Provisions on the Administration of Imported Radio Transmitting Equipment

Article 1 In order to strengthen the administration of imported radio transmitting equipment, these Provisions are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Radio Administration and the Interim Measures for the Administration of Import of Mechanical and Electrical Products. Article 2 Imported radio transmitting equipment must abide by these provisions. Article 3 The radio transmitting equipment mentioned in these Provisions refers to radio communication, navigation, positioning, direction finding, radar, remote control, telemetry, broadcasting, television and other devices that emit radio waves, excluding industrial, scientific research, medical equipment, electrified transportation systems, high-voltage power lines and other electrical devices that can radiate electromagnetic waves. Article 4 All radio transmitting equipment exported to China must hold the Radio Transmitting Equipment Type Approval Certificate issued by the Office of the State Radio Regulatory Commission of China (hereinafter referred to as the Office of the State Radio Regulatory Commission), and the equipment must be marked with the radio transmitting equipment type approval code. Article 5 Procedures for the Type Approval Certificate of Radio Transmitting Equipment:

(1) Foreign manufacturers or their designated agents shall submit the Application Form for Model Approval of Radio Transmitting Equipment and the relevant technical performance and technical indicators of the applied radio transmitting equipment model to the State Non-commissioned Office.

(2) The national editorial office reviews the radio transmitting equipment of this model according to the national radio management regulations and technical standards, and the testing unit entrusted by the national editorial office tests the approved projects.

(3) For the equipment that has passed the examination, the office of CNCA will issue the type approval certificate and approval code of radio transmitting equipment. Article 6 Each model of radio transmitting equipment shall have a unique approval code. If the performance or main technical parameters of the approved equipment model are changed due to the adoption of new technology, the equipment model shall re-apply for the Type Approval Certificate of Radio Transmitting Equipment according to the provisions of Article 5. Article 7 The Office of CNCA regularly announces to the public the equipment that has approved and revoked the Type Approval Certificate of Radio Transmitting Equipment. Article 8 The import examination procedures for imported radio transmitting equipment shall be handled in accordance with the following procedures:

(1) Before the importer declares the Application Form for the Import of Mechanical and Electrical Products to the national, regional and departmental mechanical and electrical products import management agencies, it shall submit the application form and relevant technical materials to the national non-commissioned office or the office of the Radio Management Committee of a province, autonomous region or municipality directly under the Central Government and its entrusted institution (hereinafter referred to as the non-commissioned office) for examination. The national or local non-commissioned office shall sign the audit opinion on the equipment with the Type Approval Certificate of Radio Transmitting Equipment on the Application Form for Import of Mechanical and Electrical Products.

(II) When accepting the application for importing radio transmitting equipment, the national, regional and departmental machinery and electronic equipment import management agencies shall take the audit opinions compiled by the state or local authorities as the basis for handling the import procedures, and issue the Import Certificate of Mechanical and Electronic Products or the Import Registration Form of Mechanical and Electronic Products, before the importing entity can sign an import contract with foreign countries.

(3) According to the regulations of the Ministry of Foreign Trade and Economic Cooperation (hereinafter referred to as "MOFTEC") on undertaking and acting as an agent for import projects, importers must go through effective import project registration procedures at MOFTEC. The signed technology and equipment import contract shall come into effect after being submitted to MOFTEC and its authorized departments for examination and approval.

(4) Where the government of the exporting country of radio transmitting equipment requests the China government to issue a description of the end user and end use, the importing entity shall go through the formalities with the MOFTEC in accordance with the relevant provisions, and attach the Type Approval Certificate of Radio Transmitting Equipment consistent with the imported equipment.

(5) Before the equipment enters the customs, the importer should fill in the Radio Equipment Entry Declaration Form, attach the Import Certificate of Mechanical and Electrical Products or the Import Registration Form of Mechanical and Electrical Products, submit the import contract to the national or local office for examination and approval, and then issue the first copy of the Radio Equipment Entry Approval Document to the importer. The "Approval Document for Radio Equipment Entry Examination" issued by the local non-commissioned office was submitted to the national non-commissioned office for the record.

(6) The Customs shall release the products in advance according to the Import Certificate of Mechanical and Electrical Products or the Import Registration Form of Mechanical and Electrical Products and the Approval Letter for Entry Examination of Radio Equipment. Equipment that arrives in batches shall be written off in turn. Article 9 After the customs release, the importer shall send a certain proportion of imported equipment to the inspection-free office of the State or the inspection-free office of provinces, autonomous regions and municipalities directly under the Central Government for inspection within 1 month. The equipment is too big to be sent for inspection. On-site inspection can be carried out, or the inspection reports of foreign inspection agencies provided by manufacturers can be approved by the non-commissioned bureau that handles import examination and approval. Unqualified equipment shall be handled according to the relevant national import management regulations. Article 10 The authority to handle the import examination of radio transmitting equipment and issue the Approval Document for the Entry Examination of Radio Equipment is as follows:

(1) The central state organs (including directly affiliated units) and their approved Chinese-foreign contractual joint ventures, Chinese-foreign equity joint ventures and foreign-funded enterprises, as well as national or inter-provincial enterprise groups and companies are responsible for importing radio transmitting equipment. The above-mentioned units located outside Beijing may also be handled by local provinces, autonomous regions and municipalities directly under the Central Government.

(2) The import of radio transmitting equipment by local units, Chinese-foreign contractual joint ventures, Chinese-foreign equity joint ventures and foreign-funded enterprises established with the approval of local governments shall be handled by the overseas offices of the local people's governments of provinces, autonomous regions and municipalities directly under the Central Government or their authorized institutions.
