Penalty for food without production date
1. Food operators selling bulk food shall indicate the name, production date or production batch number of the food on the containers and outer packaging of the bulk food. The shelf life and the name, address, contact information of the manufacturer and operator, etc.
2. Food producers and operators should take measures such as harmless treatment and destruction of recalled foods to prevent them from entering the market again. However, for foods that have been recalled because labels, signs or instructions do not meet food safety standards, food manufacturers can continue to sell them if they take remedial measures and can ensure food safety; the remedial measures should be clearly stated to consumers at the time of sale.
3. Food producers and operators should report the food recall and disposal status to the food safety supervision and management department of the local county-level people's government; if the recalled food needs to be harmlessly treated and destroyed, it should be reported in advance time, place. If the food safety supervision and administration department deems it necessary, on-site supervision may be implemented.
4. Illegal gains shall be confiscated; if the value of illegally produced and operated food is less than 10,000 yuan, a fine of not less than 2,000 yuan but not more than 50,000 yuan shall be imposed; if the value of the food exceeds 10,000 yuan, a fine of not less than 2,000 yuan but not more than 50,000 yuan shall be imposed; A fine of not less than two times but not more than five times the value of the goods will be imposed; if the circumstances are serious, the company will be ordered to suspend production and business, or even the license will be revoked.
