Chapter I General Principles

Article 1 ? In order to safeguard the lawful rights and interests of persons with disabilities, develop the cause of persons with disabilities, and ensure that persons with disabilities can participate fully in social life on an equal footing and ****enjoy the fruits of society's material and cultural achievements, this Law is enacted in accordance with the Constitution.

Article 2 ? Disabled persons are those who, in terms of psychology, physiology and human structure, have lost or are not normal in some organization or function, and who have lost, in whole or in part, the ability to engage in some activity in a normal way. Persons with disabilities include those with visual disability, hearing disability, speech disability, physical disability, intellectual disability, mental disability, multiple disabilities and other disabilities. Disability standards are set by the State Council.

Article 3 ? Persons with disabilities enjoy equal rights with other citizens in political, economic, cultural, social and family life. The civil rights and human dignity of the disabled are protected by law. Discrimination against, insult to, or infringement of persons with disabilities is prohibited.

Article 4 ? The State adopts auxiliary methods and supportive measures to give special assistance to the disabled, to mitigate or eliminate the effects of disability and external barriers, and to guarantee the realization of the rights of the disabled.

Article 5 ? The State and society shall provide special safeguards and give preferential treatment and pensions to disabled soldiers, persons disabled in the line of duty, and other persons disabled in the interests of the State and the people.

Article 6 ? People's governments at all levels shall incorporate the cause of the disabled into their national economic and social development plans, include funds in their financial budgets, plan in an integrated manner, strengthen their leadership, coordinate comprehensively, and take measures to harmonize the cause of the disabled with the economic and social development. The State Council and the people's governments of provinces, autonomous regions and municipalities directly under the Central Government take organizational measures to coordinate the work of the relevant departments in the cause of persons with disabilities. Specific organizations are prescribed by the State Council and the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. The relevant departments of the people's governments at all levels shall liaise closely with the disabled, listen to their views, and do a good job for the disabled in accordance with their respective responsibilities.

Article 7 ? Society as a whole shall carry forward the humanitarian spirit of socialism, understand, respect, care for and help the disabled, and support the cause of the disabled. Institutions, groups, enterprises and institutions, and urban and rural grass-roots organizations shall do a good job of working for the disabled within their respective spheres of competence. State employees and other persons engaged in work for the disabled shall perform their honorable duties and strive to serve the disabled.

Article 8 ? The China Disabled Persons' Federation and its local organizations represent the ****same interests of the disabled, safeguard the lawful rights and interests of the disabled, unite and educate the disabled, and serve the disabled. The Disabled Persons' Federation undertakes tasks entrusted to it by the government, carries out work for the disabled, and mobilizes social forces to develop the cause of the disabled.

Article 9 ? The legal supporter of a disabled person must fulfill the obligation of supporting the disabled person. The guardian of a person with disabilities must fulfill the duty of guardianship and safeguard the lawful rights and interests of the person under guardianship. Relatives and guardians of the disabled shall encourage and help the disabled to enhance their self-reliance. Abuse and abandonment of persons with disabilities are prohibited.

Article 10 ? Persons with disabilities must abide by the law, fulfill their due obligations, observe public **** order and respect social morality. Persons with disabilities shall carry forward the spirit of optimism and enterprise, self-respect, self-confidence, self-improvement and self-reliance, and contribute to the construction of socialism.

Article 11 ? The State carries out disability prevention work in a systematic manner, strengthens its leadership of disability prevention work, publicizes and popularizes the knowledge of eugenics and disability prevention, and, with regard to heredity, disease, drug intoxication, accidents, disasters, environmental pollution, and other disability-causing factors, formulates laws and regulations, organizes and mobilizes the forces of society, and adopts measures to prevent the occurrence and development of disability.

Article 12 ? Rewards shall be given by the government and relevant departments to disabled persons who have made remarkable achievements in socialist construction, and to units and individuals who have made remarkable achievements in safeguarding the lawful rights and interests of disabled persons, developing the cause of disabled persons, and providing services for disabled persons.

Chapter II Rehabilitation

Article 13 ? The State and society shall take rehabilitation measures to help persons with disabilities restore or compensate for their functions and enhance their ability to participate in social life.

Article 14 ? Rehabilitation work shall be carried out from a practical point of view, combining modern rehabilitation technology with China's traditional rehabilitation technology; with rehabilitation institutions as the backbone, community-based rehabilitation as the foundation, and the families of persons with disabilities as the basis; focusing on practical, easy-to-implement, and widely-beneficial elements of rehabilitation, as well as carrying out research on, and developing and applying, new rehabilitation technology, in order to provide effective rehabilitation services for persons with disabilities.

Article 15 ? The government and relevant departments have plans to set up rehabilitation medicine departments (rooms) in hospitals, and organize the necessary specialized rehabilitation institutions to carry out rehabilitation medical treatment and training, scientific research, personnel training and technical guidance. The people's governments at all levels and the relevant departments shall organize and guide urban and rural community service networks, medical and preventive health-care networks, organizations of persons with disabilities, families of persons with disabilities, and other social forces to carry out community rehabilitation work. Educational institutions for persons with disabilities, welfare enterprises and organizations, and other institutions serving persons with disabilities should create conditions for the development of rehabilitation training activities. Persons with disabilities, under the guidance of professionals and with the help of relevant staff members, voluntary workers and relatives, should endeavour to train in functioning, self-care and labour skills. The State Council and the departments concerned shall identify key rehabilitation projects in stages, formulate plans and organize efforts to implement them.

Article 16 ? Medical schools and other relevant institutions shall systematically offer rehabilitation courses, set up rehabilitation specialties, and train various types of rehabilitation professionals. The State and society shall take various forms of technical training for those engaged in rehabilitation work; and shall popularize knowledge of rehabilitation and teach rehabilitation methods to persons with disabilities, their relatives, and relevant staff and voluntary workers.

Article 17 ? The relevant government departments shall organize and support the development, production, supply and maintenance services of rehabilitation appliances, life self-help appliances, special goods and other assistive devices for the disabled.
