Legal Basis: The Law of the People's Republic of China on Bidding and Tendering Article 3 The following engineering construction projects, including the investigation, design, construction, supervision and procurement of important equipment and materials related to the construction of the project, shall be subject to bidding in the territory of the People's Republic of China:
(1) Projects relating to the social public interest and public safety, such as large-scale infrastructure projects, public utilities and so on;
(2) Projects relating to the social public interest and public safety;
(3) Projects relating to the public safety and public welfare; and
(a) large-scale infrastructure, public utilities and other social and public interests, public safety projects;
(b) all or part of the use of state-owned funds or state-financed projects;
(c) the use of loans from international organizations or foreign governments, aid funds for the project.
The specific scope and scale standards of the projects listed in the preceding paragraph shall be formulated by the development planning department of the State Council in conjunction with the relevant departments of the State Council for the approval of the State Council.
Law or the State Council on the scope of other projects must be tendered, in accordance with its provisions.
