The main contents of supervision and management are as follows:
Twentieth construction administrative departments of the people's governments at or above the county level and other relevant departments shall strengthen the supervision and management of the qualifications of engineering supervision enterprises.
It is forbidden for any department to take other credit, license and other construction market access restrictions other than those stipulated by laws and administrative regulations.
Twenty-first construction administrative departments shall implement the annual inspection system for the qualifications of engineering supervision enterprises.
Grade a engineering supervision enterprise qualification, by the the State Council municipal construction administrative department is responsible for the annual inspection; Among them, railway, transportation, water conservancy, information industry, civil aviation and other engineering supervision enterprise qualifications. Jointly inspected by the administrative department of construction in the State Council and relevant departments in the State Council.
The qualification of Grade B and Grade C engineering supervision enterprises shall be examined by the construction administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government where the enterprises are registered; Among them, the qualifications of engineering supervision enterprises in transportation, water conservancy, communications and other aspects shall be jointly inspected by the construction administrative department in conjunction with the relevant departments at the same level.
Twenty-second engineering supervision enterprise qualification inspection in accordance with the following procedures:
(a) the engineering supervision enterprise shall submit the annual inspection form of the qualification of the engineering supervision enterprise, the qualification certificate of the engineering supervision enterprise, the supervision business manual, the change of the engineering supervision personnel and other related materials to the construction administrative department within the specified time, and submit the business license of the enterprise as a legal person.
(II) The construction administrative department shall, jointly with the relevant departments, make a conclusion on the annual inspection of the qualification of the engineering supervision enterprise within 40 days after receiving the annual inspection data of the engineering supervision enterprise, and record it in the annual inspection record column of the copy of the Qualification Certificate of the Engineering Supervision Enterprise.
Article 23 The content of the annual qualification inspection of engineering supervision enterprises is to check whether the qualification conditions of engineering supervision enterprises meet the qualification grade standards, and whether there are violations of laws and regulations in terms of quality and market behavior.
The annual inspection conclusions of engineering supervision enterprises are divided into three types: qualified, basically qualified and unqualified.
Twenty-fourth engineering supervision enterprise qualification standards, and in the past year did not occur in the provisions of article sixteenth of the act, the annual inspection conclusion is qualified.
Article 25 If the registered number and business scale of supervision engineers in the qualification conditions of engineering supervision enterprises do not meet the qualification standards, but not less than 80% of the qualification grade standards, and all other items meet the standard requirements, and the acts listed in Article 16 of these Provisions have not occurred in the last year, the annual inspection conclusion is basically qualified.
Twenty-sixth in any of the following circumstances, the quality inspection conclusion of the engineering supervision enterprise is unqualified:
(a) any one of the registered number and business scale of the supervision engineer in the qualification conditions fails to reach 80% of the qualification grade standard, or any other one fails to reach the qualification grade standard;
(two) one of the acts listed in Article sixteenth of these Provisions.
In accordance with the provisions of laws and regulations by lowering the level of qualification punishment, in the annual inspection will not be repeated.
Twenty-seventh engineering supervision enterprise qualification annual inspection unqualified or basically qualified for two consecutive years, the construction administrative department shall re-verify its qualification grade. The newly approved qualification grade shall be lower than the original qualification grade, and if it fails to meet the minimum qualification grade standard, the qualification shall be cancelled.
Twenty-eighth engineering supervision enterprises can apply for promotion to the first level qualification only after passing the annual inspection for two consecutive years.
Twenty-ninth degraded engineering supervision enterprises, after more than one year of rectification, after verification and confirmation by the construction administrative department, have reached the prescribed qualification standards, and no acts listed in Article 16 of these Provisions have occurred during this period, they can re-apply for the original qualification level in accordance with these Provisions.
Thirtieth engineering supervision enterprises that fail to participate in the annual inspection of qualifications within the specified time shall automatically lose their qualification certificates and shall not re-apply for qualifications within one year.
Article 31 If an engineering supervision enterprise loses its qualification certificate, it shall declare it invalid in the public media. Among them, Grade-A supervision enterprises were declared invalid on the information network of China engineering construction and construction industry.
Thirty-second engineering supervision enterprises to change the name, address, legal representative, technical director, etc. , should be within one month after the change, to the original qualification examination and approval department for change procedures. For an enterprise approved by the construction administrative department of the State Council, except for the change of enterprise name, the change of enterprise address, legal representative and technical director is entrusted to the construction administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government, and the results are filed with the construction administrative department of the State Council.
