Article 2 These Measures shall apply to elevator production (including manufacturing, installation, transformation and repair), sales, procurement, bidding, use, maintenance, inspection and testing, scrapping and updating, and supervision and management activities within the administrative area of ??this city.

Except elevators that do not affect public safety and are only used by a single family. Article 3 The Municipal Special Equipment Safety Supervision and Management Department is the administrative department responsible for the supervision and management of elevator safety in this Municipality and is responsible for the organization and implementation of these Measures.

County (city, district) special equipment safety supervision and management departments are responsible for the safety supervision and management of elevators within their respective administrative regions.

Relevant government departments shall do a good job in elevator safety supervision and management in accordance with their respective responsibilities. Article 4 The government supports the promotion of the use of advanced elevator management models and Internet of Things technology; encourages the purchase of elevator safety liability insurance.

The Elevator Industry Association should conduct statistical analysis on the safety and quality status of elevators to promote orderly competition and standardized operations in the industry. Chapter 2 Production and Sales Article 5 Elevator manufacturing units shall manufacture elevators in accordance with relevant laws, regulations, and safety technical specifications, and shall be responsible for the quality of the elevators they manufacture and the quality issues involved in their safe operation. Article 6 Elevator manufacturing units shall provide the following technical guidance and services to elevator user managers:

(1) Directly carry out daily maintenance of elevators, and conduct quality supervision and professional maintenance of the maintenance units entrusted by them Technical training;

(2) Provide vulnerable parts of the same quality and price, and disclose maintenance prices;

(3) Regularly develop professional skills in elevator use management and emergency rescue training. Article 7 Elevator sellers shall establish an elevator purchase inspection and acceptance system and sales ledger. The following elevators and related products are not allowed to be sold:

(1) Without accompanying design documents, product quality inspection certificates, installation, use and maintenance instructions, supervision and inspection certificates and other documents that meet the requirements of safety technical specifications;

(2) The state has explicitly ordered them to be eliminated and scrapped;

(3) Parts and components passed off as genuine, substandard or old as new;

< p>(4) Elevators produced by units without manufacturing licenses and elevators assembled by non-elevator manufacturing units;

(5) Other elevators and related products prohibited from sale by laws and regulations. Article 8 If an elevator needs to be repaired, replaced or returned due to product quality defects and causes personal injury or property damage, the elevator user manager may request free repair, replacement, return and compensation from the manufacturing unit or seller. Article 9 Construction units engaged in elevator installation, modification, and repair shall notify the municipal special equipment supervision and management department in writing of the proposed elevator installation, modification, and repair before construction, and apply for supervision and inspection from the elevator inspection and testing agency.

Elevators that have not passed the supervision and inspection shall not be delivered for use. Article 10 Only after the elevator installation, modification, and repair units have passed the supervision and inspection after the elevator installation, modification, and repair, and after the construction project has been uniformly completed and accepted, can the safety technical files and "Elevator Usage Signs" and other materials be handed over to the elevator for use. Article 11 Elevator modifications shall be carried out by the original manufacturing unit or a modification unit with corresponding qualifications entrusted and approved by it.

If the original manufacturing unit has been canceled or cannot obtain the entrustment or consent of the original manufacturing unit, the transformation unit with corresponding qualifications shall carry out the transformation after obtaining the consent of the elevator ownership unit. The elevator modification unit shall issue a modification certificate, replace the elevator nameplate, conduct verification and debugging of the elevator, and assume the relevant responsibilities and obligations of the original elevator manufacturing unit. Chapter 3 Procurement and Bidding Article 12 If fiscal funds are used to purchase elevators, they shall be implemented in accordance with relevant government procurement regulations.

Tendering and procurement of elevators should be the main method of government procurement. Encourage non-financial funds to purchase elevators through bidding. Article 13 The construction unit shall fully evaluate the frequency of use, use environment and other factors of the pre-installed elevator, select and configure the elevator in accordance with the requirements of the design specifications, and combine the elevator manufacturing unit’s qualifications, after-sales service capabilities, market response, and special equipment safety supervision The safety and quality status of elevators announced by the management department, as well as their product performance and quality assurance commitments, etc., are used as competitive conditions for elevator procurement and bidding.

Article 14 The special equipment safety supervision and management department shall establish a tracking and processing mechanism for the quality and safety status of elevators, and work with relevant departments to pursue the bidders whose quality and safety status of elevator products and parts does not meet the contract or tender document commitments. responsibility, and establish a product quality credit reputation release system. Article 15: The development and reform administrative departments shall, in accordance with relevant regulations, establish review and credit records for experts selected from the expert database and implement a responsibility review mechanism. Chapter 4 Usage Management Article 16 Elevator usage managers refer to units or individuals with elevator management rights and obligations.

The elevator user manager is determined in the following manner:

(1) If the newly installed elevator has not been handed over to the owner, the project construction unit shall be the elevator user manager;

(2) If a property service enterprise or other unit is entrusted with management, the entrusted property service enterprise or other unit shall be the elevator user manager;

(3) If the property service enterprise or other unit is not entrusted with management, the elevator shall be If there is a single owner, the owner is the elevator user manager. If *** has property rights, the owner shall determine the elevator user manager through a written agreement;

(4) When leasing a place equipped with an elevator, the elevator user manager shall be agreed upon in the lease contract. If there is no agreement, refer to item (3). Elevators that are not clearly designated by the user manager shall not be put into use.
