Article 49 of the Law of the People's Republic of China on the Administration of Medicines prohibits the production and sale of inferior medicines. Article 76 An enterprise or other unit engaged in the production or sale of counterfeit drugs or the production or sale of substandard drugs under serious circumstances shall be prohibited from engaging in the production or operation of drugs within ten years for the persons directly in charge and other persons directly responsible. Raw and auxiliary materials, packaging materials, and production equipment used exclusively for the production of counterfeit or substandard drugs shall be confiscated. Article 77 Anyone who knows or should know that the drugs are counterfeit or substandard and provides them with transportation, storage or warehousing facilities shall have all the income from transportation, storage or warehousing confiscated and shall be subject to a fine of not less than fifty percent and not more than three times the amount of the illegal income; and if a crime is constituted, the person concerned shall be held criminally liable in accordance with the law. Article 81 Where a drug business enterprise or a medical institution has not violated the relevant provisions of the Drug Administration Law and these Regulations, and there is sufficient evidence to prove that it does not know that the drugs it sells or uses are counterfeit or substandard, it shall confiscate the counterfeit or substandard drugs and the illegal proceeds from the sale or use of such drugs; however, it may be exempted from other administrative penalties. Article 142 of the Criminal Law The Crime of Producing or Selling Inferior Drugs If the production or sale of inferior drugs causes serious harm to human health, the offender shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and a fine of not less than fifty percent but not more than two times the amount of the sales; if the consequences are particularly serious, the offender shall be sentenced to fixed-term imprisonment of not less than ten years but not more than life imprisonment, and a fine of not less than fifty percent but not more than two times the amount of the sales, or the confiscation of property.
