Relevant provisions on the application of sealing and freezing measures by public security organs in handling criminal cases

The People's Court shall not seal up, detain or freeze the following property of the person subject to execution:

1. Clothing, furniture, cooking utensils, etc. necessary for the life of the person subject to execution and his dependent family members. Tableware and other items necessary for family life

2. Necessary living expenses for the person subject to execution and his dependent family members. If there is a local minimum living security standard, the necessary living expenses shall be determined in accordance with the standard. 3. Items necessary for the person subject to execution and his dependent family members to complete compulsory education.

4. Undisclosed inventions or unpublished works

5. Auxiliary tools and medical items necessary for the person subject to execution and his dependent family members to deal with physical defects

6. Medals and other honorary commendations received by persons subject to execution

The public security organs have the right to seize accounts or property when units or individuals are suspected of committing crimes.

During case investigation, the public security organs shall seal up and detain all kinds of property and documents found that can be used to prove the guilt or innocence of the criminal suspect. Freeze the deposits, remittances, bonds, stocks, fund shares and other properties of criminal suspects related to the case.

The regulations on sealing, detaining and freezing by security organs are as follows:

1. Based on the needs of investigating crimes, public security organs may seal, detain and freeze the land, houses and other real estate involved in the case in accordance with the law. As well as specific movable properties such as vehicles, ships, aircraft and large machinery and equipment involved in the case. When necessary, legal documents and documents proving property ownership or related rights and interests may be seized together;

2. Facilities, furniture and other related items placed on real estate that need to be used as evidence shall be seized ; If it is not suitable to be moved, it can be seized together;

3. If the seizure of property involved requires assistance from relevant departments such as land and resources, real estate management, transportation, agriculture, forestry, and civil aviation, it shall be approved by the public security agency at or above the county level. The person in charge approves, prepares a seal decision and a notice of assistance in sealing, clarifies the situation of the seized property, the method of seizure, the period of seizure and other matters, sends it to the relevant departments for assistance, and promptly informs the relevant parties;

4. Case involved If the area or amount of land or houses is relatively large, the person in charge of the public security organ at or above the districted city level must obtain approval to prepare a seal decision and a notice of assistance in sealing.
