Foreign aid management measures

Chapter I General Provisions Article 1 In order to strengthen the strategic planning and overall coordination of foreign assistance, standardize the management of foreign assistance, enhance the effectiveness of foreign assistance, based on relevant laws and administrative regulations to formulate these measures. Article 2 The foreign aid referred to in these measures refers to the use of government foreign aid funds to the recipient to provide economic, technical, material, human resources, management and other support activities. Article 3 The recipients of foreign aid mainly include developing countries that have established diplomatic relations with the People's Republic of China and have the need to receive assistance, as well as international organizations that are mainly developing countries.

In urgent or special cases such as humanitarian assistance, developed countries or developing countries that do not have diplomatic relations with the People's Republic of China may also be recipients. Article 4 Foreign aid is committed to helping recipients alleviate and eliminate poverty, improve the livelihood and ecological environment of recipients, promote the economic development and social progress of recipients, enhance the capacity of recipients for independent and sustainable development, consolidate and develop friendly and cooperative relations with recipients, promote the high-quality ****building of the "One Belt, One Road", and push forward the construction of a new type of international relations and the building of a human destiny ****. international relations, and promote the construction of a new type of international relations and a common destiny of mankind. Article 5 Foreign aid shall adhere to the correct concept of righteousness and benefit and the concept of truthfulness and sincerity, mutual respect, equal treatment and win-win cooperation; respect the sovereignty of the recipient country, non-interference in the internal affairs of the other country, and non-attachment of any political conditions; act within the limits of its capabilities, do its best, keep its promises and finish what it started; and implement policies according to the country's needs, ***business*** construction, diversify the forms and emphasize the practical results. Article 6 The National Agency for International Development Cooperation (hereinafter referred to as the Agency for International Development Cooperation) is responsible for formulating guidelines and policies on foreign aid, promoting reform of foreign aid, managing the scale and direction of foreign aid funds, preparing annual budgets for foreign aid projects, identifying foreign aid projects, supervising and evaluating the implementation of foreign aid projects, and organizing and carrying out international exchanges and cooperation on foreign aid.

The Ministry of Commerce and other foreign aid implementation departments (hereinafter referred to as foreign aid implementation departments) are responsible for putting forward foreign aid-related proposals in accordance with the needs of foreign work, undertaking the specific implementation of foreign aid, consulting with recipients and dealing with specific matters relating to the implementation of foreign aid projects, being responsible for the organization and management of the projects, selecting the main body of implementation of foreign aid projects or dispatching foreign aid personnel, and managing the foreign aid funds of the department. The Ministry of Foreign Affairs is responsible for putting forward proposals on foreign aid according to the needs of diplomatic work. The embassies and consulates (missions) in foreign countries coordinate the management of foreign aid work in the countries (international organizations), assist in handling foreign aid-related affairs, communicate with the recipients of aid needs and policy review, and are responsible for the supervision and management of foreign aid project implementation abroad. Article 7 The Agency for International Development and Cooperation, together with relevant departments, shall establish an inter-ministerial coordination mechanism for foreign aid, and coordinate major issues of foreign aid. Article 8 The Agency for International Development and Cooperation shall formulate a unified logo for the Chinese government's foreign aid, and shall be responsible for the supervision and management of the use of the logo. Chapter II Foreign Aid Policy and Planning Article 9 The Agency for International Development and Cooperation shall, together with the relevant departments, formulate strategic guidelines and medium- and long-term policies and plans for foreign aid, and shall submit them for approval and implementation in accordance with the procedures. Article 10 The Agency for International Development Cooperation shall, in conjunction with the relevant departments, formulate country-specific foreign aid policies and submit them for approval in accordance with the procedures for implementation. Article 11 The Agency for International Development and Cooperation shall, in conjunction with the relevant departments, formulate overall programs and annual plans for foreign assistance, and submit them for approval and implementation in accordance with the procedures. Article 12 The Agency for International Development Cooperation shall, in conjunction with the relevant departments, study reform measures of foreign aid modalities and promote the implementation of such reform measures. Article 13 The Agency for International Development and Cooperation shall take the lead in promoting the legalization of foreign aid, and formulate corresponding foreign aid management systems with the foreign aid departments in accordance with the division of responsibilities. Article 14 The Agency for International Development and Cooperation establishes a foreign aid project reserve system, collects, examines and determines country-specific foreign aid reserve projects, and implements dynamic management of the reserve projects.

The foreign aid reserve projects are the main basis for the preparation of foreign aid fund plans and budgets, as well as the establishment of foreign aid projects. Article XV of the International Development Cooperation Agency to formulate draft agreements on foreign aid assistance, negotiate with the recipients, and sign the agreements in the name of the Chinese government. Chapter III Mode of Foreign Aid Article 16 The funds for foreign aid mainly include non-reimbursable aid, interest-free loans and preferential loans of three types.

Non-reimbursable assistance is mainly utilized for the recipient's needs for assistance in poverty reduction, disaster mitigation, people's livelihood, social welfare, public **** services, humanitarianism and other areas.

Interest-free loans are mainly used for the recipient's assistance needs in public **** infrastructure, industrial and agricultural production.

Concessionary loans are mainly used for the recipient's assistance needs in economically beneficial production-oriented projects, resource and energy development projects, and larger-scale infrastructure construction projects. Article 17 The Agency for International Development Cooperation (AIDC) innovates forms of foreign assistance through the South-South Cooperation Assistance Fund and other means. Article 18 Foreign aid is mainly project-based.

In emergency or special circumstances such as humanitarian assistance, it may provide cash assistance to the recipient. Article 19 Foreign aid projects mainly include the following types:

(1) complete sets of projects, i.e., through organizing or guiding the whole process of construction, installation and trial production or part of it, providing recipients with complete sets of production and living, public ****services, etc., and engineering facilities, as well as providing long-lasting quality assurance and ancillary technical services;

(2) material projects, i.e., providing recipients with general production and living materials, and providing recipients with general production and living materials, and providing recipients with general production and living materials. (f) foreign aid medical team projects, i.e., selecting and sending medical service personnel, and providing part of the medical equipment and medicines at no cost to the recipient party to carry out fixed or fixed-term medical services in the recipient party. (vii) Emergency humanitarian assistance projects, i.e., projects that provide emergency relief materials, cash remittances, or send rescue personnel to provide relief in the event of a humanitarian disaster in the country concerned;

(viii) South-South cooperation assistance fund projects, i.e., projects that use the South-South cooperation assistance fund to support international organizations, social organizations, think tanks, etc.
