Hubei Province, urban amenities and environmental sanitation management regulations of the ordinance content

Article 1 In order to strengthen the management of urban amenities and environmental sanitation, to create a clean and beautiful urban environment, to protect the health of citizens, and to promote the construction of urban civilization, according to the provisions of relevant laws and regulations, combined with the actual situation in this province, the formulation of these regulations.

Second Article This Ordinance shall apply to the management activities of the cityscape and environmental sanitation in the urban areas of the municipalities and county people's governments within the administrative area of this province.

The urban areas of the established towns other than those stipulated in the preceding paragraph may, by decision of the people's government at a higher level, refer to the implementation of these Regulations.

Article 3 The administrative department of construction of the provincial people's government shall be responsible for the management of the cityscape and environmental sanitation in the province; the administrative departments of cityscape and environmental sanitation of the people's governments at the municipal, prefectural and county levels (hereinafter referred to as the departments in charge of cityscape and environmental sanitation) shall be responsible for the management of the cityscape and environmental sanitation in their own administrative areas.

The people's governments at or above the county level health, environmental protection, public security, industry and commerce administration, transportation, water conservancy and other relevant departments shall, in accordance with their respective responsibilities, to do a good job in the management of municipal sanitation.

Article 4 of the people's governments at or above the county level shall strengthen the leadership of the work of amenities and environmental health, amenities and environmental health into the national economy and social development plan, the organization of the preparation of urban amenities and environmental health professional planning, and implementation.

People's governments at or above the county level shall establish and improve the public **** financial as the main body of the city of environmental sanitation diversified investment mechanism, attach importance to and support scientific research, promote the application of advanced technology and facilities, improve the management level of the city of environmental sanitation.

Article 6 Communities and residents' committees may organize residents to formulate conventions for the maintenance of amenities and environmental sanitation, and encourage residents to actively participate in the management of amenities and environmental sanitation and the creation of clean, beautiful and civilized communities.

Article 7 Citizens have the right to enjoy a good sanitation environment and the obligation to maintain the city's environmental sanitation, and have the right to discourage, report the destruction of the city's environmental sanitation and damage to environmental sanitation facilities.

Any unit or individual shall respect the labor of workers in urban sanitation and shall not hinder or obstruct their normal work.

Article 8 The units and individuals who have made remarkable achievements in the work of cityscape and environmental sanitation shall be recognized and rewarded by the people's government and its relevant departments. Article 9 The buildings, structures and other facilities of the city shall conform to the standards of urban appearance prescribed by the state, and be neat, intact and beautiful.

Article 10 The design style and color tone of the buildings in the city shall conform to the requirements of urban planning, new construction, expansion, alteration of buildings shall be coordinated with the surrounding urban environment.

Buildings and structures shall be kept neat and clean, and their cityscape and environmental sanitation responsibility shall be in accordance with the provisions of the urban people's government for regular cleaning, painting and modification.

The roofs, balconies and windows of the buildings on both sides of the main streets of the city and the street buildings in the key areas shall not be hung, dried or piled up with objects or structures affecting the cityscape.

The installation of window bars, air conditioning units, awnings and other facilities on the facades of buildings on both sides of the city's main streets and street-facing buildings in key areas shall be kept safe and clean and shall not affect the passage of pedestrians.

Article 11 No unit or individual shall, without authorization, pile up materials and erect buildings, structures or other facilities on both sides of urban roads and public **** places.

Construction and other special needs, on both sides of urban roads and public **** place temporary stacking of materials, erecting non-permanent buildings, structures or other facilities, subject to the consent of the competent departments of the city and sanitation, and to maintain the surrounding environmental health and cleanliness.

Outdoor advertising, plaques, light boxes, galleries, slogans, bulletin boards and other outdoor facilities should be set up to strengthen the day-to-day management of the facilities, to maintain the appearance of beautiful, safe and sound and functional integrity. No unit or individual shall carve, write or post on trees, ground, buildings, structures or other public **** facilities. Article 19 Citizens shall consciously maintain urban environmental health, and shall not engage in the following behaviors that affect public ****ing environmental health:

(1) spitting and defecating;

(2) littering with fruit and vegetable peels and kernels, paper scraps, cigarette butts, beverage cans, lunch boxes, chewing gum, plastic bags and other wastes;

(3) indiscriminately pouring sewage, feces, and indiscriminately abandoning animal carcasses;

(d) burning leaves, garbage or other wastes in the open field or public **** garbage collection containers;

(e) throwing or burning things on the road or public **** places;

(f) other behaviors stipulated by the laws and regulations affecting the urban environmental health.

Article 20 Units and individuals shall dump domestic garbage in accordance with the location and manner prescribed by the competent department of urban sanitation.

The catering service providers shall collect and dispose of kitchen garbage separately in accordance with the relevant provisions.

Article 21 of industrial solid waste, medical waste and other hazardous waste must be collected, transported and disposed of separately in accordance with national regulations, and it is prohibited to mix with municipal garbage.

Article 22 of the municipal government, power supply, water supply, gas, communications, air defense, transportation, fire prevention, greening, sanitation and other facilities set up, maintenance and repair of sludge, silt, branches and leaves, and other wastes generated by its operating units shall be removed in a timely manner.

Article 23 of the construction waste generated by the unit shall apply to the competent department of cityscape and sanitation, approved by the disposal of construction waste can be disposed of.

Rubbish generated by residents renovating their houses shall be put into designated places in accordance with the regulations, and shall not be mixed with domestic garbage.

Article 24 The construction unit shall be set up at the construction site shelter fences, vehicle washing facilities, temporary toilets and garbage containers and other temporary environmental sanitation facilities, and keep them clean and intact.

Construction units shall not be unauthorized outside the construction site fence piles of construction garbage, engineering residue and construction materials. Construction of garbage, dirt should be centralized, timely removal, and take measures to prevent dust and sewage pollution of the surrounding environment.

After the completion of the construction project, the construction unit shall promptly level the construction site, remove construction waste, and remove the construction of temporary facilities.

Article 25 prohibits the keeping of chickens, ducks, geese, rabbits, sheep, pigs, edible pigeons and other poultry and livestock in the urban areas of the city. For teaching, scientific research and other special needs of rearing, in accordance with the relevant provisions.

Residents keeping pets and pigeons shall not pollute the environment, the pets on the roads and other public **** site emissions of feces, the keeper shall be immediately removed.

Article 26 No unit or individual shall wash vehicles on city roads, squares and other public **** sites.

Engaged in vehicle washing, repair and waste collection, waste acceptance operations, shall maintain environmental hygiene around the business premises, and take measures to prevent sewage outflow or waste dispersed to the outside.

Article 27 The gradual implementation of urban living garbage collection, in accordance with the principle of harmlessness, minimization, resource treatment, encourage waste recycling and comprehensive utilization.

Urban household garbage producers shall pay the household garbage disposal fee in accordance with the relevant provisions of the state. Domestic garbage disposal fee can be entrusted to collect and pay on behalf of the way.

Article 28 to establish and improve the market operation of environmental sanitation system, open environmental sanitation, garbage disposal facilities construction and operation of the market. Engaged in the city's domestic garbage business cleaning, collection, transportation, treatment services, shall be approved by the city's municipal sanitation department.

Article 29 The competent authorities in charge of cityscape and sanitation shall strengthen the management of environmental sanitation and urge the sanitation operation units to clean and remove garbage in a timely manner in accordance with the regulations, and reasonably arrange the operation time and operation mode, so as not to impede the travel and normal life of the public. Article 30 The department in charge of urban sanitation shall, in accordance with the professional planning of urban environmental sanitation and environmental sanitation facilities set standards, formulate the construction plan for environmental sanitation facilities and organize the implementation. Article 31 The construction plan for the construction of new urban areas, the renovation of old cities, industrial areas, commercial districts, airports, stations, piers, tourist attractions, etc., shall include the setting up of environmental sanitation facilities.

Construction units should be set up in accordance with the urban sanitation facilities standards supporting the construction of environmental sanitation facilities, and with the main project at the same time as the design, construction, delivery and use, the required investment funds should be included in the construction project estimates.

Article 32 of the city's domestic waste, construction waste disposal sites and other environmental sanitation facilities shall comply with environmental sanitation standards and technical specifications.

All kinds of public **** places, passenger transportation and other places of pedestrian traffic distribution of business units or management units, shall be in accordance with the standards of environmental sanitation facilities set up, set up garbage collection containers.

Article 33 The management and use of environmental sanitation facilities shall strengthen the management of environmental sanitation facilities, regular maintenance, repair, to keep them clean and intact.

Article 34 No unit or individual shall not encroach upon, damage or unauthorized demolition, relocation, closure of environmental sanitation facilities, shall not change the nature of the use of public **** environmental sanitation facilities. Because of urban construction really need to demolish environmental sanitation facilities, the construction unit should be proposed in advance demolition and construction program, reported to the competent department of sanitation for approval.

Urban planning to determine the land of environmental sanitation facilities, shall not change its use without authorization. Article 35 of the city sanitation department shall establish and organize the implementation of environmental sanitation responsibility system, divided into areas of responsibility, the implementation of the responsible person. Article 36 The owner of buildings, structures and other facilities and premises is the person responsible for urban sanitation. If the owner, manager or user agrees on the management responsibility, it shall follow their agreement.

(b) the implementation of property management of the residential area of the responsibility of the property management unit, without the implementation of property management of the residential areas The responsible person is the street office or the original property rights unit;

(3) all kinds of commodity trading places, the responsible person is the management unit;

(4) highways, railroads, urban rail transit, bridges, tunnels and their jurisdictions, the responsible person is the operation and management of the unit;

(5) rivers, lakes and their shorelines, embankments, culverts, the responsible person is the management or use of the unit;

(6) the responsible person is the management or use of the unit;

(7) the responsible person is the management unit;

(8) the responsible person is the management unit units;

(vi) construction sites, the responsible person is the construction unit;

(vii) land parcels to be constructed, the responsible person is the land use right holder;

Article 37 The person responsible for cityscape sanitation shall fulfill the following responsibilities:

The competent department of cityscape and sanitation may notify the responsible person of the cityscape and sanitation of his failure to fulfill his responsibilities. Article 38 The department in charge of urban sanitation shall, in accordance with the law, publish the standards and regulations for the management of urban sanitation, as the basis for the implementation of supervision and inspection of urban sanitation.

Article 39 The competent authorities in charge of cityscape and sanitation shall strengthen the construction of law enforcement team, strict education and management, standardize law enforcement behavior, improve law enforcement level. Article 40 of the municipal sanitation department shall establish and standardize the municipal environmental sanitation inspection system, the acceptance of complaints and reports, timely detection and investigation of violations of the provisions of the municipal environmental sanitation management.

(8) Violation of the provisions of Article 31, paragraph 2, Article 34, shall be ordered to make corrections within a specified period of time, the circumstances are serious, and may be imposed on the construction of environmental sanitation facilities or facilities less than two times the cost of a fine;

(ix) violation of the provisions of the first paragraph of Article 25, shall be ordered to deal with the deadline, and confiscated if not dealt with within a specified period of time.

Article 43 The manner of collection of fines shall be in accordance with the provisions of relevant laws and regulations.

Article 44 Insulting or beating the staff of the municipal environmental sanitation constitutes a violation of public security management behavior, the public security organs shall be punished according to law; constitutes a crime, shall be investigated for criminal responsibility.

Article 45 The municipal environmental sanitation management personnel of one of the following acts, depending on the severity of the case, be given criticism and education, or given administrative sanctions; constitutes a crime, shall be investigated for criminal liability; caused losses, shall be compensated according to law.

(a) failing to perform the duties of management of municipal environmental sanitation;

(b) violating the provisions of the charges, fines or penalties in accordance with the law without issuing special receipts;

(c) abuse of power to the detriment of the lawful rights and interests of citizens, legal persons or other organizations;

(d) scolding and insulting the person concerned;

(e) intentionally damaging, unauthorized handling or misappropriating the articles of the person concerned;

(vi) using one's authority for favoritism, embezzlement and bribery;

(vii) other violations of laws and regulations. Article 46 These Regulations shall come into force on August 1, 2006.
