Article 1 In order to strengthen the safety management of compressed natural gas vehicles and compressed natural gas vehicle filling stations, and ensure public safety, these Measures are formulated in accordance with the Regulations of the State Council on Safety Management of Hazardous Chemicals, the Regulations on Safety Supervision of Special Equipment and the Regulations of Chongqing Municipality on Natural Gas Management, combined with the actual situation of this Municipality.
Article 2 These Measures shall apply to the modification and maintenance of compressed natural gas vehicles, the use of gas cylinders, the construction and operation of compressed natural gas vehicle filling stations and related safety supervision and management activities within the administrative area of this Municipality.
Article 3 The safety supervision and management of compressed natural gas vehicles and compressed natural gas vehicle filling stations shall follow the principle of safety first and prevention first.
Article 4 The Municipal Leading Group for the Promotion and Application of Natural Gas Vehicles is a comprehensive coordinating body for the development of compressed natural gas vehicles and compressed natural gas vehicle filling stations, and is responsible for the comprehensive coordination, guidance and supervision of the development of the industry of compressed natural gas vehicles and compressed natural gas vehicle filling stations in the city.
The municipal administrative department of natural gas shall be responsible for the fixed-point approval, supervision and management of compressed natural gas automobile filling stations according to the layout of natural gas pipeline network and the special planning of compressed natural gas automobile filling stations. The district/county (autonomous county) natural gas administrative department is responsible for the daily supervision and management of compressed natural gas automobile filling stations.
The municipal hazardous chemicals management department is responsible for the hazardous chemicals business license of compressed natural gas automobile filling stations.
The municipal quality and technical supervision department is responsible for the cylinder filling license of compressed natural gas automobile filling stations, and supervises and manages the special equipment for compressed natural gas automobile filling stations. The quality and technical supervision departments of counties (autonomous counties) are responsible for the registration of the use of compressed natural gas cylinders for refitting and finished vehicles, and are responsible for the daily supervision and management.
The county (autonomous county) road transport management institution is responsible for the administrative license for the modification and maintenance of compressed natural gas vehicles, and is responsible for the daily supervision and management of the modification and maintenance enterprises. The municipal road transport management institution shall strengthen the guidance and supervision of the road transport management institutions of counties (autonomous counties) in implementing the modification and maintenance, administrative licensing and daily supervision of compressed natural gas vehicles.
The public security traffic management department is responsible for the record of refitting compressed natural gas vehicles.
Science and technology, construction, public security and fire control, production safety supervision and management, environmental protection and other relevant administrative departments. Should be in accordance with their respective responsibilities, cooperate to do a good job in the safety supervision and management of compressed natural gas vehicles and compressed natural gas vehicle filling stations.
Article 5 The municipal natural gas administrative department shall, in accordance with the overall urban planning and the principle of ensuring safety, work out a special plan for the development of compressed natural gas automobile filling stations in conjunction with the municipal planning, hazardous chemicals management, public security and fire control, construction and other departments, and implement it after being approved by the Municipal People's Government.
Article 6 The Municipal People's Government shall set up a special fund for the safety management technology of compressed natural gas vehicles to support the research and development of safety equipment and key technologies related to compressed natural gas vehicles and compressed natural gas vehicle filling stations.
Measures for the use of special funds for compressed natural gas vehicle safety management science and technology shall be formulated separately by the municipal finance department in conjunction with relevant departments such as science and technology. Article 7 The principles of unified planning, rational layout, co-construction of oil and gas and ensuring safety shall be followed in the construction of compressed natural gas automobile filling stations.
Article 8 To apply for the construction of compressed natural gas automobile filling stations, the applicant shall submit a fixed-point application to the municipal natural gas administrative department with relevant application materials. The municipal natural gas administrative department shall make a decision on whether to approve or not within 20 days from the date of accepting the application. If it meets the requirements, it shall be approved and the applicant shall be notified in writing; Do not meet the conditions, shall not be approved, and explain the reasons in writing.
The conditions and procedures for the fixed-point examination and approval of compressed natural gas automobile filling stations shall be formulated separately by the municipal natural gas administrative department in accordance with relevant laws, regulations and technical specifications, and shall be published after examination and registration in accordance with the procedures for examination and registration of normative documents.
Article 9 Compressed natural gas automobile filling stations shall be designed, constructed and installed by qualified design, construction and installation units in accordance with relevant national technical standards, and relevant procedures shall be handled in accordance with capital construction procedures.
Article 10 After the completion of the construction project of compressed natural gas automobile filling station, the municipal departments of natural gas, planning, quality and technical supervision, public security and fire protection, environmental protection, construction and other relevant departments shall organize the acceptance in accordance with the relevant provisions of the state, and handle the gas cylinder filling license and hazardous chemicals business license according to law.
Article 11 The production and operation activities of compressed natural gas automobile filling stations shall meet the following requirements:
(a) the quality of the gas produced meets the national mandatory standards;
(2) Having sound safety production and operation rules and regulations;
(3) Having corresponding safety measures and emergency rescue plans;
(four) the main person in charge, safety production management personnel, special equipment operators in accordance with the relevant provisions of the state assessment;
(five) equipped with measuring instruments that meet the requirements of the state.
Article 12 The owner or manager of compressed natural gas vehicles shall register the use of gas cylinders in accordance with the relevant provisions of this Municipality, and obtain the "Chongqing Vehicle CNG Gas Cylinder Use Registration Certificate"; If the cylinder passes the regular inspection, it will get the "Chongqing CNG cylinder inspection mark".
Compressed natural gas vehicle filling stations that have not obtained the Chongqing Vehicle Compressed Natural Gas Cylinder Use Registration Certificate and the Chongqing Vehicle Compressed Natural Gas Cylinder Inspection Qualification Mark shall not be used for filling compressed natural gas vehicles.
Thirteenth compressed natural gas automobile filling stations shall put forward maintenance arrangements within the time limit prescribed by the municipal natural gas administrative department. After the comprehensive balance of the municipal natural gas administrative department, the annual maintenance plan of the city's compressed natural gas automobile filling stations shall be formulated and announced 30 days in advance.
Fourteenth compressed natural gas automobile filling stations shall not terminate production and business activities without authorization.
If the production and business activities are terminated with the approval of the original examination and approval authority, it shall properly handle the safety issues related to the aftermath and handle the cancellation procedures of the enterprise.
If the compressed natural gas automobile filling station needs to temporarily stop production and business activities within 6 months, it shall be reported to the original examination and approval authority for the record. Safety management of automobile modification and maintenance
Article 15 Where an applicant is engaged in the modification and maintenance of compressed natural gas vehicles, he shall apply to the road transport management institution of the district/county (autonomous county) where he is located, and issue a license for modification (maintenance) of compressed natural gas vehicles according to law after passing the examination by the road transport management institution of the district/county (autonomous county) where he is located.
The licensing conditions and procedures for the modification and maintenance of compressed natural gas vehicles shall be formulated separately by the municipal road transport management institution in accordance with relevant laws, regulations and technical specifications, and shall be published after examination and registration in accordance with the procedures for examination and registration of normative documents.
Sixteenth compressed natural gas vehicle modification and maintenance system.
Article 17 The quality of the special devices for compressed natural gas vehicles used by the refitting and maintenance enterprises of compressed natural gas vehicles shall meet the corresponding national, local or industrial standards.
Eighteenth compressed natural gas vehicle modification and maintenance enterprises shall, in accordance with the relevant national or local standards, inspect the modified compressed natural gas vehicles, and issue a certificate of completion of modification and maintenance after passing the inspection.
Article 19 Enterprises engaged in refitting and repairing compressed natural gas vehicles shall establish archives for refitting and repairing compressed natural gas vehicles and file them one by one for future reference.
Twentieth compressed natural gas vehicles should be regularly maintained in accordance with the relevant provisions of the state.
Twenty-first municipal quality and technical supervision departments shall, in accordance with the relevant provisions of the state, regularly inspect or inspect the pressure vessels, pressure pipelines, relevant safety accessories, measuring instruments and gas quality of compressed natural gas vehicles and compressed natural gas vehicle filling stations.
Twenty-second modified compressed natural gas vehicles, vehicle owners or managers should be filed with the public security traffic management department.
Twenty-third compressed natural gas vehicles and compressed natural gas vehicle filling stations shall not use cylinders that have not been inspected by statutory inspection agencies, overdue inspection or have been scrapped.
Twenty-fourth compressed natural gas vehicles to replace gas cylinders, vehicle owners or managers shall register with the quality and technical supervision departments of counties (autonomous counties). Legal liability
Twenty-fifth in violation of the provisions of the first paragraph of Article 8 of these measures, the construction of compressed natural gas automobile filling stations without fixed-point approval shall be punished by the municipal natural gas administrative department in accordance with the relevant provisions of the Regulations of Chongqing Municipality on Natural Gas Management.
Twenty-sixth in violation of the provisions of Article 9 of these measures, the compressed natural gas automobile filling station is not designed, constructed and installed by a qualified design, construction and installation unit in accordance with the relevant national technical standards, and shall not be put into use, and the relevant administrative departments shall not accept it.
Article 27 Whoever, in violation of the provisions of Article 10 of these measures, fails to organize the acceptance and put into use of the construction project of compressed natural gas automobile filling station in accordance with the relevant provisions of the state, or engages in production and business activities without obtaining the gas cylinder filling license and hazardous chemicals business license according to law, shall be dealt with by the relevant administrative departments according to law.
Article 28 In violation of the provisions of Items (1) and (5) of Article 11 of these Measures, the quality of gas produced by compressed natural gas automobile filling stations does not meet the mandatory national standards or is not equipped with measuring instruments that meet the requirements of the state, the quality and technical supervision department shall handle it according to law.
In violation of the provisions of Item (2) and Item (3) of Article 11 of these Measures, if the compressed natural gas automobile filling station does not meet the requirements of relevant safety production and business activities, the natural gas administrative department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of more than 5000 yuan 10000 yuan shall be imposed.
If the main person in charge, safety production management personnel and special equipment operators of compressed natural gas automobile filling stations violate the provisions of Item (4) of Article 11 of these measures, they shall be dealt with by the safety production supervision and management department or the quality and technical supervision department in accordance with the division of responsibilities.
Article 29 In violation of the provisions of the second paragraph of Article 12 of these Measures, if the CNG vehicle filling station is a CNG vehicle without the Chongqing Vehicle CNG Cylinder Use Registration Certificate and the Chongqing Vehicle CNG Cylinder Inspection Certificate, the quality and technical supervision department shall order it to make corrections and impose a fine of 1 10,000 yuan to 30,000 yuan.
Thirtieth in violation of the provisions of the first paragraph of Article 14 of these measures, the compressed natural gas automobile filling station terminates its production and business activities without authorization, and the original examination and approval authority shall order it to resume its production and business activities within a time limit and impose a fine of not less than 20,000 yuan but not more than 30,000 yuan.
In violation of the provisions of the second paragraph of Article 14 of these measures, the compressed natural gas automobile filling station is approved to terminate its production and business activities, but fails to properly handle the aftermath safety matters or fails to handle the cancellation procedures of the enterprise, the relevant administrative department shall order it to make corrections within a time limit and punish it according to law; Those who cause economic losses to others shall be liable for compensation according to law.
Thirty-first compressed natural gas vehicle modification and maintenance enterprises have one of the following acts, and the road transport management institution at or above the county level shall order it to make corrections; If no correction is made within the time limit, a fine of more than 20000 yuan and less than 30000 yuan shall be imposed:
(a) engaged in the modification and maintenance of compressed natural gas vehicles without permission;
(2) Working beyond the scope;
(3) Setting up an office in a different place without permission;
(4) Failing to issue a certificate of completion of refitting and maintenance of compressed natural gas vehicles or issuing a false certificate of completion of refitting and maintenance;
(five) did not establish a compressed natural gas vehicle modification and maintenance files.
Thirty-second any of the following acts shall be dealt with by the quality and technical supervision department according to law:
(a) the use of cylinders that have not been inspected by a statutory inspection agency, have not been inspected within the time limit or have been scrapped;
(two) the replacement of gas cylinders is not registered. supplementary terms
Article 33 These Measures shall come into force as of July 6, 2008.
