Wuxi City construction project bidding and tendering management measures (2014)

Chapter I General Provisions Article 1 In order to standardize the construction project bidding and tendering activities, safeguard the legitimate rights and interests of the parties involved in bidding and tendering, according to the "Chinese People's Republic of China *** and the State Bidding and Tendering Law", "Chinese People's Republic of China *** and the State Bidding and Tendering Law Implementation Regulations", "Jiangsu Province Bidding and Tendering Regulations", "Jiangsu Province, the Construction Market Management Regulations" and other laws and regulations, combining with the actuality of the city, to formulate the present measures. Article 2 in the city within the scope of the urban areas of the construction works and construction works related to goods and services bidding activities, the application of these measures. Article 3 The construction works referred to in these Measures, refers to all types of new construction, alteration and expansion of housing construction and municipal infrastructure projects, including:

(1) housing construction and its ancillary facilities;

(2) and housing construction supporting the lines, pipelines, equipment installation and renovation, demolition, repair works;

(3) city roads, tunnels, rail transit, urban Lighting, water supply, drainage, gas, heat, sewage treatment, sanitation, garbage disposal, underground public **** facilities and ancillary facilities, such as civil construction, piping, equipment installation, landscaping and other municipal infrastructure projects.

The goods related to the construction works referred to in this method refers to the equipment and materials that constitute an inseparable part of the project and are necessary for the realization of the basic functions of the project.

Services related to the construction works referred to in these measures, refers to the survey, design, supervision, engineering consulting, engineering management and other services required for the completion of the project. Article 4 The bidding and tendering for construction projects shall adhere to the principles of openness, fairness, impartiality, meritocracy and integrity. Article 5 The municipal construction administrative department shall be responsible for the supervision and management of bidding and tendering activities for construction projects within the urban area of the city.

Development and reform, finance, supervision and other departments in accordance with their respective responsibilities, is responsible for doing a good job in construction bidding activities. Article 6 The municipal construction administrative department shall establish the city's unified construction bidding integrity information management system, collection, audit, record, publication, management of bidding parties to the integrity of information. Article 7 The municipal administrative department in charge of construction shall establish a bidding and tendering expert group collegiality system, is responsible for bidding and tendering activities involving the qualification level, the joint qualification of different professions, the handling of complaints and other matters to put forward processing opinions. Chapter II Tendering Article VIII must be bid in accordance with the law, the scope and scale of construction works, in accordance with national and provincial regulations and standards.

No unit or individual shall not be required by law to bidding construction works into zero or otherwise avoid bidding.

Encouragement of construction projects other than those that must be tendered by tender. Article IX must be bid in accordance with the law shall be in the municipal construction engineering trading center (hereinafter referred to as the trading center) for bidding activities; encouragement of construction projects other than must be bid in the trading center for bidding activities.

The trading center shall establish a network security mechanism, contingency plans and system management system, build a platform for information collection, storage and dissemination of information for the construction project bidding and tendering activities to provide information dissemination, consulting, electronic bidding and tendering services, and to accept the supervision and management of the competent department of the city's administrative department of construction and business guidance. Article 10 encourages the bidding and tendering parties to use the information network for electronic bidding and tendering.

The bidding and tendering parties to carry out electronic bidding and tendering, shall enter the city's unified electronic bidding and tendering of construction projects database, comprehensive and true entry of relevant information, shall not be false.

The information used in the electronic bidding and tendering activities to the bidding and tendering database information shall prevail. Article XI of the construction project bidding shall have the following conditions:

(a) the bidder has been established in accordance with law;

(b) has been in accordance with the provisions of the relevant examination and approval, approval, filing and other formalities;

(c) to meet the bidding of the required technical information or design drawings;

(d) bidding scope of the required funds or sources of funds have been implemented;

(E) other conditions stipulated by laws and regulations.

The implementation of the project on behalf of the construction system, should also be issued by the bidder's letter of entrustment and the agreement signed by the bidder and the project manager; the use of BT, BOT and other means of construction, should also provide relevant approval documents or information.

The bidding of goods and services related to the construction project shall comply with relevant laws and regulations. Article XII of the construction works must be bidding, the bidder to organize its own bidding, shall meet the following conditions, and will be reported to the municipal administrative department of construction for the record:

(1) a legal person or other organization qualifications;

(2) with the construction works compatible with the technical, cost, financial and management aspects of technical force;

(3) there are three or more personnel with bidding business capacity;

(4) have the ability to prepare bidding documents and organize bid opening, bid evaluation, and bid fixing;

(5) other conditions stipulated by laws and regulations. Article 13 The bidder does not meet the conditions for organizing the bidding on its own, it shall entrust the bidding agent with appropriate qualifications to organize the bidding, sign the entrustment contract, and report to the municipal construction administrative department for the record.

All the use of state-owned capital investment or state-funded construction projects (hereinafter referred to as state-funded construction projects) entrusted to bidding, should be openly and selectively determine the bidding agent, the specific measures shall be formulated by the municipal administrative department in charge of construction in conjunction with the relevant departments.
