Difference between medical liability accident and medical technical accident

Legal analysis: Liability accident refers to the accident caused by medical staff's dereliction of duty such as violation of rules and regulations and routine diagnosis and treatment; Technical accident refers to the accident caused by technical negligence of medical staff. "Medical technical accidents" generally occur because of the limited ability or lack of experience of medical staff. Therefore, any medical personnel who make mistakes in diagnosis, treatment and nursing due to their own professional level and the limitations of medical technology, equipment and conditions, resulting in death, disability, tissue and organ damage and dysfunction of patients, should be considered as a medical technical accident.

Legal basis: Article 2 of the Regulations on Handling Medical Accidents The medical accidents mentioned in these regulations refer to accidents in which medical institutions and their medical staff violate laws, administrative regulations, departmental rules, medical care norms and practices in medical activities and cause personal injury to patients due to negligence.
