Chapter I General Provisions
Article 1 These regulations are formulated in accordance with the Civil Aviation Law of the People's Republic of China in order to regulate the construction and management of civil airports, actively and steadily promote the development of civil airports, ensure the safe and orderly operation of civil airports, and safeguard the lawful rights and interests of the parties concerned.
Article 2 These Regulations shall apply to the planning, construction, use and management of civil airports within the territory of the People's Republic of China and its related activities.
Civil airports are divided into transportation airports and general aviation airports.
Article 3 Civil airports are public **** infrastructure. People's governments at all levels shall take the necessary measures to encourage and support the development of civil airports and improve the management of civil airports.
Article 4 The competent civil aviation authorities under the State Council shall, in accordance with law, implement industry supervision and management of civil airports nationwide. Regional civil aviation authorities shall, in accordance with law, exercise industrial supervision and management over civil airports under their jurisdiction.
The relevant local people's governments shall, in accordance with law, implement supervision and management of civil airports.
Article 5 The national civil airport layout plan shall be based on the national economy and social development needs and national defense requirements, and comprehensive transportation development planning, land use planning, urban and rural planning, strictly control the scale of land for construction, land saving and intensive land use, and protection of the ecological environment.
Chapter II Construction and Use
Article 6 The site of a newly constructed transportation airport shall comply with the conditions stipulated by the competent civil aviation department of the State Council.
The relevant local people's governments where the transportation airport is located shall incorporate the site of the transportation airport into the overall land use planning and urban and rural planning arrangements, and implement the protection of the site.
Article 7 The new construction, alteration and expansion of transportation airports shall be in accordance with the relevant provisions of the state for the approval of construction projects, approval procedures.
Article VIII of the transport airport master plan by the transport airport construction projects prepared by the legal person, and by the State Council department in charge of civil aviation or regional civil aviation authorities (hereinafter collectively referred to as the civil aviation authorities) approved before implementation.
The master plan of a transportation airport with a flight area index of more than 4E (including 4E) shall be approved by the competent civil aviation department under the State Council; the master plan of a transportation airport with a flight area index of less than 4D (including 4D) shall be approved by the local regional civil aviation administration. The civil aviation authority approving the master plan of the transportation airport shall consult the relevant local people's government where the transportation airport is located.
The general planning of a transportation airport shall be prepared by the legal person of the transportation airport construction project, and the opinion of the relevant military authorities shall be sought.
Article 9 The relevant local people's governments where the transportation airports are located shall incorporate the master plans of the transportation airports into the urban and rural planning, and shall exercise planning control over the land use and construction of the areas surrounding the transportation airports in accordance with the needs of the operation and development of the transportation airports.
Article 10 The construction projects in the transportation airports shall conform to the general planning of the transportation airports. No unit or individual shall build new, altered or expanded buildings or structures within the transportation airport without authorization.
Article XI of the transport airport new construction, alteration and expansion projects should be designed, construction, acceptance and put into use at the same time as the main project safety facilities. Safety facilities investment should be included in the construction project estimates.
Article XII of the transport airport water supply, power supply, gas supply, communications, roads and other infrastructure by the airport construction project is responsible for the construction; transport airport water supply, power supply, gas supply, communications, roads and other infrastructure by the local people's government of transport airports, unified planning, integrated construction.
Article 13 The design of specialized projects at transport airports shall conform to the relevant national standards and be approved by the civil aviation administration.
The design of the specialized engineering of the transport airports with flight area index of 4E or above (including 4E) shall be approved by the civil aviation authority under the State Council; the design of the specialized engineering of the transport airports with flight area index of 4D or below (including 4D) shall be approved by the civil aviation authority of the region where the transport airports are located.
Professional works of a transportation airport may be put into use only after they have been accepted and passed by the civil aviation administration.
The directory of specialized projects for transport airports shall be formulated and published by the competent civil aviation authority of the State Council in conjunction with the competent construction authority of the State Council.
Article 14 The planning and construction of general-purpose airports shall be carried out in accordance with the relevant state regulations.
Article 15 The safety and operation management of a transportation airport shall be the responsibility of an organization with legal personality (hereinafter referred to as an airport management organization) formed or entrusted in accordance with the law.
Article 16 A transport airport shall have the following conditions when it is put into operation:
(1) It has a sound safety and operation management system, organizational structure and management system;
(2) It has a flight area, terminal area, work area, and related facilities, equipment, and personnel for air traffic services, navigation information, communication, navigation and surveillance, and meteorology, etc., which are appropriate for its operation;
(3) It has a safety and operation management system, organizational structure, and management system; and p>
(3) the use of airspace, flight procedures and operation standards have been approved;
(4) compliance with the national provisions of civil aviation safety and security conditions;
(5) contingency plans to deal with emergencies and the corresponding facilities and equipment.
Article 17 If a transportation airport is put into operation, the airport management agency shall submit an application to the competent department of civil aviation under the State Council, together with relevant materials that meet the conditions stipulated in Article 16 of these Regulations.
The competent department of civil aviation under the State Council shall, within 45 working days from the date of acceptance of the application, complete the examination and make a decision to permit or not permit. Permission is granted, the use of transport airports issued permits; not permitted, shall notify the applicant in writing and explain the reasons.
Article 18 General-purpose airports shall have the following conditions when they are put into use:
(1) a flight site that is suitable for the operation of the business;
(2) air traffic services, communication, navigation, surveillance and other facilities and equipment to ensure the safety of flights;
(3) a sound safety management system, safety and security of civil aviation in accordance with national regulations and emergency plans to deal with emergencies As well as emergency plans to deal with emergencies;
(d) Equipped with the necessary management personnel and professional and technical personnel.
Article 19 If a general-purpose airport is put into use, the manager of the general-purpose airport shall submit an application to the regional civil aviation administration agency where the general-purpose airport is located, and attach relevant materials that meet the conditions stipulated in Article 18 of these Regulations.
The regional civil aviation authority shall review the application within 30 working days from the date of acceptance, and make a decision to permit or not permit. Permission granted, the issuance of general airport license; not allowed, shall notify the applicant in writing and explain the reasons.
Article 20 transportation airports as international airports, shall be in accordance with the relevant provisions of the state to set up port inspection agencies, equipped with the appropriate personnel, space and facilities, and by the relevant departments of the State Council acceptance.
The opening of international airports for use shall be announced by the competent department of civil aviation under the State Council; information on international airports shall be uniformly provided by the competent department of civil aviation under the State Council.
Article 21 The airport management agency shall open and use the transportation airport in accordance with the scope stipulated in the transportation airport use permit, and shall not close it without authorization.
Transportation airports for any reason can not guarantee the safety of civil aircraft operation, the need for temporary closure, the airport authority shall promptly notify the relevant air traffic management department and timely announcement to the community. The air traffic management department shall issue a navigation notice in accordance with the relevant provisions.
The airport management agency intends to close the transport airport, should be reported 45 days in advance to the authority that issued the license for the use of transport airports, and only after approval can be closed, and announced to the public.
Article 22 The naming or renaming of a transportation airport shall be in accordance with the relevant state laws and administrative regulations.
Article 23 If a transportation airport is abandoned or converted to other uses, the airport management agency shall go through the approval procedures in accordance with the relevant state regulations, and promptly announce to the public.
Chapter III Operation Management
Article 26 The airport authority shall organize emergency rescue drills and personnel training for transport airports in accordance with the emergency plan for transport airport emergencies.
Airport management agencies, air transportation enterprises and other resident units shall be equipped with the necessary emergency rescue equipment and devices, and strengthen the daily management.
Article 27 The airport authority shall, in accordance with relevant state laws, regulations and technical standards, to ensure that the transportation airport continues to meet the requirements of safe operation. Transportation airports do not meet the requirements for safe operation, the airport authority shall, in accordance with the relevant provisions of the state timely correction.
Article 28 of the airport management agency of the transport airport safety operations to implement the unified coordination and management, is responsible for the establishment of a sound airport safety operation responsibility system, the organization of the formulation of airport safety operation rules and regulations, to ensure the effective implementation of the airport safety inputs, supervision and inspection of the safety operation work, the timely elimination of hidden safety accidents, and according to the law to report accidents in the production of safety.
The occurrence of the situation affecting the safe operation of transportation airports should be immediately reported to the airport authority.
Article 29 The airport management agencies, air transportation enterprises and other resident units shall regularly carry out the necessary safety operation training for employees, to ensure that employees have the relevant knowledge and skills.
Article 30 The special equipment for civil airports shall comply with the national standards and relevant technical specifications, and by the competent department of civil aviation under the State Council recognized by the agency inspection and qualification, before being used in civil airports.
The civil aviation administration shall strengthen the supervision and inspection of special equipment for civil airports.
The catalog of special equipment for civil airports shall be formulated and published by the competent civil aviation department under the State Council.
Article 31 In the case of transportation airports open for use, no construction shall be carried out in the flight area and the terminal area adjacent to the flight area. Where such construction is necessary, approval shall be obtained from the civil aviation authority of the region where the transportation airport is located.
Article 32 In the event of an emergency, the relevant local people's government where the transportation airport is located, the civil aviation administration, the air traffic management department, the airport management agency and other units shall carry out emergency rescue in a timely and effective manner in accordance with the requirements of the emergency plan.
Article 33 The airport management organization shall coordinate and manage the production and operation of the transportation airport, maintain the normal order of the transportation airport, and provide fair, just and convenient services for the air transport enterprises and other resident units, passengers and cargo owners.
The airport management agency and air transportation enterprises and other on-site units shall sign a written agreement to clarify the rights and obligations of each party in the process of production and operation, airport management, as well as in the event of flight delays and other situations.
Article 35 The airport management organization shall, in accordance with national standards, equipped with waiting, catering, parking, medical emergency and other facilities and equipment, and provide appropriate services.
Article 36 The airport management agency shall establish an information **** enjoyment mechanism with air transport enterprises, air traffic management departments and other units to provide each other with the necessary information on production and operation, and provide passengers and cargo owners with timely and accurate information.
Article 37 of the airport management agencies, air transport enterprises and other resident units shall take effective measures to strengthen coordination and cooperation, **** with the normal operation of flights.
Article 38 of the airport within the scope of the retail, catering, aviation ground services and other business operations to take the transfer of operating rights for compensation, the airport management agency shall, in accordance with the provisions of the competent department of civil aviation under the state council and the acquisition of operating rights of the enterprise to sign an agreement to clarify the service standards, fee levels, safety norms and responsibilities and other matters.
For the business operated by way of transferring the operation right with compensation, the airport management organization and its affiliates shall not participate in the operation.
Article 39 The airport management agency shall submit to the civil aviation administration relevant information on the planning, construction and production operation of transportation airports, and accept the supervision and inspection of the civil aviation administration.
Article 41 Enterprises engaged in aviation fuel supply business in civil airports shall have the following conditions:
(1) obtaining the license to operate refined petroleum products and the license to operate hazardous chemicals;
(2) having aviation fuel supply facilities and equipments in compliance with the relevant national standards and appropriate to the scale of operation;
(3) having sound aviation fuel supply safety management system, oil products management system, oil products management system and other safety management systems; and
(3) having sound aviation fuel supply safety management system, oil products management system and other safety management systems. (C) have a sound aviation fuel supply safety management system, oil testing and monitoring system;
(D) have professional technology and management personnel to meet the needs of business operations.
Article 42 An enterprise applying for engaging in the business of aviation fuel supply within a civil airport shall submit an application to the regional civil aviation administrative agency in the area where the civil airport is located, together with relevant materials that meet the conditions stipulated in Article 41 of these Regulations.
The regional civil aviation authority shall, within 30 working days from the date of acceptance of the application, make a decision on the granting of permission or denial of permission. Permitted, issued by the civil airport aviation fuel supply safety operation license; not allowed, shall notify the applicant in writing and explain the reasons.
Article 43 of the aviation fuel supply enterprises to supply aviation fuel shall comply with aviation fuel airworthiness standards.
Article 44 The aviation fuel supply facilities at civil airports shall be equitably provided for use by aviation fuel supply enterprises.
Article 45 If an aviation fuel supply enterprise at a transportation airport ceases its aviation fuel supply business at the transportation airport, it shall notify the civil aviation administration agency of the region where the transportation airport is located, the airport administration agency and the relevant air transportation enterprise 90 days in advance.
Chapter IV Environmental Protection
Article 46 The civil aviation administrative agency of the region where the civil airport is located and the relevant local people's government shall, in accordance with the relevant provisions of the State, delineate the net air protection area of the civil airport and publicize it to the society.
Article 47 The local people's governments at or above the county level shall, for the purpose of approving construction projects within the airspace protection areas of civil airports, consult in writing with the civil aviation administrative agencies of the regions where the civil airports are located.
Article 48 Where a high-voltage transmission tower of more than 220,000 volts (including 220,000 volts) is set up within the airspace clearance protection area of a civil airport, it shall set up obstacle lights or signs in accordance with the relevant provisions of the competent civil aviation department of the State Council, maintain its normal state, and provide relevant information to the civil aviation administrative agency of the region where the civil airport is located, the air traffic management department and the airport management agency.
Article 49 It is prohibited to engage in the following activities within the airspace clearance protection area of civil airports:
(1) Emission of large quantities of smoke, dust, flames, exhaust gases and other substances affecting flight safety;
(4) Planting of plants affecting flight safety or affecting the use of navigational aids at civil airports;
(5) Releasing of birds affecting flight safety, raising of unmanned free balloons, tethered balloons and other lifting objects;
Article 50 Anyone who engages in the activities listed in Article 49 of these Regulations outside the airspace protection area of civil airports shall not affect the protection of the airspace of civil airports.
Article 51 It is prohibited to construct air-to-air firing ranges and other facilities that may affect flight safety in the zones within 30 kilometers from the borders on each side of the flight path.
Article 52 The civil aviation administration and the airport management organization shall strengthen the verification of the net air condition of civil airports. If any situation affecting the protection of the civil airport's airspace is found, it shall be stopped immediately and reported in writing to the local people's government at or above the county level where the civil airport is located. The local people's government at or above the county level that receives the report shall promptly take effective measures to eliminate the impact on flight safety.
Article 53 The local radio administration of the civil airport shall, in conjunction with the regional civil aviation authorities in accordance with the relevant provisions of the national radio management and standards to determine the electromagnetic environmental protection areas of civil airports, and publicize to the community.
Electromagnetic environmental protection areas of civil airports, including civil aviation radio stations (stations) set up in the general planning area of civil airports, electromagnetic environmental protection areas and civil airports, electromagnetic environmental protection areas of the flight zone.
Article 54 The setting up and use of ground-based civil aviation radio stations (stations) shall be examined and approved by the Civil Aviation Administration in accordance with the relevant provisions of the national radio management procedures for approval, and receive a radio station license.
Article 55 In the electromagnetic environmental protection area of civil airports set up, the use of non-civil aviation radio stations (stations), the radio administration shall consult the civil aviation authorities in the region where the civil airport, in accordance with the relevant provisions of the national radio management approval.
Article 56 It is prohibited to engage in the following activities affecting the electromagnetic environment of civil airports within the electromagnetic environmental protection area of civil aviation radio stations (stations):
(b) storing metal accumulations;
(c) planting tall plants;
(d) engaging in activities of altering the topography and geomorphology of terrain, such as digging soil, sand mining and quarrying stones;
(e) Other behaviors affecting the electromagnetic environment of civil airports as stipulated by the competent department of civil aviation under the State Council.
Article 57 The radio station (station) and other instruments and devices used by any unit or individual shall not interfere with the normal use of the dedicated civil aviation radio frequency.
Article 58 When the civil aviation radio frequency is interfered with, the airport authority and civil aviation management shall immediately take measures to eliminate in time; if it is not possible to eliminate, it shall notify the local radio administration where the civil airport is located. The notified radio administration shall take measures to investigate and deal with according to law.
Article 59 Civil aircraft landing and taking off at civil airports shall comply with national airworthiness standards for aircraft noise and turbine engine emissions.
Article 60 The airport authority shall, in conjunction with air transportation enterprises, air traffic management departments and other relevant units, take technical means and management measures to control the impact of civil aircraft noise on the surrounding areas of the transportation airport.
Article 61 The relevant local people's governments where the civil airports are located to formulate the overall land use planning and urban and rural planning for the areas around the civil airports, shall give full consideration to the impact of civil aircraft noise on the areas around the civil airports, in line with the relevant national quality standards for the acoustic environment.
Airport management agencies shall report the impact of civil aircraft noise on the surrounding areas of transportation airports to the competent authorities of the relevant local people's governments in charge of land resources, planning and construction, and environmental protection.
Article 62 The relevant local people's government of the place where the civil airport is located shall delineate an area in the peripheral area of the civil airport to restrict the construction of noise-sensitive buildings and implement control. It is necessary to construct noise-sensitive buildings in the area, the construction unit shall take measures to mitigate or avoid the noise impact of civil aircraft operation.
The relevant local people's governments where civil airports should be coordinated with the regional civil aviation authorities to solve the noise impact of civil aircraft landing and taking off at civil airports caused by related issues.
Chapter V Legal Liability
Article 63 In case of violation of the provisions of these Regulations, the civil aviation administration shall order correction and impose a fine of not less than 100,000 yuan and not more than 500,000 yuan for any one of the following cases:
(1) Carrying out construction activities within the transportation airport field that do not conform to the overall planning of the transportation airport;
(2) unauthorized implementation of the unapproved design of the specialized works of the transport airport, or putting into use the unapproved specialized works of the transport airport that have not passed the acceptance test;
(iii) carrying out unapproved construction activities in the flight area and the terminal area adjacent to the flight area when the transport airport is open for use.
Article 64 If, in violation of the provisions of this Regulation, an airport management agency fails to use a transportation airport in accordance with the scope specified in the transportation airport use permit, the regional civil aviation management agency in the area where the transportation airport is located shall order rectification and impose a fine of not less than 200,000 yuan and not more than 1,000,000 yuan.
Article 65 If, in violation of the provisions of these Regulations, an airport management agency closes a transportation airport without approval, it shall be ordered to make corrections by the regional civil aviation administration agency where the transportation airport is located and shall be subject to a fine of not less than 100,000 yuan and not more than 500,000 yuan.
Article 66 Violation of the provisions of these regulations, the airport management agency for reasons can not guarantee the flight safety of civil aircraft, the temporary closure of transport airports, without timely notification of the relevant air traffic management department and timely announcement to the community, or approved the closure of transport airports are not timely announced to the community, by the transport airport is located in the region of the civil aviation management agency shall order correction, impose a fine of 20,000 yuan or more than 100,000 yuan. A fine of not less than 20,000 yuan shall be imposed.
Article 67 If, in violation of the provisions of these Regulations, an airport management organization fails to conduct emergency rescue drills in accordance with the requirements of the emergency plan or fails to equip with the necessary emergency rescue equipment and devices, it shall be ordered to make corrections by the regional civil aviation administration agency and fined from RMB 10,000 yuan to less than RMB 50,000 yuan.
Article 68 Violation of the provisions of these Regulations, the transport airport put into use does not meet the requirements for safe operation, the airport management agency refuses to make corrections, or after correction still does not meet the requirements for safe operation, the civil aviation administration to make a decision on restricting the use of the; the circumstances are serious, the use of transport airports revocation of the license.
Article 69 If an airport management organization fails to perform its management duties in accordance with the provisions of these Regulations, resulting in a ground accident at a transportation airport, a civil aircraft flight accident or a serious accident symptom, the civil aviation administration shall order corrections and impose a fine of 200,000 yuan or more than 1 million yuan.
Article 70 Violation of the provisions of these regulations, the airport management agency in the transport airport ground use does not meet the national provisions of the standards and relevant technical specifications of the civil airport special equipment, by the transport airport in the region of the regional civil aviation management agency shall order to stop the use of a fine of 100,000 yuan to 500,000 yuan.
Seventy-one violation of the provisions of this regulation, the occurrence of emergencies, airport management agencies, air traffic management departments and other units failed to carry out emergency rescue in a timely and effective manner in accordance with the requirements of the emergency response plan, the regional civil aviation management agency ordered to make corrections, and impose a fine of 100,000 yuan or more than 500,000 yuan or less.
Article 72 If, in violation of the provisions of these Regulations, a person engages in the business of supplying aviation fuel at a civil airport without obtaining a license for the safe operation of supplying aviation fuel at civil airports, he shall be ordered by the regional civil aviation administrative agency where the civil airport is located to make corrections, and shall be subject to a fine of not less than RMB 200,000 and not more than RMB 1 million; if there is any unlawful income, the unlawful income shall be confiscated.
Article 73 Violation of the provisions of these Regulations, aviation fuel supply enterprises supply aviation fuel does not meet the aviation fuel airworthiness standards, by the civil aviation management agencies in the region where the civil airport is ordered to correct, impose a fine of 200,000 yuan or more than 1 million yuan; the circumstances are serious, the revocation of the civil airport aviation fuel supply safety operation license.
Article 74 Violation of the provisions of these Regulations, the transportation airport aviation fuel supply enterprises to stop the transportation airport aviation fuel supply business, not 90 days in advance to inform the regional civil aviation management agencies, airport management agencies and related air transport enterprises, by the transportation airport where the regional civil aviation management agencies impose a fine of 50,000 yuan to 250,000 yuan.
Article 75 In case of violation of the provisions of these Regulations, the regional civil aviation administration agency shall order correction and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan in any of the following cases:
(1) The airport administration agency does not equip facilities and equipment for waiting, catering, parking, medical emergency and other facilities in accordance with the standards stipulated by the state and provide the corresponding services;
(2) When flights are delayed, airport management organizations, air transport enterprises and other on-site units do not provide appropriate services for passengers and cargo owners in accordance with relevant regulations and service commitments.
Article 76 If, in violation of the provisions of these Regulations, an airport management agency and its affiliates are involved in the operation of a business that takes the form of transferring the right to operate in return for payment, the regional civil aviation management agency shall order rectification and impose a fine of not less than 100,000 yuan and not more than 500,000 yuan; if there is any illegal income, the illegal income shall be confiscated.
Article 77 If, in violation of the provisions of these Regulations, an airport management organization fails to submit to the civil aviation administration relevant information on the planning, construction and production and operation of a transportation airport, it shall be ordered by the civil aviation administration to make corrections; if it refuses to make corrections, it shall be subject to a fine of not less than RMB 10,000 yuan and not more than RMB 50,000 yuan.
Article 78 If, in violation of the provisions of these Regulations, a high-voltage transmission tower of more than 220,000 volts (including 220,000 volts) is set up in the airspace protection area of a civil airport, or if an obstacle light or sign is not set up in accordance with the relevant provisions of the competent department of civil aviation under the State Council, the civil aviation administrative agency of the region in which the civil airport is located shall order rectification, and impose a fine of not less than RMB 100,000 but not more than RMB 500,000 yuan.
Article 79 Violation of the provisions of these regulations, one of the following circumstances, the local people's government at or above the county level where the civil airport is located shall order correction; if the circumstances are serious, a fine of 20,000 yuan or more than 100,000 yuan or less shall be imposed:
(1) Emission of large quantities of smoke, dust, flames, exhaust gases, and other substances affecting flight safety;
(2) Construction of firing ranges, strong explosives warehouse and other buildings or other facilities affecting flight safety;
(c) Setting up lights, signs or objects affecting the use of visual aids to navigation at civil airports or pilots' line of sight;
(d) Planting plants affecting flight safety or affecting the use of navigational aids to navigation at civil airports;
(e) Releasing birds, raising and releasing unmanned free balloons, tethered balloons, or other devices affecting flight safety. Unmanned free balloons, tethered balloons and other airborne objects;
(6) burning crop stalks, garbage and other materials that produce a lot of smoke, or setting off fireworks, fireworks;
(7) within 5 meters outside the boundaries of civil airports, erecting buildings, planting trees, or engaging in excavation, piling up of objects, and other activities affecting the safety of operation of civil airports;
(viii) Other behaviors affecting the protection of the airspace of civil airports as stipulated by the competent department of civil aviation under the State Council.
Article 80 Violation of the provisions of these Regulations, the use of radio stations (stations) or other instruments, devices, the normal use of civil aviation radio frequency interference, by the local radio administration of civil airports shall be ordered to correct; the circumstances are serious, shall be sentenced to 20,000 yuan or more than 100,000 yuan of the following fine.
81 Violation of the provisions of these Regulations, in civil aviation radio stations (stations) within the electromagnetic environmental protection area to engage in the following activities, by the local people's government at or above the county level where the civil airport is located and ordered to make corrections; the circumstances are serious, impose a fine of 20,000 yuan or more than 100,000 yuan:
(a) the construction of overhead high-voltage power lines, overhead metal lines, railroads, highways, electric power drainage and irrigation stations;
(ii) storage of metal accumulations;
(iii) engaging in activities such as digging, sand mining, quarrying and other activities that change the topography and geomorphology;
(iv) other behaviors affecting the electromagnetic environmental protection of the civil airports as stipulated by the competent department of civil aviation under the State Council.
Article 82 If, in violation of the provisions of these Regulations, a civil aircraft taking off or landing at a civil airport fails to comply with the national airworthiness standards for aircraft noise and turbine engine emissions, the civil aviation administration shall order the relevant air transportation enterprise to make corrections, and may impose a fine of not more than RMB 100,000 yuan; and if the civil aviation authority refuses to make corrections, it shall impose a fine of not less than RMB 100,000 yuan but not more than RMB 500,000 yuan.
Article 83 If a state employee violates the provisions of these Regulations in any of the following cases, he or she shall be punished by the relevant departments in accordance with law:
(1) Failure to carry out administrative licensing in accordance with the provisions;
(2) Failure to carry out supervisory and inspection duties in accordance with the law;
(3) Failure to carry out administrative coercive measures or administrative penalties in accordance with the law;
(4) Other acts of abuse of power and dereliction of duty.
Chapter VI Supplementary Provisions
Article 84 The transportation airports referred to in these regulations are airports that provide takeoff and landing services for civil aircraft engaged in public **** air transportation activities such as passenger and cargo transportation.
General aviation airports referred to in these regulations are airports that provide takeoff and landing services for civil aircraft engaged in operational flights in industry, agriculture, forestry, fishery and construction, as well as flight activities such as medical and health care, disaster relief, meteorological exploration, ocean monitoring, scientific experimentation, education and training, culture and sports.
Article 85 The transport airports with flight area index of 4D referred to in these Regulations are those airports which can be used for the take-off and landing of civil aircrafts with the length of the base flight site greater than 1800 meters, the wingspan between 36 meters and 52 meters, and the spacing between the outer wheels and outer edges of the main landing gear between 9 meters and 14 meters.
Transport airports with a flight area index of 4E as referred to in this Regulation are those airports that can be used for takeoff and landing of civil aircraft with a length of the base flight site greater than 1800 meters, a wingspan of 52 meters to 65 meters, and a spacing between the outer wheels of the main landing gear and the outer edges of the outer wheels of the main landing gear of between 9 meters and 14 meters.
Article 86 In addition to complying with the relevant provisions of these Regulations, the management of the civil portion of a joint military-civilian airport shall also comply with the relevant provisions of the State Council and the Central Military Commission.
Article 87 These Regulations shall come into force on July 1, 2009.
