Article 1 In order to carry out the national industrial policy, control the scale of investment, guide the direction of investment, adjust the structure of investment, strengthen the key constructions, and promote the national economy's sustainable, stable and coordinated development of the national economy, the formulation of these regulations. Article 2 Units and individuals investing in fixed assets within the territory of the People's Republic of China shall be the taxpayers (hereinafter referred to as "taxpayers") of the adjustment tax on investment in fixed assets (hereinafter referred to as "adjustment tax on investment") and shall pay the adjustment tax on investment in accordance with the provisions of these Regulations. The taxpayers shall pay the Investment Direction Adjustment Tax in accordance with the provisions of these Regulations. Article 3 The Investment Direction Adjustment Tax shall be implemented at different tax rates according to the national industrial policy and the economic scale of the project. The tax rate applicable to a fixed asset investment project shall be determined separately according to its unit project. The tax items and tax rates shall be implemented in accordance with the "Table of Tax Items and Tax Rates for Fixed Assets Investment Direction Adjustment Tax" attached to these Regulations. For fixed asset investments not listed in the Tax Table of Tax Items (excluding renewal and reconstruction investments), the tax rate is 15%. The tax rate for renewal and reconstruction investments other than those listed in the Table of Tax Rates for Applicable Tax Items with a 0% tax rate is 10%. The Table of Tax Items and Rates of Directional Adjustment Tax on Investment in Fixed Assets shall be adjusted periodically by the State Council. Article 4 The tax basis of investment direction adjustment tax is the actual completed investment amount of fixed assets investment projects, of which the investment amount of renewal and reconstruction investment projects is the actual completed investment amount of construction works. Article 5 The investment direction adjustment tax shall be paid in advance according to the annual planned investment amount of the unit project of the fixed asset investment project. After the end of the year, according to the annual actual completion of the investment amount of settlement, more refund less compensation; project completion, according to all the actual completion of the investment amount of liquidation, more refund less compensation. If it is difficult for a taxpayer to pay the tax for the whole year according to the annual planned investment amount, the taxpayer may pay the tax payable in installments before the end of September of the current year upon the approval of the tax authorities. Article 6 When a taxpayer submits a fixed asset investment project for approval, the tax shall be implemented by the investment direction adjustment tax of the project and be included in the total investment of the project for the economic and financial evaluation of the project. However, the tax shall not be used as the base for design, construction and other fees. Article 7 The investment direction adjustment tax shall not be reduced or exempted except as otherwise provided by the State Council. Article 8 The investment direction adjustment tax shall be collected and managed by the tax authorities. Taxpayers shall apply for tax registration, tax identification and tax declaration to the tax authorities where the project is located. Article 9 The collection of investment direction adjustment tax, the implementation of the unified management of the plan and the investment license combined with the source of control and management methods: (a) the provinces, autonomous regions, municipalities directly under the Central Government and municipalities with plans (Planning and Economic Commission) summary of the region's fixed-asset investment project plan, by the same level of the tax authorities to validate the fixed-asset investment projects applicable to the tax items, tax rates and taxable amount, issued by the planning department. (ii) Taxpayers shall go to the tax authorities where the project is located for tax registration and declaration before using the annual investment in the project. Banks and other financial institutions transfer the tax payable on the basis of special payment vouchers filled out by the tax authorities. (iii) The planning department shall issue investment licenses on the basis of tax payment certificates. Banks and other financial institutions shall, according to the investment license, go through the procedures of allocating funds and loans for fixed asset investment projects. Article 10 The investment direction adjustment tax shall be withheld and paid by the People's Construction Bank of China, Industrial and Commercial Bank of China, Agricultural Bank of China, Bank of China and Bank of Communications, other financial institutions and relevant units. Article 11 For unplanned fixed asset investment projects, the tax authorities, in addition to levying tax at its applicable tax rate, and may impose on the taxpayer a fine of not more than five times the taxable amount. However, the unplanned fixed asset investment projects applying 0% tax rate shall be disposed of separately by the planning department in accordance with relevant regulations. Capital construction investment in the name of renewal and reconstruction shall be taxed at double the tax rate of the capital construction investment tax item. However, the application of 0% tax rate of investment projects, by the planning department in accordance with the relevant provisions of a separate disposal. Article 12 If a taxpayer fails to pay the tax in accordance with the provisions of these Regulations, the Planning Commission (Planning and Economic Commission) shall cancel the project for the preparatory project, shall not arrange for the commencement of the new project, shall cancel the scale of its annual investment plan for the renewed project, and shall revoke the investment license; banks and other financial institutions shall not apply for loans and grants for them. If the planning, banking and other departments violate the provisions of these regulations, resulting in tax evasion and tax evasion by the taxpayers, their superior authorities shall pursue the responsibility of the relevant personnel. Article 13 Other matters relating to the collection and management of the investment direction adjustment tax shall be carried out in accordance with the provisions of the Law of the People's Republic of China on Taxation Collection and Management of the People's Republic of China*** and the People's Republic of China. Article 14 These Regulations shall not apply to investments in fixed assets of Sino-foreign joint ventures, Sino-foreign cooperative ventures and foreign-funded enterprises. These Regulations shall not apply to investments in projects whose development is prohibited by the State. The planning department shall dispose of them separately in accordance with the provisions of the relevant state laws, regulations, guidelines and policies. The List of Projects Prohibited for Development by the State Council shall be adjusted periodically. Article 15 The preferential measures for the investment direction adjustment tax in minority areas shall be separately stipulated. In accordance with the state regulations are not included in the plan management, the investment amount of less than 50,000 yuan of fixed asset investment, investment direction adjustment tax collection and exemption and reduction, by the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government to decide.
