance department according to the requirements of the Measures at each level.

Article 7 The Provincial Department of Land and Resources shall formulate and issue annual plans for project declaration according to the land remediation planning, annual land use plan and revenue budget of special funds for land development and consolidation.

The land resource management departments at all levels shall organize the declaration of projects according to the status of land reserve resources and land remediation planning and annual land use plan of the region.

Article 8 Conditions for declaration of provincial key projects.

(a) basic conditions: the project location should have the necessary supporting infrastructure for the implementation of land development and finishing projects, such as roads, water, electricity.

(2) construction scale : land consolidation: hilly mountainous areas of 50-500 hectares, relatively centralized and contiguous, a single area of not less than 10 hectares, no more than 5 pieces; plains 100-1000 hectares, relatively centralized and contiguous, a single area of not less than 20 hectares, no more than 5 pieces. Land development and reclamation: 25-300 hectares in hilly and mountainous areas, relatively concentrated and contiguous, with a single area of not less than 5 hectares and no more than 5 pieces; 50-600 hectares in plain areas, relatively concentrated and contiguous, with a single area of not less than 10 hectares and no more than 5 pieces.

The area of basic farmland finishing in the basic farmland protection zone should not be less than 100 hectares.

(C) the proportion of net increase in arable land area of the project: land consolidation project net increase in arable land area in principle not less than 3% of the area of the project design scale, land reclamation of not less than 20%, land development of not less than 40% of the basic farmland consolidation project of the new arable land area of not less than 1% of the area of the project design scale.

Article IX Provincial Demonstration Project Declaration Conditions.

(a) basic conditions: the project is located in the area of land development and reclamation and finishing necessary roads, water, electricity and other supporting infrastructure. The project is representative of the type, topographic and geomorphological conditions, construction techniques or organization and implementation, management mode. Basic farmland protection zones should be prioritized.

(ii) construction scale: no higher than the same type of construction scale of key projects.

Article X of the provincial subsidy project reporting conditions.

(a) the project is located in areas of poverty, old revolutionary areas, disaster-stricken areas, etc.. By subsidizing part of the funds for the construction of the project, for the project local area to increase the area of arable land, improve agricultural production conditions, and promote economic development.

(ii) construction scale: provincial subsidy projects in hilly and mountainous areas of more than 10 hectares, more than 20 hectares of plains, the project is relatively centralized and contiguous.

Article XI project reporting requirements.

(a) planning and construction period: provincial investment in key projects, demonstration projects planning and construction period of no more than 2 years, subsidized project planning and construction period of 1 year.

(2) project feasibility study evaluation and demonstration: the investment scale of more than 15 million yuan of projects organized by the provincial Department of Land and Resources evaluation and demonstration; investment scale of less than 15 million yuan of municipal Bureau of Land and Resources evaluation and demonstration of the organization, and reported to the Provincial Department of Land and Resources for approval.

(C) project declaration time: March 31, June 31 and August 31 each year by the municipal land and resources bureau in conjunction with the same level of the Finance Bureau in three batches of eligible land development and consolidation project declaration materials reported to the Provincial Department of Land and Resources and the Provincial Department of Finance, as an alternative to the current year's projects.

Article XII of the project declaration materials.

(a) municipal application report;

(b) project feasibility study report and feasibility study report expert assessment of the validation opinion and the organization of feasibility demonstration of land resource management department of the confirmation of the expert's opinion;

(c) the project location of the county government of the project involves the review of the relevant situation and commitment to prove;

() (D) the general planning map of the project, the current land use status map of the standard subdivision of the project area;

(E) the relevant approval documents involving land development. Involving forestry, agriculture, transportation, water conservancy and other matters, should be attached to the views of the relevant departments, involving projects with farmland and water conservancy projects should be provided with relevant information on the hydrogeological situation;

(f) for land reclamation projects in mining subsidence areas shall be submitted to the project area of the assessment of the stability of the mining subsidence area;

(vii) the project area of the relevant image data;

() (viii) project electronic documents (Word, Excel);

(ix) land development and finishing projects for the record declaration form;

(x) land development and finishing project declaration for the record project benefit calculation form;

(xi) declaration materials for textual materials, diagrams, electronic documents, each of the three sets, a set of image data.

Article XIII of the Provincial Department of Land and Resources in accordance with the relevant provisions and requirements of the project declaration, the municipal land and resources bureau of the project declaration materials reported on the organization of the evaluation and validation and approval.

Article 14 The project survey shall be organized by the municipal land and resources departments with reference to the national land development and consolidation survey principles, with the cooperation of the county land and resources departments where the projects are located, and the provincial land and resources departments shall carry out the verification.

(1) the main content of the survey: according to the conditions of the project, the field investigation of the project area's natural environmental conditions, the current state of land use and ownership, infrastructure conditions, the potential for new arable land, as well as the local people's views on the construction of the project, and so on.

(2) the main content of the verification: project verification work organized by the Provincial Department of Land and Resources, the provincial land consolidation of specialized agencies or combined with the relevant departments of the experts to participate in the project where the city and county departments of land and resources to cooperate.

The verification work shall verify whether the land conditions of the project area, the existing infrastructure conditions, the current state of land use and land ownership are consistent with the information provided, whether there is project superposition and duplication of investment in the same project area, as well as the recognition, motivation and importance attached to the project by the local government where the project is located, the departments, and the public, etc., and submit a written report.

(c) The responsibility system is implemented for on-site investigation and verification.

Article 15 Review of the project into the pool.

(a) the project by the provincial and municipal departments of land and resources have been on-site survey of the project review, put forward audit opinions, municipal departments of land and resources to organize experts to review the project feasibility study report, the review should be reported to the provincial department for the record. The eligible projects are formally included in the land development and finishing project alternative library, as the basis for project declaration and preliminary design.

(ii) the land and resources department of the project feasibility study review and agree to the project, for the record, in line with the specified requirements, included in the provincial investment project alternative library.

(C) provincial and municipal land and resources departments to establish a project review and demonstration of the expert pool, the project selected for review and evaluation of the demonstration level; where there is no expert demonstration of the project shall not be selected for the project pool.

Article XVI of the projects included in the provincial alternative project library, the provincial department will be based on the annual provincial land development special funds in batches of organizations, the preferred arrangements for the establishment of projects.

Article 17 The Provincial Department of Land and Resources from the project library on the basis of merit to validate the new project and approve the project, the continuation of the project requires the project undertaking unit to issue the corresponding stage of the project and the annual financial situation report, by the Provincial Department of Land and Resources of the annual validation of the qualified, before the implementation of the budget.

The Municipal Bureau of Land and Resources shall annually review or audit the new and renewal projects within its jurisdiction and report the investment plans and budgets of the renewal projects. The project undertaking shall submit the declaration of new and renewal projects, and for renewal projects shall compile and report the annual project plan and budget implementation and renewal of the annual plan tasks.
