"Workers' Compensation Insurance Regulations" Article XVII Employees injured in accidents or in accordance with the provisions of the law on the prevention and control of occupational diseases diagnosed and identified as occupational disease, the unit should be from the date of the date of accidental injury or diagnosed and identified as an occupational disease within 30 days from the date of the co-ordination of the regional social insurance administration to apply for a determination of work injury. In the event of special circumstances, the time limit for application may be appropriately extended with the consent of the social insurance administrative department.
If the employer fails to submit an application for recognition of work injury in accordance with the provisions of the preceding paragraph, the injured employee, or his/her close relatives, or the trade union organization may, within one year from the date of the occurrence of the accidental injury or the date of diagnosis or appraisal of the injury as an occupational disease, directly submit an application for recognition of work injury to the administrative department of social insurance of the co-ordinating area where the employer is located.
Article 21 If an employee is injured at work and there is a disability that affects his or her ability to work after the injury is relatively stabilized by treatment, an appraisal of his or her ability to work shall be made.
The compensation received is different according to different disability levels. The main compensation is: medical expenses, one-time disability allowance, one-time employment allowance, one-time medical allowance, wages for the period of stay out of work, meal allowance, nursing fee and so on.
