Legal basis: Interim Measures for the Administration of Medical and Health Institutions Accepting Social Donations.
Article 1 In order to encourage social donations to support health undertakings, standardize donations and recipients, and protect the legitimate rights and interests of donors and recipients, these Measures are formulated in accordance with the People's Republic of China (PRC) Law on Public Welfare Donation, the People's Republic of China (PRC) Law on Anti-Unfair Competition and other laws and regulations, combined with the actual medical and health work.
Article 2 The term "medical and health institutions" as mentioned in these Measures refers to medical and health institutions established according to law, with independent legal personality, engaged in medical and health service activities and not for profit (including traditional Chinese medicine, integrated traditional Chinese and western medicine and ethnic medical institutions, the same below). The term "social donation" as mentioned in these Measures means that natural persons, legal persons and other organizations (hereinafter referred to as donors) voluntarily provide financial or material support and help to medical and health institutions.
