Measures for the implementation of household appliances trade-in

(Revised Draft) Article 1 In order to further promote the expansion of consumer demand, improve the utilization efficiency of resources and energy, reduce environmental pollution, and promote the development of energy conservation and emission reduction and circular economy, these Measures are formulated in accordance with the Letter of the Ministry of Commerce, the Ministry of Finance and the Ministry of Environmental Protection on Printing and Distributing the Work Plan for Promoting Household Appliances Trade-in (Shang Shang Shang Fa [20 10] 190).

Article 2 The term "trade-in of household appliances" as mentioned in these Measures refers to the behavior of consumers to trade-in old household appliances.

Article 3 The implementation period of the old-for-new household appliances policy is tentatively set as June/day of 20 10 to February/day of 20 1 0/year. In the meantime, we should do a good job in connection with the policy of setting up a fund for the treatment of waste electrical and electronic products stipulated in the Regulations on the Management of Recycling and Treatment of Waste Electrical and Electronic Products (the State Council Decree No.5565438 +0).

Article 4 The principle of "simple procedures, direct subsidies, safety, high efficiency, energy saving and environmental protection" shall be followed in exchanging old household appliances for new ones. Article 5 Ways and objects of subsidies:

1. Any legal person registered in the province where home appliance trade-in is implemented or an individual with household registration in this province (hereinafter referred to as the purchaser) who sells discarded old home appliances to the winning recycling enterprise and buys new home appliances from the winning sales enterprise can enjoy the home appliance subsidy. The buyers who sell old appliances and buy new ones must be the same. New home appliances that have enjoyed the subsidy policy of "home appliances going to the countryside" may not enjoy the old-for-new subsidy repeatedly.

2. During the implementation of the policy, the successful home appliance recycling enterprise (hereinafter referred to as the recycling enterprise) that buys old home appliances from buyers and sells them to the designated dismantling enterprise for dismantling can enjoy the freight subsidy.

3. Dismantling enterprises can enjoy dismantling subsidies when dismantling old household appliances sold by buyers during the policy implementation period.

4. During the implementation of the policy, the total number of new household appliances purchased by individuals shall not exceed 5; Units to buy new home appliances, the total does not exceed 50 units. The purchase of new household appliances is not subject to the corresponding restrictions on the varieties of old household appliances sold.

Article 6 Subsidies for replacing old appliances with new ones include televisions, refrigerators (including freezers), washing machines, air conditioners and computers. Where the scope of subsidized products needs to be adjusted, the Ministry of Commerce shall, jointly with the Ministry of Finance, the Ministry of Industry and Information Technology, the Ministry of Environmental Protection and other departments, study and put forward specific opinions, and organize the implementation after reporting to the State Council for approval.

Article 7 The subsidy standards are:

1, home appliance subsidy. Subsidies will be given according to 10% of the sales price of new household appliances. The upper limit of subsidy is: TV 400 yuan/TV, refrigerator (including freezer) 300 yuan/TV, washing machine 250 yuan/TV, air conditioner 350 yuan/TV and computer 400 yuan/TV;

2. Freight subsidy. According to the types, specifications and transportation distance of recycled old household appliances, a fixed subsidy will be given. See Annex for specific subsidy standards. Transportation distance refers to the fair distance between the actual location of recycling enterprises and the actual location of dismantling enterprises, and the specific standards are approved and published by the relevant local departments.

3. Dismantling subsidies. According to the actual number of old household appliances dismantled by dismantling enterprises, a fixed subsidy will be given. The specific subsidy standards are: TV 15 yuan/Taiwan, refrigerator (including freezer) 20 yuan/Taiwan, washing machine 5 yuan/Taiwan, computer 15 yuan/Taiwan, and air conditioning is not subsidized.

Eighth, new household appliances should meet the requirements of relevant national safety and environmental protection standards. Article 9 The home appliance sales enterprises and recycling enterprises shall be determined by the local competent commercial department in conjunction with the financial department through bidding, and the bidding results shall be reported to the Ministry of Commerce and the Ministry of Finance for filing within 15 working days, and the list and contact information of the successful home appliance sales and recycling enterprises shall be announced to the public. Dismantling and processing enterprises shall be selected by the local environmental protection administrative department from the existing dismantling and processing enterprises and reported to the government for identification. The determined results shall be reported to the Ministry of Environmental Protection and the Ministry of Finance for filing within 15 working days.

Tenth buyers choose recycling enterprises, through the Internet, telephone and other ways to apply for the sale of old household appliances, recycling enterprises in a timely manner to buy old household appliances; Or the buyer buys new home appliances first, and the winning enterprise recycles the old home appliances while distributing the new home appliances to the buyer, and at the same time issues the certificate of household appliances trade-in formulated by the state.

No unit or individual is allowed to transfer or sell the old-for-new certificate of household appliances and obtain financial subsidies.

The recycling enterprise shall timely and accurately enter all the information of the old-for-new certificate of household appliances, including category, brand, product manufacturer, model, fuselage number, buyer's name and ID number, recycling price of old household appliances, certificate number of old-for-new household appliances, etc. , and paste the serial number of the fuselage generated by the system on the old household appliances without the serial number of the fuselage.

Eleventh buyers choose the successful sales enterprises, with valid identity documents, home appliances trade-in certificate, to the home appliance sales enterprises to buy new home appliances. For those who meet the requirements, home appliance sales enterprises directly advance subsidy funds to buyers when selling new home appliances, and input relevant information into the home appliance trade-in management information system.

Twelfth recycling enterprises to buy old household appliances should be sold to the designated dismantling enterprises for dismantling. To meet the requirements, the dismantling and processing enterprise shall pay transportation subsidies to the recycling enterprise in advance, and input the relevant information into the management information system of household appliances trade-in.

Article 13 A household appliance sales enterprise shall apply for subsidy funds from the finance department at the same level with the sales invoice of new household appliances, trade-in vouchers and the Application Form for Subsidy Funds for Trade-in of Household Appliances, after being audited by the local commerce department or the relevant business department determined by the local government.

Article 14 The dismantling enterprise shall apply to the local financial department for prepaid freight subsidies and dismantling subsidies on the basis of the trade-in certificate, the Declaration Form of Trade-in (Freight) Subsidies for Household Appliances and the Declaration Form of Trade-in (Dismantling) Subsidies for Household Appliances after being audited by the local competent environmental protection department. Fifteenth in order to facilitate buyers to sell old household appliances, the recycling of old household appliances adopts diversified recycling methods. Household appliance manufacturers (after-sales service agencies), sales enterprises, professional recycling enterprises, etc. You can participate in the bidding activities of home appliance trade-in recycling enterprises organized by relevant local departments.

Article 16 The household appliance recycling enterprises determined by bidding shall have corresponding service capabilities and good reputation, and meet the following basic conditions:

1, with recycling outlets, reasonable layout and wide coverage;

2. Recycling outlets have the ability to record and check the information related to household appliances trade-in through the trade-in management information system;

3. There are storage places that meet the requirements of environmental protection and sufficient transportation support capacity;

4. There are trained recycling personnel with certain professional and technical knowledge;

5. Good business credit status in the past three years.

Article 17 The local competent commerce department shall, jointly with the financial department, formulate the specific conditions for inviting bids of household appliance recycling enterprises according to the local actual conditions and the basic conditions stipulated in these Measures, and no local protection threshold shall be set in the specific conditions.

Article 18 The local competent commerce department shall report the recycling enterprises and qualified recycling outlets to the Ministry of Commerce and the Ministry of Finance for the record. Guide recycling enterprises to apply to the local administrative department for industry and commerce to increase the business scope of renewable resources recycling, and apply to the local competent commercial department for the record of renewable resources enterprises, and standardize their operations in accordance with the provisions of the Measures for the Administration of Renewable Resources Recycling. Recycling enterprises that meet the requirements stipulated in document Caishui [2008] 157 can enjoy preferential policies related to value-added tax.

Article 19 A recycling enterprise shall sign a commitment agreement, pay a performance bond, ensure the timely purchase of old household appliances sold by buyers at a reasonable price, standardize the issuance of trade-in certificates, inspect and recycle old household appliances in strict accordance with relevant regulations, sell all the recovered old household appliances to designated dismantling and processing enterprises, and shall not resell the trade-in certificates and old household appliances, dismantle and handle old household appliances without authorization, engage in fraud, engage in illegal activities such as selling and selling old household appliances with new ones. Twentieth professional home appliance chain sales enterprises, comprehensive large-scale retail enterprises, home appliance production enterprises (sales organizations) and so on. You can participate in the bidding activities of home appliance trade-in sales enterprises organized by relevant state departments.

Twenty-first sales enterprises determined through bidding should have strong strength, good reputation and sound sales network, and meet the following basic conditions:

1, the sales outlets cover a wide range, and the sales enterprise outlets in the province cover the county level;

2. Sales outlets have the ability to record and check the information related to the trade-in of household appliances through the trade-in management information system;

3. Strong warehousing and distribution capabilities;

4. Have a perfect after-sales service system for home appliances delivery, installation, debugging and maintenance;

5. Good business credit status in the past three years.

Article 22 The local competent commerce department shall, jointly with the financial department, formulate specific conditions for the bidding of home appliance sales enterprises based on the local actual conditions and the basic conditions stipulated in these Measures, and no local protection threshold shall be set in the specific conditions.

Twenty-third local commercial authorities will report the successful home appliance sales enterprises and qualified sales outlets to the Ministry of Commerce and the Ministry of Finance for the record.

Twenty-fourth successful sales enterprises shall sign a commitment agreement and pay a performance bond to ensure the sale of new household appliances at normal market prices, strictly control the purchase of goods, and prevent counterfeit and shoddy products from entering the market. Twenty-fifth during the implementation of the policy, all localities should determine the dismantling and processing enterprises in accordance with the principle of rational distribution and centralized processing. Non-fixed-point dismantling and processing enterprises shall not buy and process old household appliances with old ones for new ones.

Twenty-sixth dismantling enterprises shall meet the requirements of relevant national laws and regulations on environmental protection, and meet the following basic conditions:

1. Independent legal entities listed in the list of electronic waste dismantling, utilization and disposal units (including temporary list) according to the Administrative Measures for the Prevention and Control of Environmental Pollution by Electronic Waste (Order No.40 of the former State Environmental Protection Administration), excluding individual industrial and commercial households;

2, with the relevant environment, quality and safety management and technical personnel;

3. It has related facilities and equipment such as classification, packaging, storage, and dismantling that are suitable for the dismantling of old household appliances;

4. Old household appliances and their disassembled products that cannot be deeply treated shall be properly utilized or disposed of;

5. Have the ability to record and check the data of dismantling and processing old household appliances through the management information system of household appliances trade-in; Establish a record book system for the operation of old household appliances;

6. It has not been punished by the environmental protection department in the past three years.

Twenty-seventh local environmental protection administrative departments shall, according to the local actual situation, on the basis of the basic conditions stipulated in these measures, formulate and determine the specific conditions for dismantling and processing enterprises to ensure the dismantling and processing capacity of old household appliances.

Article 28 The dismantling and processing enterprise shall sign a commitment agreement and pay a performance bond to ensure that it will not refuse the old household appliances sold by the recycling enterprise without reason, will not recycle the purchased old household appliances, and will not engage in illegal activities such as manufacturing and selling old ones and filling them with new ones, and dismantle and process the old household appliances within the time limit prescribed by the local environmental protection administrative department.

Dismantling enterprises should, in principle, complete dismantling within 30 working days after receiving old household appliances.

Twenty-ninth dismantling enterprises should set up a video monitoring system before 20 10 10 3 1 to supervise all key areas such as import and export, dismantling and storage 24 hours a day. The dismantling plant should have only one entrance and one exit.

Thirtieth dismantling enterprises should set up signs in a prominent position in the factory area, publicize the daily reception, dismantling and storage of old household appliances, and report the reception, dismantling and storage to the local environmental protection administrative department for the record on a weekly basis. The original vouchers related to the receipt, disassembly and storage of old household appliances shall be properly kept for future reference.

Thirty-first local environmental protection departments at all levels should set up a special column on the government website to publicly disclose the reception, dismantling and storage of used household appliances submitted by dismantling and processing enterprises. First, home appliance subsidies.

Article 32 Buyers who sell used household appliances shall obtain a unified national certificate for exchanging old appliances for new ones from recycling enterprises. The recycling enterprise shall indicate the product brand, specification, model, fuselage number, buyer's name and ID number of old household appliances on the trade-in certificate.

Thirty-third buyers directly declare home appliance subsidies when purchasing new home appliances, and the sales enterprises will review them. For those who meet the subsidy conditions, the sales enterprise shall issue an invoice to the buyer according to the sales price, instruct the buyer to fill in the Declaration Form of Subsidy Funds for Household Appliances Trade-in (household appliances), pay the subsidy funds on the spot, and collect the money according to the normal sales price of new household appliances minus the subsidy amount. If it does not meet the subsidy conditions, it shall immediately inform the buyer and collect the payment according to the sales price.

Article 34 The information that the purchaser should provide when applying for subsidies: (1) the certificate of exchanging the old for the new; (2) invoices for purchasing new household appliances; (3) "Home Appliances Trade-in (Home Appliances) Subsidy Fund Declaration Form"; (four) the identity card of the purchaser or the relevant certificates of the relevant legal entity.

Thirty-fifth home appliance sales enterprises according to the old-for-new sales situation, regularly sort out the buyer's application materials, after being audited by the local commercial department, apply to the local financial department for home appliance subsidies. After the examination and confirmation by the financial department, the subsidy funds will be paid directly to basic account, where the household appliance sales enterprise is established in the bank, through centralized payment from the national treasury. Financial and commercial departments at all levels should strengthen the supervision and inspection of subsidies issued by home appliance sales enterprises to prevent fraudulent subsidies.

Second, freight subsidies.

Thirty-sixth recycling enterprises will sell the purchased waste household appliances to dismantling enterprises, and issue sales invoices to dismantling enterprises. The invoice shall indicate the product category, specification, model, quantity and price of the used household appliances sold.

Thirty-seventh recycling enterprises directly declare freight subsidies according to the actual number of used household appliances sold, and the dismantling and processing enterprises will review them. To meet the requirements, direct payment of freight subsidies, and guide recycling enterprises to fill out the "Application Form for Home Appliances Trade-in" (freight subsidies). Do not meet the requirements of subsidies, should immediately inform the recycling enterprises.

Article 38 The materials that recycling enterprises should provide when applying for subsidies are: (1) trade-in certificate; (2) Sales invoice of used household appliances; (3) Home appliance trade-in (freight) subsidy declaration form.

Thirty-ninth dismantling enterprises regularly sort out and recycle enterprise application materials, and after being audited by the local environmental protection department, apply to the local financial department for freight subsidies. After examination and confirmation by the financial department, the subsidy funds will be paid directly to the basic account opened by the household appliance dismantling and processing enterprise in the bank through centralized payment from the national treasury. Financial and environmental protection departments at all levels should strengthen the supervision and inspection of subsidies issued by dismantling and processing enterprises to prevent fraudulent subsidies.

Third, dismantling subsidies.

Fortieth dismantling enterprises shall regularly count the varieties and quantities of old household appliances dismantled, fill in the Application Form for Dismantling Subsidies for Old-for-New Household Appliances, and apply to the local financial department for subsidy funds after being audited by the local environmental protection department. After examination and confirmation by the financial department, the subsidy funds will be directly allocated to basic account, where the dismantling and processing enterprise is established in the bank.

Article 41 When applying for dismantling subsidies, dismantling enterprises shall provide the following information: (1) Application Form for Dismantling Subsidies for Household Appliances Trade-in; (2) Certificate of trade-in of household appliances; (3) Sales invoice of used household appliances issued by household appliance recycling enterprises (with purchase list attached); (four) the certificate of prepaid freight of the dismantling and processing enterprise (with freight receipt); (5) Disassembly record form and sales certificate or disposal certificate of disassembled products.

Forty-second dismantling enterprises should check the old household appliances purchased one by one, and the information such as product category, specification and model provided by the old-for-new certificate and the old-for-new household appliances management information system should be consistent. If the audit is inconsistent, the dismantling subsidy shall not be declared. According to the requirements of the competent department of environmental protection, the dismantling of old household appliances should be completed within the specified time, and it is not allowed to trade old appliances for new ones.

Forty-third local environmental protection departments at all levels should strengthen the preliminary examination of the subsidy form declared by the dismantling and processing enterprises, and review whether the old household appliances have been dismantled, whether the processing procedures are in line with the regulations, and the direction of the dismantled products. It is necessary to strengthen the supervision and management of dismantling and processing enterprises in conjunction with the financial department, establish a regular verification system, prevent fraud, false reporting and other acts, and ensure the safety of financial funds. Forty-fourth subsidy funds in accordance with the relevant provisions of the special transfer payment, centralized payment by the state treasury.

Forty-fifth the management and use of subsidy funds follow the principles of openness and transparency, grading burden, directional use and dynamic supervision.

Forty-sixth subsidy funds shall be borne by the central finance and provincial finance. Among them, the central financial burden is 80%, and the provincial financial burden is 20%.

For the five autonomous regions of Inner Mongolia, Guangxi, Tibet, Ningxia and Xinjiang, and 5 1 county severely affected by the Wenchuan earthquake and Yushu earthquake in Qinghai, the subsidy funds will be fully borne by the central government.

Article 47 The Ministry of Finance, together with the Ministry of Commerce, shall calculate the scale of subsidy funds according to the stock of used household appliances, the capacity of dismantling household appliances and the economic development level of various places, and allocate the subsidy funds that should be borne by the central finance to the provincial financial departments in advance.

Article 48 After receiving the subsidy funds allocated by the central government, the provincial financial department shall implement the subsidy funds that should be borne by the local government, issue the budget breakdown document of the subsidy funds in time, and pay the subsidy funds according to the demand progress and the above procedures according to the budget documents. In the process of implementation, if the actual subsidy funds need to be paid beyond the budget, the provincial financial department will pay in advance.

Article 49 The provincial finance department shall, jointly with the commerce and environmental protection departments, verify and summarize the use of subsidy funds in the local area in the previous year before the end of April each year, and report to the Ministry of Finance for review and liquidation. Article 50 The Ministry of Commerce, together with the Ministry of Finance, the Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Environmental Protection, the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine and other relevant departments, shall jointly organize and implement the trade-in of household appliances in accordance with the division of responsibilities of the departments and the provisions of these Measures.

The Ministry of Commerce will work with the Ministry of Finance, the Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Environmental Protection and other departments to organize the trade-in of household appliances and issue implementation measures. In conjunction with the Ministry of Finance, it will guide all localities to determine home appliance recycling enterprises and sales enterprises, be responsible for the development and training of home appliance trade-in management information systems, and be responsible for printing and organizing the issuance of home appliance trade-in certificates.

The Ministry of Finance, together with the Ministry of Commerce, the Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Environmental Protection and other departments, is responsible for formulating the subsidy policy for replacing old appliances with new ones and managing the financial subsidy funds.

The Development and Reform Commission is responsible for strengthening the guidance and supervision of the price of household appliances.

The Ministry of Environmental Protection is responsible for the organization, implementation, supervision and management of the dismantling and disposal of old household appliances, and will guide all localities to determine the dismantling and disposal enterprises together with the Ministry of Finance.

The Ministry of Industry and Information Technology is responsible for the management of home appliance manufacturers, urging and guiding them to improve and guarantee the quality of home appliances.

Quality inspection, industry and commerce departments should strengthen the supervision and management of home appliance production and market according to law within their respective responsibilities. Article 51 Local people's governments shall be responsible for organizing and implementing the trade-in of local household appliances. Local people's governments should set up a leading group for the trade-in of household appliances, form a working group, clarify responsibilities and division of labor, implement work funds, carefully organize and strengthen supervision.

Article 52 The relevant departments of the local people's government shall, in accordance with the Letter of the Ministry of Commerce, the Ministry of Finance and the Ministry of Environmental Protection on Printing and Distributing the Work Plan for Promoting the Trade-in of Household Appliances (Shang Shang Fa [2065 438+00] 190) and the requirements of these Measures, formulate specific operating rules as soon as possible, including the process of the buyer's trade-in, the determination of household appliances recycling enterprises, sales enterprises and dismantling and processing enterprises, and the trade-in of household appliances.

Article 53 The relevant departments of the local people's government shall formulate the provisions on the integrity of the main parts of used household appliances, and supervise successful household appliance recycling enterprises to recycle used household appliances at fair and reasonable prices.

Article 54 The local competent commerce department, together with the finance and environmental protection departments, is responsible for managing the trade-in of household appliances in the local area, establishing a smooth information channel by establishing a contact mechanism with recycling enterprises, sales enterprises and dismantling enterprises, supervising and managing the recycling and sales enterprises and outlets of household appliances and dismantling enterprises, establishing working files, keeping abreast of the work trends, and urging enterprises to do a good job of trade-in with old ones.

Article 55 The relevant departments of the local people's governments shall be responsible for the policy publicity and training of replacing old household appliances with new ones.

Article 56 The local competent commerce department shall, jointly with the departments of finance, development and reform, industry and informatization, and environmental protection, establish a work reporting system, and regularly report the work progress, existing problems and suggestions to the Ministry of Commerce, the Ministry of Finance, the Development and Reform Commission, the Ministry of Industry and Information Technology, and the Ministry of Environmental Protection. Fifty-seventh enterprises engaged in the trade-in of household appliances shall abide by the relevant laws and regulations and the relevant provisions of these measures. Once it is verified that there are violations to defraud financial subsidies, it is necessary to strictly take punishment measures such as recovering financial subsidies, confiscation of performance bonds, fines, disqualification, and publicity to the public.

Article 58 Under any of the following circumstances, the competent administrative department of environmental protection of the local province (autonomous region or municipality directly under the Central Government) shall report to the government to suspend or even cancel the qualification of dismantling enterprises. 20 1 1 after the implementation of the regulations on the management of recycling and disposal of waste electrical and electronic products, the qualification for disposal of waste electrical and electronic products shall not be granted within three years.

1, violating environmental laws and regulations;

2, defrauding the national freight and dismantling subsidies;

3. Re-circulate the purchased old household appliances;

4, engaged in illegal activities such as manufacturing and selling the old and filling the new;

5. Other acts in violation of regulations.

Article 59 The local people's government shall be responsible for the supervision and administration of the trade-in of household appliances in this area. Through the establishment of the supervision and management system of household appliances trade-in, the work of trade-in is ensured to be carried out in an orderly manner.

Sixtieth financial departments at all levels should strengthen the supervision and management of the use of subsidy funds for household appliances, and ensure the timely and full payment of subsidy funds.

Article 61 The competent commercial departments at all levels shall establish a supervision system for the business activities of the successful home appliance recycling and sales enterprises, formulate the management measures for the old-for-new certificates of home appliances and a reporting system for the use of them, and track and manage the whole process of applying for certificates.

Sixty-second environmental protection departments at all levels should strengthen the supervision and management of the dismantling and disposal of old household appliances, and can supervise them in the factory when necessary.

Article 63 The administrative departments for industry and commerce at all levels shall give full play to the role of 123 15 consumer complaint reporting network, promptly accept and handle consumer complaints and reports on household appliances with old ones for new ones according to law, and earnestly safeguard the legitimate rights and interests of consumers.

Sixty-fourth quality supervision departments at all levels shall investigate and deal with illegal acts such as quality, and crack down on illegal acts of counterfeit and shoddy products from the source. Sixty-fifth localities can formulate specific implementation rules according to these measures.

Article 66 These Measures shall be implemented as of the date of promulgation.

Article 67 These Measures shall be interpreted by the Ministry of Commerce, the Ministry of Finance, the Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Environmental Protection, the State Administration for Industry and Commerce and the General Administration of Quality Supervision, Inspection and Quarantine.
