The municipal infrastructure projects referred to in these measures, refers to urban roads, bridges and tunnels (including urban planning area through the mountains and tunnels, subway tunnels, underground traffic engineering, underground street crossings), rail transit, public **** transportation, water supply, drainage, gas, heat, gardening, landscaping, lighting, sanitation, sewage treatment, waste disposal, flood control, underground public **** facility and ancillary facilities of civil construction, piping, equipment installation works. Article IV of housing and municipal engineering project bidding activities should follow the open, fair, just and honest principle.
Encourage the implementation of electronic bidding and electronic contract filing system for housing and municipal engineering projects.
People's governments at or above the county level shall encourage and support the use of information networks for electronic bidding. Article 5 the provincial people's government department in charge of housing and urban-rural construction is responsible for the supervision and management of the province's housing and municipal engineering project bidding activities.
Municipal (state), county (city) people's government housing and urban-rural construction department is responsible for the supervision and management of the bidding activities of housing and municipal engineering projects within the administrative area. Article 6 according to law must be bidding housing and municipal engineering projects, shall enter the bidding and tendering trading place for bidding and tendering. Chapter II Tendering and Bidding Article 7 The bidder has the conditions for bidding prescribed by the state, may tender on its own; does not have the conditions for bidding prescribed by the state, shall entrust the bidding agent to tender. Projects that must be tendered according to law, the bidder to tender on its own or entrusted bidding, shall provide relevant documents for the record to the competent department of housing and urban-rural construction of the people's government at or above the county level where the project is located. Article 8 The following housing and municipal engineering project investigation, design, construction, supervision, and procurement of equipment and materials related to it, must be tendered:
(a) the relationship between the social public *** interests, public safety infrastructure, public utilities projects;
(b) the use of state-owned funds for investment or state-financed projects;
(c) the use of international organizations or foreign government loans, aid funds. organizations or foreign government loans, assistance funds for the project.
The scope and scale standards of specific engineering and construction projects listed in the preceding paragraph which must be tendered by law shall be implemented in accordance with relevant state regulations.
Relating to national security, state secrets, disaster relief projects, shall be implemented in accordance with relevant state regulations. Article IX public tendering of housing and municipal engineering projects, the bidder shall issue a tender notice, preparation of tender documents.
The bidder adopts pre-qualification method of potential bidders for qualification examination, shall issue pre-qualification announcement, preparation of pre-qualification documents.
The preparation of bidding documents and pre-qualification documents for housing and municipal engineering projects which must be tendered in accordance with law shall use the standard text (including electronic text) formulated by the competent department of housing and urban-rural construction of the provincial people's government. Article 10 The pre-qualification announcement and bidding announcement for housing and municipal engineering projects which must be publicly tendered in accordance with the law shall be published in the media designated by the development and reform department of the provincial people's government, and the scope of publication shall not be narrowed without authorization. The contents of the pre-qualification announcement or bidding announcement of the same bidding project published in different media shall be consistent. No fee shall be charged for the publication of the pre-qualification announcement and the bidding announcement by the designated media. Article 11 public tendering of housing and municipal engineering projects pre-qualification, shall be carried out in accordance with the standards and methods set out in the pre-qualification documents.
The bidder shall form a qualification examination committee to examine the pre-qualification application documents for housing and municipal engineering projects for which tendering is required by law. After the conclusion of pre-qualification, the bidder shall promptly issue to the pre-qualification applicants pre-qualification results notice. If less than three applicants pass the pre-qualification, the bidding shall be re-tendered. An applicant that fails to pass the pre-qualification is not qualified to tender. Article 12 Where a bidder adopts a post-qualification examination method for qualification examination of bidders, the bidding shall be examined by the bid evaluation committee after the opening of the bids in accordance with the standards and methods stipulated in the bidding documents, and the bid shall be invalidated if it fails to comply with the provisions of the bidding documents after the qualification examination. Article 13 encourages the bidder to adopt the construction general contracting method for housing and municipal engineering projects. Article 14 prohibits a bidder from restricting or excluding potential bidders or tenderers by unreasonable conditions. Article 15 Where a bidding project requires a bidder to possess a number of qualification conditions at the same time, the bidder shall allow the bidder to bid by way of a consortium. For bidders to use higher than the bidding documents require enterprise qualification level and project manager in the evaluation of the bidding will not be added points.
