Article 1 In order to strengthen grassland fire prevention, actively prevent and fight grassland fires, safeguard people's lives and property, and protect grassland resources, these regulations are formulated in accordance with the relevant provisions of the "Grassland Law of the People's Republic of China *** and the State".
Article 2 These Regulations shall apply to the prevention and extinguishing of fires in all grasslands (including grassy mountains and grasslands) within the territory of the People's Republic of China; however, forested areas and urban areas are excluded.
Article 3 Grassland fire prevention work to implement the prevention-oriented, prevention and elimination of the combination of the policy.
Article 4 The agricultural and animal husbandry departments of the State Council shall be in charge of the national grassland fire prevention work.
Local people's governments at or above the county level may, in the light of the actual situation, determine the grassland fire prevention department in charge of grassland fire prevention work within the administrative area.
The people's governments at the township level are responsible for grassland fire prevention in their administrative areas.
The grassland fire prevention work in the key grassland fire prevention zones shall be carried out by the administrative leaders of the local people's governments concerned and by the leaders of the departments and units.
Article 5 The state encourages and supports scientific research on grassland fire prevention, and promotes advanced fire prevention technology.
Sixth key grassland fire prevention areas of the relevant local people's governments and their relevant departments, shall organize regular grassland fire prevention publicity and education activities, and improve citizens' awareness of grassland fire prevention.
Article 7 The prevention and fighting of grassland fires is the duty of citizens.
Chapter II Prevention of Grassland Fire
Article 8 The local people's governments at all levels shall organize the delimitation of grassland fire prevention responsibility area, determine the grassland fire prevention responsibility unit, establish the grassland fire prevention responsibility system, and regularly carry out inspections.
The relevant local people's governments of key grassland fire prevention areas shall strengthen the organization of grassland fire prevention work.
Article 9 of the grasslands of animal husbandry enterprises and institutions, troops, railroads, farms, forests, industrial and mining enterprises, management units of nature reserves and rural collective economic organizations, under the leadership of the local people's government and its grassland fire prevention authorities, is responsible for grassland fire prevention within the scope of their own systems and units.
All units operating and using grasslands should establish mass fire-fighting teams (groups), the key grassland fire prevention areas should also organize professional fire-fighting teams.
Article 10 At the junction of administrative regions in the grassland, grassland and forest junction area, the relevant local people's governments shall establish fire prevention work joint defense system, agreed to convene the unit, to determine the joint defense area, the development of joint defense measures, inspection, supervision of joint defense area of grassland fire prevention work.
Article XI of the local people's governments at or above the county level shall, in accordance with the natural conditions of the region and the law of occurrence of grassland fires, the grassland fire prevention period; in the grassland fire prevention period of high temperatures, droughts, winds, and other fire risk weather, you can delineate the delineation of the plains of the fire control area, the provisions of the grassland fire control period.
The grassland fire prevention period, the grassland fire prevention authorities of the relevant local people's governments can enter the grassland vehicles and personnel for fire safety checks.
Article 12 During the grassland fire control period, wildfire is prohibited in the grassland; if fire is needed due to special circumstances, the following provisions must be observed.
(a) because of burning, burning ash accumulation of fertilizer, burning straw, burning fire prevention isolation zone, etc., the need for productive use of fire, the person whose authorized units approved.
Productive fire approved, the fire unit should determine the person in charge, beforehand, open the fire barrier, ready to fight the fire tools, the implementation of fire prevention measures to prevent fire.
(2) in the grasslands engaged in animal husbandry or sideline production, the need for domestic fire, should be in a designated safe place to use fire, and take the necessary fire prevention measures, fire must be completely extinguished after the remaining fire.
(3) Persons entering the grassland fire control area must obey the fire control by the grassland fire control department of the local people's government at or above the county level or its authorized units.
Article 13 of the grassland fire prevention period, in the grassland operation and through the grassland all kinds of motorized vehicles, must be installed fire prevention devices, take effective measures to prevent leakage of fire, fire and motorized brake tiles fall off caused by fire. Traveling on the grassland passenger trains and public **** car, drivers and crew should be fire safety education for passengers, to prevent passengers from throwing fire.
Operating machinery and equipment in the field, must comply with fire safety regulations, to prevent fire.
Article XIV of the grassland fire prevention period prohibit the use of firearms on the grassland hunting hogs; the need for live-fire exercises, blasting, surveying and construction activities. Shall be approved by the grassland fire prevention department of the people's governments of provinces, autonomous regions and municipalities directly under the central government or its authorized units, and implement fire prevention measures, make preparations to extinguish the fire.
Article XV of the grassland fire prevention period, the troops snore unexpected events and the implementation of other tasks, the need to enter the grasslands or in the grasslands for live-fire exercises, blasting and other activities, shall be approved by its higher authorities, and the implementation of the necessary fire prevention measures.
Article XVI of the grassland fire control period, it is strictly prohibited in the fire control area of all field fires, the grassland fire may be caused by mechanical equipment and residential fire, must be strictly managed.
Article XVII of the key grassland fire prevention area of the relevant local people's government, should be based on the actual situation, the organization of the relevant units to carry out the following grassland fire prevention facilities:
(1) set up fire lookout;
(2) in the inner national boundary and important facilities, industrial and mining enterprises, schools and settlements, etc., the opening of the fire prevention zone;
(iii) equipping grassland fire prevention transportation, fire-fighting equipment and observation and communication equipment, etc., building fire prevention highways, and reserving necessary fire prevention materials.
To carry out large areas of grassland construction, shall at the same time formulate the construction plan of grassland fire prevention facilities, and organize the implementation.
Article 18 The grassland fire prevention department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall establish a management system for the use of special vehicles, equipment, equipment and facilities for grassland fire prevention, and regularly check the implementation.
Article 19 of the grassland fire prevention departments and meteorological agencies, shall jointly establish grassland fire risk monitoring system. Meteorological agencies at all levels should be based on the actual needs of grassland fire prevention, grassland fire weather monitoring and forecasting work.
Chapter III grassland fire fighting
Article 20 Any unit or individual found that the grassland fire, must immediately fight, and promptly report to the local people's government or grassland fire prevention department. The local people's government or the grassland fire prevention department receives the report, must immediately organize the local military and civilian fighting, and at the same time reported to the people's governments of provinces, autonomous regions and municipalities directly under the Central People's Government grassland fire prevention department.
The grassland fire prevention authorities of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government of the following grassland fires, shall immediately report to the State Council agricultural and animal husbandry departments of the grassland fire prevention agencies:
(a) grassland fires in the vicinity of the national boundary line;
(b) major, mega grassland fires;
(c) grassland fires that threaten settlements and key facilities;
(d) grassland fires that threaten primary forests;
(e) grassland fires that have not been extinguished for more than 24 hours;
(f) grassland fires of great danger in the border areas of provinces, autonomous regions and municipalities directly under the Central Government;
(g) grassland fires that require state support to fight.
Article 21 Fighting grassland fires, by the local people's government or grassland fire prevention department in charge of the unified organization of the command. Units and individuals who receive the order to fight the fire must quickly go to the designated place and put into the fight.
The disabled, pregnant women and children shall not be mobilized to participate in fighting grassland fires.
Article 22 When fighting grassland fires, animal husbandry departments shall do a good job of transferring and evacuating livestock; meteorological agencies shall do a good job of fire-related weather forecasts in a timely manner; railroads, transportation and civil aviation departments shall give priority to the provision of means of transportation; the post and telecommunications departments shall ensure the smooth flow of communication; the civil affairs departments shall properly resettle the victims; the public security departments shall investigate and deal with cases of grassland fires in a timely manner to strengthen Public security departments shall investigate grassland fire cases in a timely manner and strengthen public security management; departments of commerce, supply and marketing, food, materials, energy, health and other departments shall do a good job in supplying relevant materials and medical rescue work.
Article 23 After a prairie fire has been extinguished, a unit designated by the competent prairie fire prevention department of the relevant local people's government shall conduct a comprehensive inspection of the fire scene, clear the residual fire, and retain sufficient personnel to guard the fire scene, and shall only be withdrawn from the guard after the relevant local people's government or the competent department of the prairie fire prevention department has inspected and accepted the fire scene.
Chapter IV Aftermath Work
Article 24 After the prairie fire extinguished, the relevant local people's government shall organize the relevant departments in a timely manner to formulate grassland improvement plan, organize the implementation of replanting grass seed and other technical measures to restore the pasture vegetation, and to do a good job in the prevention and control of human and animal diseases and quarantine, to prevent the occurrence and spread of epidemics.
Article 25 Injured, disabled or sacrificed in fighting grassland fires, state employees (including state organs, state-owned enterprises and institutions of contract workers and temporary workers, the same below) by their units in accordance with the relevant provisions of the medical expenses, pension; non-state employees by the fire unit in accordance with the provisions of the relevant competent departments of the State Council to bear the medical expenses, pension, fire unit determined to be unable to bear, the relevant unit of the fire unit in accordance with the provisions of the relevant departments of the State Council to bear the medical expenses, pension. If the unit is determined to be unable to bear the medical expenses, the local people's government concerned shall bear the medical expenses and provide pensions.
For those who sacrificed their lives in fighting the fire, in accordance with the provisions of the Regulations on the Commendation of Revolutionary Martyrs, those who should be recognized as martyrs shall be handled by the relevant departments in accordance with the regulations.
Article 26 Funds for fighting fires shall be paid in accordance with the following provisions:
(1) The wages and travel expenses of state employees during their participation in fighting fires shall be paid by their respective units;
(2) The subsistence allowance for state employees during their participation in fighting fires, the allowance for loss of labor and subsistence allowance for non-state employees during their participation in fighting fires, and other expenses consumed during the period of fighting fires shall be paid in accordance with the provincial, autonomous regions and municipalities directly under the Central People's Government shall be paid by the unit responsible for the fire or the person responsible for the fire; where the cause of the fire is unclear, the unit that started the fire shall pay; and the portion of the expenses that the unit responsible for the fire, the person responsible for the fire, or the unit that started the fire determines that it is unable to pay, shall be paid by the people's government of the locality concerned.
Article 27 After the occurrence of a grassland fire, the local people's government concerned or the competent department of grassland fire prevention shall organize or work together with the public security and other relevant departments to investigate the time, place and cause of the fire, the perpetrator, the area of the grassland victimized, the type and number of livestock, the type and number of rare wild species, the situation of the fight, the consumption of materials, other economic losses, casualties and the impact of the ecological environment and production. and production of the impact of the investigation, etc., contained in the file.
The grassland fires listed in paragraph 2 (a) and (b) of Article 20 of these Regulations, as well as grassland fires that burned into settlements, burned down important facilities, or caused other major losses, the competent department of grassland fire prevention of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall establish a special archive and report it to the grassland fire prevention agency of the State Council's agriculture and animal husbandry department.
Article 28 After the occurrence of a grassland fire, the grassland fire prevention department of the relevant local people's government shall compile statistics in accordance with the following criteria for the division of grassland fires:
(1) Grassland fires: the victim grassland area of 100 hectares or less, and the direct economic loss of 10,000 yuan or less;
(2) General grassland fires: the victim grassland area of more than 100 hectares (b) General grassland fire: the affected grassland area is more than 100 hectares and less than 2,000 hectares, or the direct economic loss is more than 10,000 yuan and less than 50,000 yuan, or it causes serious injury to less than 10 persons, or it causes death to less than 3 persons, or it causes death and serious injury to less than 10 persons (of which the death of less than 3 persons is caused). million yuan or more than 500,000 yuan or less, or cause serious injuries to 10 or more than 20 people, or cause deaths of 3 or more than 10 people, or cause deaths and serious injuries in total of 10 or more than 20 people (of which more than 3 or more than 10 deaths are caused by the following);
(d) Extraordinary prairie fires: the affected prairie area of more than 8,000 hectares or a direct economic loss of more than 500,000 yuan. or cause serious injury to more than 20 people, or cause the death of more than 10 people, or cause the death and serious injury combined more than 20 people (of which cause the death of more than 10 people).
The term "above" in the preceding paragraph includes this number, and "below" does not include this number.
Article 29 The grassland fire prevention departments of the local people's governments at all levels shall, in accordance with the needs of grassland fire statistical reports, grassland fire statistics, reported to the next level of grassland fire prevention departments and the same level of the civic departments, statistical departments. Grassland fire statistical statements by the State Council department of agriculture and animal husbandry in conjunction with the public security department to develop, reported to the national statistical department for the record.
Chapter V Rewards and Penalties

(b) after the occurrence of grassland fires, and actively organizing the suppression, or (c) reporting grassland fires in a timely manner or taking timely measures to fight them to avoid causing major losses;
(d) stopping arson or reporting arson in a timely manner;
(e) contributing to the investigation of grassland fires;
(f) inventing and creating innovations in scientific research on grassland fire prevention;
(g) contributing to the investigation of grassland fires;
(h) contributing to the investigation of grassland fires;
(i) contributing to the scientific research on grassland fire prevention;
(j) contributing to the investigation of grassland fire prevention. Grassland fire scientific research in the invention;
(g) continuously engaged in grassland fire prevention work for more than 15 years, the work has made remarkable achievements.
Article 31 Anyone who has one of the following behaviors listed in (1) and (2) shall be ordered to rectify the situation, and may be given a warning or fined not less than RMB 10 yuan and not more than RMB 50 yuan; anyone who has one of the behaviors listed in (3), (4) and (5) shall be given a warning and fined not more than RMB 100 yuan; and anyone who has one of the behaviors listed in (6) and (7) may be fined not more than RMB 500 yuan, and anyone who causes damage may be fined not more than RMB 100 yuan; and anyone who has one of the behaviors listed in (6) and (7) may be fined not less than RMB 500 yuan. A fine of not more than 500 yuan, and shall be liable to pay compensation for any damage caused:
(I) During the period of prairie fire prevention, unauthorized entry into the prairie fire control area;
(II) During the period of prairie fire prevention, use of firearms in the prairie for hunting, smoking, and random use of fire, but without forming a fire hazard;
(III) Use of motorized vehicles and mechanical equipment in violation of the provisions of these regulations, which become a fire hazard;
(d) there is a grassland fire hazard, by the grassland fire prevention authorities notice still does not remove;
(e) refused or hindered the implementation of the grassland fire prevention authorities fire prevention inspections;
(f) destroying the destruction of fire prevention facilities and equipment;
(g) negligence caused the grassland fire, has not yet caused significant losses.
One of the acts listed in the preceding paragraph of the responsible person or in the grassland fire prevention work in dereliction of duty or disobedience to the fire-fighting command institutions, and may, depending on the circumstances, by their units or higher authorities to give administrative sanctions; constitutes a crime, shall be investigated for criminal responsibility.
Article 32 The administrative penalties provided for in Article 31 of these Regulations shall be decided by the competent department of grassland fire prevention of the people's governments at or above the county level, or by their authorized units.
The party concerned administrative penalty decision is not satisfied, may from the date of receipt of notice of the penalty decision within 15 days to the higher level of the authority that made the penalty decision to apply for reconsideration; the reconsideration decision is not satisfied, may from the date of receipt of the decision of the reconsideration of the people's court within 5 days; the party concerned may also directly to the people's court. The parties to the administrative penalty decision does not apply for reconsideration or to the people's court, and does not fulfill, the authority that issued the penalty decision may apply to the people's court for compulsory execution.
Chapter VI Supplementary Provisions
Article 33 The key grassland fire prevention areas referred to in these Regulations shall be delineated by the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government in accordance with the actual situation in the local area, and shall be reported to the State Council for the record in the agricultural and animal husbandry sector.
Article 34 These Regulations shall be interpreted by the State Council department of agriculture and animal husbandry.
Article 35 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Regulations, formulate measures for their implementation in the light of local conditions.
Article 36 These Regulations shall come into force on the date of publication.
