Any unit or individual engaged in the activities of electromagnetic radiation listed in the preceding paragraph, or activities accompanied by such electromagnetic radiation, must comply with the provisions of these measures. Article III of the people's governments at or above the county level, the competent administrative department of environmental protection to implement unified supervision and management of electromagnetic radiation environmental protection work under this jurisdiction. Article IV units engaged in electromagnetic radiation activities of the competent departments responsible for the system, the industry electromagnetic radiation environmental protection supervision and management work. Article 5 Any unit or individual has the right to report and complain about the violation of these management measures. Chapter II Supervision and Management Article 6 The competent administrative department for environmental protection under the State Council shall be responsible for the registration of environmental protection declaration and approval of environmental impact report for the following construction projects, and shall be responsible for the inspection of the implementation of environmental protection facilities and the main project at the same time as the design, construction, and put into operation (hereinafter referred to as the "three-simultaneity" system) for such projects. Inspection and responsible for the completion and acceptance of such projects:
(A) the total power of 200 kilowatts or more of the television transmission tower;
(B) the total power of 1,000 kilowatts or more of the broadcasting station, station;
(C) cross-provincial administrative regions of the electromagnetic radiation construction projects;
(D) the state limits of the above electromagnetic radiation construction projects. Article 7 Provinces, autonomous regions, municipalities directly under the Central Government (hereinafter referred to as "provincial"), the competent administrative department of environmental protection is responsible for in addition to the projects listed in Article 6, exemptions above the level of electromagnetic radiation construction projects and equipment for the registration of environmental protection declarations and approval of environmental impact reports; responsible for the implementation of environmental protection facilities for such projects and equipment. "The competent department for environmental protection under the State Council is responsible for the approval of environmental impact reports, the inspection of the implementation of the "three simultaneous" system of environmental protection facilities and the acceptance of the completion of such projects and equipment, as well as the impact on the environment after the completion of the projects. As well as the supervision and inspection of the environmental impact after the completion of the project; responsible for the construction of electromagnetic radiation environmental protection management team within the jurisdiction; responsible for the supervision and management and supervisory monitoring of the environmental impact caused by electromagnetic radiation activities within the jurisdiction. Article 8 The municipal environmental protection administrative department, according to the provincial environmental protection administrative department entrusted, may undertake all or part of the tasks listed in Article 7 and the supervisory monitoring and daily supervision and management of electromagnetic radiation projects and equipment within the jurisdiction. Article 9 The competent department of the unit engaged in electromagnetic radiation activities shall supervise its subordinate units to comply with the national environmental protection regulations and standards, strengthen the leadership of the electromagnetic radiation environmental protection of the units under its jurisdiction, and be responsible for the pre-trial of the environmental impact report (form) of the electromagnetic radiation construction projects and equipment. Article 10 Any unit or individual engaging in activities of electromagnetic radiation shall abide by and implement the national environmental protection policies, regulations, systems and standards, accept the supervision and management and inspection by the environmental protection department of its environmental protection work of electromagnetic radiation; do a good job in preventing and controlling the environmental pollution by electromagnetic radiation activities. Article 11 units and individuals engaged in electromagnetic radiation activities in the construction or use of "electromagnetic radiation construction projects and equipment list" (see Annex) listed in the electromagnetic radiation construction projects or equipment, must be in the construction project before applying for the establishment of the project or in the acquisition of equipment before, in accordance with the provisions of these measures, to the administrative department of environmental protection with the right to approve the environmental impact report (form) for environmental protection declaration and registration procedures.
After accepting the registration of environmental protection declaration, the competent administrative department for environmental protection with approval authority shall notify the units and individuals engaged in electromagnetic radiation activities of the written opinion of acceptance within 30 days, and copy the opinion of acceptance to the relevant competent department and the administrative department for environmental protection of the location of the project. Article 12 The competent administrative department for environmental protection with the power of approval shall, according to the urban development plan of the place where the declared electromagnetic radiation construction project is located, the scale of the electromagnetic radiation construction project and equipment as well as the requirements for environmental protection of the region in which it is located, make the following opinions on the registration of declaration of environmental protection:
(1) For the electromagnetic radiation construction project which is seriously polluted, backward in terms of technology and equipment, and which is seriously wasteful in terms of resources and ecological damage and equipment, prohibit the construction or acquisition;
(ii) for electromagnetic radiation construction projects that meet the requirements of the urban development plan and are above the exemption level, require the units or individuals engaged in electromagnetic radiation activities to fulfill the approval procedures of the environmental impact report;
(iii) for electromagnetic radiation equipment in the relevant industrial, scientific and medical applications, require the units or individuals engaged in electromagnetic radiation activities to (c) for electromagnetic radiation equipment in relevant industrial, scientific and medical applications, requiring units or individuals engaged in electromagnetic radiation activities to fulfill the approval procedures for the environmental impact statement. Article 13 The provincial-level administrative department of environmental protection is responsible for confirming the level of exemption for electromagnetic radiation construction projects and equipment in accordance with the provisions of the relevant national electromagnetic radiation protection standards. Article 14 Before the implementation of these Measures, electromagnetic radiation construction projects that have been completed or are under construction and have not yet fulfilled the registration procedures for declaration of environmental protection, or electromagnetic radiation equipment that has been purchased but has not yet fulfilled the registration procedures for declaration of environmental protection, and which are listed in the List of Electromagnetic Radiation Construction Projects and Equipment, must make up for the procedures for declaration of environmental protection and registration. Do not meet the environmental protection standards, serious pollution, to take remedial measures, difficult to remedy the closure or relocation in accordance with the law.
