The Regulations on the Management of Domestic Waste in Jiangxi Province have been adopted by the Standing Committee of the Thirteenth People's Congress of Jiangxi Province at its Thirty-first Session on July 28, 2021, and are hereby promulgated and shall come into force on March 1, 2022.

Chapter I General Provisions

Article 1 In order to strengthen the management of domestic wastes, to improve urban and rural habitat, to protect the public's health, to promote the construction of ecological civilization, and to promote the sustainable development of economy and society, and in accordance with the provisions of the Chinese Constitution of the PRC, the government shall implement the following measures Sustainable economic and social development, according to the "Chinese People's Republic of China *** and the State Solid Waste Pollution Prevention and Control Law" "Chinese People's Republic of China *** and the State Circular Economy Promotion Law" and the State Council "Urban Amenities and Environmental Hygiene Management Regulations" and other laws and administrative regulations, combined with the actual situation in this province, the formulation of these regulations.

Article 2 These Regulations shall apply to the management activities of domestic garbage in the administrative area of this province.

Article 3 The province to implement the classification system of household garbage. Domestic garbage in accordance with national standards are divided into: recyclables, hazardous waste, food waste and other garbage. Municipal people's governments in the districts should be combined with the actual local specific classification catalog or refinement of the classification categories.

Article 4 The management of domestic waste should follow the government to promote the participation of all people, urban and rural integration, local management, local conditions, simple and easy to implement the principle of reducing the source of domestic waste, the whole process of classification, resource utilization, harmless treatment.

Article 5 The people's governments at or above the county level shall incorporate the management of domestic garbage in the administrative area into the national economic and social development planning and ecological environmental protection planning at this level, establish a coordination mechanism for the classification of domestic garbage, and strengthen and coordinate the management of the classification of domestic garbage and the construction of the capacity of the financial budget of the required funds are included in the level.

Township (township) people's governments, street offices are responsible for the management of domestic garbage within the jurisdiction of the specific work, the village (neighborhood) committees to assist in carrying out the management of domestic garbage source reduction, classification and placement.

Article 6 The department in charge of housing and urban-rural construction of the provincial people's government is responsible for organizing, coordinating, guiding and supervising the management of domestic garbage in the province.

Cities and counties (cities and districts) with districts are responsible for organizing and implementing the management of domestic waste by the departments determined by the people's governments at their respective levels (hereinafter referred to as the domestic waste management departments).

The department in charge of ecological environment is responsible for the supervision and management of pollution prevention and control during the transportation and treatment of hazardous waste, as well as pollution prevention and control of domestic waste treatment enterprises.

Departments of the people's governments at or above the county level, such as agriculture and rural areas, development and reform, finance, natural resources, commerce, education, culture and tourism, health and hygiene, market supervision and management, industry and informationization, administration of organ affairs, transportation, science and technology, as well as postal administrations, shall, in accordance with their respective responsibilities, do a good job of work related to the management of domestic waste.

Article 7 The whole society shall respect the environmental sanitation staff and the fruits of their labor.

The people's governments at or above the county level and the relevant departments shall guarantee the labor remuneration and welfare of environmental sanitation staff, improve their working conditions, and safeguard their legitimate rights and interests.

Cities and counties (cities and districts) people's governments shall organize, guide and do a good job of environmental health staff health care and skills training, to ensure operational safety.

Article 8 advocate the whole society to practice low-carbon green lifestyle, and develop the habit of domestic waste classification. Units, families and individuals who produce domestic garbage shall fulfill their obligations to reduce and classify domestic garbage at source and bear the responsibility of domestic garbage producers in accordance with the law.

Living garbage producers shall pay the living garbage disposal fee. Domestic garbage disposal fee charges by the people's governments at or above the county level in accordance with the relevant provisions of the state to formulate.

Article 9 The people's governments at or above the county level shall promote the classification of household garbage placement, collection, transportation and disposal of carbon emission reduction, and promote the high-quality development of low-carbon economy.

Article 10 Encourage and support in the reduction, resource utilization, harmlessness of domestic waste, carry out research and development and scientific and technological innovation of new technologies, new processes, new materials, new equipment.
