Xinjiang Uygur Autonomous Region Road Transportation Management Regulations

Chapter I. General Provisions Article 1 In order to strengthen the management of road transportation, establish a unified, open, competitive and orderly road transportation market, and protect the lawful rights and interests of road transportation operators and passengers, cargo owners and other service recipients, the Regulations are formulated in accordance with the relevant laws and regulations, and in the light of the actual situation of the Autonomous Region. Article 2 The road transport referred to in these regulations, including road passenger transport, cargo transport and road transport related vehicle maintenance, handling, transportation services. Article 3 All units and individuals engaged in road transportation business and management activities in the administrative area of the autonomous region shall comply with these regulations. Laws and regulations provide otherwise, shall be subject to its provisions. Article 4 The road transport adhere to a variety of economic components * * * with the development, unified management, active support, guarantee safety, improve efficiency, quality service principle, to protect the legitimate business, against unfair competition. Article 5 The autonomous region traffic administrative department in charge of the region's road transport work, prefectures, states, cities and counties in charge of traffic administrative department of the road transport work in the administrative area, the county (city) above the traffic transport management agencies (hereinafter referred to as transport management agencies) to specifically implement the management of road transport in the administrative area. Chapter II opening and change Article 6 engaged in commercial road transport operators, must have the state and autonomous regions with its business type, project and scope of equipment, facilities, funds and professional staff and other opening conditions. Non-operational road transport units and individuals temporarily engaged in no more than three months of operational road transport, shall apply to the local county (city) transport agency for temporary operation procedures.

The applicant with the business license to the industry and commerce, the tax department for registration procedures before being allowed to operate. Article VIII engaged in commercial road transport operators should be in accordance with the approved scope of business, project, regional business. Need to change the business project, the scope of business, must be 30 days in advance of the original approval of the opening of the department for approval; relocation, name change and other changes as well as closure, should be reported to the original approval of the opening of the department for the record. Article IX transport agencies engaged in commercial road transport operators qualifications for the implementation of annual validation system. Without annual validation or failed by the annual validation, shall not continue to engage in road transportation. Road transport operators shall be required to submit statistical reports and related information to the local transport authorities. Article 10 prohibits any unit or individual to use end-of-life vehicles engaged in road transport activities. Chapter III Passenger Transportation Article XI road passenger transportation, including shuttle bus passenger transport, tourist passenger transport, cab passenger transport and chartered passenger transport. Indeed need to change the vehicle or transfer to other vehicles for transportation, shall not be repeated charges.

Strictly prohibit passenger transport operators to pull passengers and interference, crowding out the normal road transport business activities. Article XVI due to the fault of the passenger transport operator caused by passengers missed, misuse, the operator shall, in accordance with the requirements of the passengers to refund the ticket or arrange for a change of ride; cause personal injury to the passengers or accompanied by checked baggage damage, loss, the operator shall be held liable for compensation. Article XVII passenger transport operators shall strictly enforce the approved vehicle crewing standards, prohibit overcrowding, speeding, to ensure passenger safety. Article XVIII passengers must hold a valid ticket, consciously maintain the order of the bus, care of public **** facilities. It is strictly prohibited to carry flammable, explosive, toxic, corrosive and other dangerous goods and other prohibited items into the station, by car. Article 19 is strictly prohibited tractors, freight vehicles and other vehicles prohibited by state regulations to carry passengers engaged in road passenger transportation. Chapter IV Cargo Transportation Article 20 of the commercial road transport of goods in accordance with the principle of fair competition, merit-based consignment by the consignor and consignee sign a contract of carriage.

The carrier shall transport goods in accordance with the approved scope of business, the type of vehicle and technical conditions.

Road less-than-truckload carriers shall be approved routes, schedules, stations. Article 21 of the State and the autonomous regional people's government to determine the bulk materials, foreign-related goods and other special materials transport, the autonomous regional administrative department of transportation issued transport plans, transport agencies at all levels of specific organization and implementation.

The people's governments of counties (cities) and above to decide the rescue, disaster relief and other emergency transport tasks, by the local administrative department of transportation issued transport plans, transport agencies are responsible for the organization and implementation. Any unit or individual engaged in road transportation business activities must obey the scheduling.
