Regulations of Shenyang Municipality on Urban Drainage Management

Chapter I General Provisions Article 1 In order to strengthen urban drainage management, give full play to the functions of urban drainage facilities, prevent floods, protect the environment, promote economic and social development and improve people's quality of life, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "urban drainage" as mentioned in these Regulations refers to the reception, transportation, discharge and treatment of sewage, rainwater and groundwater within a planned urban area.

The term "urban drainage facilities" as mentioned in these Regulations refers to facilities such as pipe networks, rivers, ditches, artificial lakes, pumping stations, gates and sewage treatment plants that receive, transport and discharge sewage, rainwater and groundwater. Urban drainage facilities include public drainage facilities and self-built drainage facilities. Article 3 All units and individuals engaged in the management, construction, maintenance and use of urban drainage facilities in urban planning areas shall abide by these regulations. Article 4 The municipal urban construction management department is the administrative department in charge of urban drainage management in this Municipality, and implements unified supervision and management of urban drainage.

The drainage management institution affiliated to the municipal urban construction management department is responsible for the daily management.

District urban construction management department, in accordance with the management authority, is responsible for the administrative area of urban drainage management and supervision.

Construction, planning, real estate, environmental protection, water conservancy and other relevant departments shall, in accordance with the division of responsibilities, do a good job in urban drainage. Article 5 The municipal and district people's governments shall, in accordance with the relevant provisions of the state, incorporate the funds for the construction, renovation, maintenance and operation of urban drainage facilities into the annual urban construction investment plan. Article 6 The principles of unified planning, supporting construction, hierarchical management and coordinated development shall be applied to urban drainage. Article 7 Encourage scientific and technological research on urban drainage, actively promote and support the application of advanced technologies and equipment for urban drainage, and improve the scientific and technological level of construction, renovation, maintenance and management of urban drainage facilities. Article 8 All units and individuals have the right to use urban drainage facilities according to law and the obligation to protect urban drainage facilities, and have the right to stop and report violations of these regulations.

City and district urban construction management departments shall reward units and individuals that have made remarkable achievements in maintaining urban drainage facilities. Chapter II Planning and Construction Management Article 9 The Municipal People's Government shall, in accordance with the overall urban planning and the national economic development plan, organize relevant departments to formulate urban drainage planning and rationally arrange drainage facilities such as drainage pipe networks, drainage pumping stations and sewage treatment plants.

The relevant departments of the municipal and district people's governments shall, according to the urban drainage planning, formulate the annual construction plan of public drainage facilities and organize their implementation. Tenth urban drainage should follow the principle of separate discharge of rainwater and sewage.

The drainage facilities for the construction of new urban areas, the renovation of old urban areas and new construction, renovation and expansion projects shall be constructed in accordance with the requirements of rain and sewage diversion; The old urban areas that have not yet implemented rain and sewage diversion should speed up the transformation of drainage facilities and gradually transition to rain and sewage diversion. Eleventh new or rebuilt drainage pipelines, before access to urban public drainage facilities, must be set up in accordance with the relevant provisions of the standard grit chamber, grease trap, septic tanks and other facilities.

In rain and sewage diversion areas, rainwater pipes and sewage pipes shall not be mixed. Twelfth new construction, renovation and expansion of urban drainage projects must meet the national quality standards for construction projects. After the completion of the project, the construction unit shall organize the relevant departments to carry out acceptance in accordance with relevant regulations, and the project can only be delivered for use after passing the acceptance. Thirteenth new construction, renovation and expansion of urban drainage projects, the implementation of quality warranty system, the warranty period of 2 years from the date of acceptance of the project. Chapter III Administration of the Use of Drainage Facilities Article 14 A permit system shall be implemented for urban drainage. Any unit or individual operator that directly or indirectly drains into urban drainage facilities (hereinafter referred to as drainage households) shall apply to the municipal urban construction management department for a drainage permit, and shall not drain into urban drainage facilities without obtaining a drainage permit. Fifteenth to apply for the "Drainage Permit" shall meet the following conditions:

(1) The setting of sewage outlets meets the requirements of urban drainage planning;

(two) the sewage discharged into the urban drainage facilities meets the national and provincial discharge standards;

(three) the corresponding sewage treatment facilities have been built according to the regulations;

(4) The discharge port is provided with a special inspection well;

(5) If there is sediment in the temporary drainage during the construction operation, which is enough to cause the drainage pipe network and its ancillary facilities to be blocked or damaged, the drainage households have built pre-precipitation facilities;

(six) key drainage households should also meet other conditions stipulated by the state.

Key drainage households shall be determined by the municipal urban construction management department in conjunction with the environmental protection department in accordance with the relevant provisions of the state and announced to the public. Article 16 To apply for a drainage permit, the following materials shall be submitted truthfully:

(a) the application form for urban drainage permit;

(two) drainage pipe network (road), special manhole, drainage position and caliber drawings and related instructions;

(3) Relevant information on the construction of sewage treatment facilities and sewage treatment technology;

(four) the drainage water quality, water quantity, water temperature and water pressure test report issued by the drainage testing institution with measurement certification qualification;

(5) Description of product types, main raw materials and water consumption;

(six) new construction, renovation and expansion projects and drainage related information;

Key drainage households shall also provide other relevant materials in accordance with state regulations.
