Chapter 1 General Provisions Article 1 In order to strengthen the protection and management of the cultural heritage of the Potala Palace, inherit and promote the excellent history and culture, in accordance with the "Cultural Relics Protection Law of the People's Republic of China" and other laws and regulations , this regulation is formulated based on the actual conditions of the autonomous region. Article 2 The Potala Palace cultural heritage referred to in these regulations refers to the Potala Palace and its expansion projects, the Jokhang Temple and Norbulingka, which are listed on the World Cultural Heritage List. Article 3 These regulations apply to protection management, capital construction, production and life, religious, cultural activities, sightseeing, scientific research, business services and other activities within the protection scope and construction control zone of the Potala Palace cultural heritage. Article 4 The protection and management of the cultural heritage of the Potala Palace should adhere to the principles of overall planning, protection first, rational utilization, and strengthened supervision to ensure the authenticity and integrity of its historical features and natural environment. Article 5 The People's Government of the Autonomous Region is responsible for organizing the preparation of the Potala Palace cultural heritage protection plan, and coordinating and solving major issues in the protection and management of the Potala Palace's cultural heritage.
The Lhasa Municipal People's Government should do a good job in the protection and management of the cultural heritage of the Potala Palace in accordance with the protection plan organized by the People's Government of the Autonomous Region.
The cultural relics administrative department of the autonomous region is the department in charge of the protection and management of the cultural heritage of the Potala Palace, and assumes supervision and management responsibilities in accordance with the law.
The cultural relics protection and management agency is responsible for the protection and management of the cultural heritage of the Potala Palace.
Culture, finance, development and reform, housing and urban-rural construction, land and resources, planning, environmental protection, industry and commerce, tourism, public security, folk religion, forestry, earthquake, meteorology, public security and fire protection and other departments, according to their respective Responsibilities: Fulfill the protection responsibilities related to the cultural heritage of the Potala Palace. Article 6 The People's Government of the Autonomous Region and the People's Government of Lhasa City shall incorporate the protection and management of the cultural heritage of the Potala Palace into the national economic and social development plan, and the required funds shall be guaranteed by the finance. Article 7 An expert consultation system shall be implemented for the protection of the cultural heritage of the Potala Palace. When formulating the Potala Palace cultural heritage protection plan, reviewing and approving construction projects related to the Potala Palace cultural heritage, and making decisions on other major matters related to the Potala Palace cultural heritage, expert opinions should be solicited. Article 8 The sources of funds for the protection, management and maintenance of the cultural heritage of the Potala Palace:
(1) Special funds of the state and the autonomous region;
(2) General public funds of the autonomous region and Lhasa City ***Budget funds;
(3) Business income;
(4) Social donations;
(5) Other legal income.
The funds for the protection, management and maintenance of the cultural heritage of the Potala Palace shall be earmarked for special use in accordance with the relevant provisions of national laws and regulations, and shall not be misappropriated or misappropriated by any unit or individual. Article 9: All units and individuals have the responsibility and obligation to protect the cultural heritage of the Potala Palace.
The cultural relics administrative department of the autonomous region will commend and reward units and individuals that have made outstanding achievements in the protection and management of the Potala Palace cultural heritage; units and individuals that have made outstanding contributions will be reported to the People's Government of the autonomous region for commendation. Chapter 2 Protection and Management Article 10 The People's Government of the Autonomous Region is responsible for organizing the preparation of the Potala Palace cultural heritage protection plan. The protection plan will be implemented after being reviewed and approved by the cultural relics administrative department of the State Council.
The cultural relics administrative department of the autonomous region and the Lhasa Municipal People's Government are responsible for the organization and implementation of the Potala Palace cultural heritage protection plan.
When the Lhasa Municipal People's Government formulates urban and rural planning, it should coordinate with the Potala Palace cultural heritage protection plan. Article 11 The management of the cultural heritage protection scope and construction control zone of the Potala Palace shall be implemented in accordance with the protection plan. The protection and management work within the protection scope shall be the specific responsibility of the cultural relics protection and management agency; the protection and management work within the construction control zone shall be jointly responsible by the cultural relics, housing and urban and rural development, land and resources, planning and other departments of the Lhasa Municipal People's Government.
The cultural relics protection and management agency shall set up permanent protection signs and boundary stakes in accordance with the announced protection scope and construction control zones to indicate the four boundaries, protection instructions, prohibited behaviors, etc.
Protection signs and boundary posts are maintained and managed by cultural relics protection and management agencies.
Article 12 The following behaviors are prohibited within the scope of protection:
(1) Carving, painting, and posting on cultural relics protection signs;
(2) Climbing, climbing over, and protecting cultural relics Facilities;
(3) Erecting and installing facilities and equipment unrelated to the protection of cultural relics;
(4) Dumping and burning garbage;
(5) Damage , damage or occupy cultural relics buildings and their ancillary buildings;
(6) Set up communications, outdoor advertising, and build artificial attractions;
(7) Conduct in areas where photography is prohibited. Photography activities;
(8) Engaging in activities underground or in the air that endanger the safety of cultural relics buildings and their ancillary buildings;
(9) Setting up, storing, and using easy-to-use equipment that endangers the safety of cultural relics. flammable, explosive and other items and facilities that endanger the safety of cultural relics;
(10) planting plants that endanger the safety of cultural relics;
(11) damaging water supply, power supply, fire protection, Monitoring facilities;
(12) Carry out construction projects or blasting, drilling, excavation and other operations without authorization;
(13) Other behaviors that may damage the safety of cultural heritage.
