Chapter I General Provisions Article 1 In order to strengthen the management of publicly-funded medical care, and further improve and perfect the management system of publicly-funded medical care, in accordance with the former Central People's Government Government Council "on the people's government at all levels of the national people's government, parties, organizations and affiliated institutions of the State staff to implement the prevention of publicly-funded medical care instructions" and the relevant provisions of the State in recent years, combined with the new situation, the formulation of the present measures. Article 2 The system of publicly-funded medical care is a social security system practiced by the State to safeguard the physical health of State workers. The State, through the medical and health departments, provides free medical prevention within the scope of the system to those who enjoy it. Article 3 The implementation of the publicly-funded medical care system shall be carried out in accordance with the principles of actively preventing disease, ensuring basic medical care and overcoming waste, and shall be managed and supervised by the publicly-funded medical care administration departments at all levels. Article 4 Medical institutions undertaking the task of providing publicly-funded medical treatment shall adhere to the principle of serving the people wholeheartedly, carry forward the revolutionary humanitarian spirit of saving lives and helping the injured, conscientiously implement the principle of prevention as the mainstay of disease prevention; adhere to the principles of medical treatment, administering treatment according to the cause of the disease, rationalizing the use of medicines, rationalizing examinations, and rationalizing the fees to ensure the proper implementation of the publicly-funded medical treatment system. Article 5 Individuals enjoying publicly-funded medical treatment and the units to which they belong are obliged to abide by the relevant rules and regulations formulated by the management departments of publicly-funded medical treatment at all levels. The ideological education of persons enjoying such treatment shall be effectively strengthened, and unethical practices shall be corrected and resisted. Leaders and cadres at all levels shall set an example and shall not make use of their authority to engage in specialization. Chapter II The scope of enjoyment of public medical treatment Article 6 belongs to the enjoyment of public medical treatment:

First, state organs at all levels, parties and people's organizations by the state budget expenditures of wages, in the establishment of the staff.

The staff of all kinds of societies, associations, research institutes and foundations at all levels that are self-financed or subsidized by the difference are not entitled to publicly-funded medical treatment.

Second, all levels of culture, education, science, health, sports, economic construction and other institutions by the state budget expenditures of the salary, in the establishment of the staff.

The staff of the institutions under differential budget management (excluding hospitals under national ownership) and self-supporting management, as well as temporary workers, seasonal workers, and part-time substitute teachers in schools listed in paragraphs 1 and 2 above are not entitled to publicly-funded medical treatment.

C. Basic-level industrial, commercial and tax personnel whose salaries are expended within the state budget and who belong to the state establishment.

Fourth, the All-China Federation of Trade Unions, local trade unions at all levels, industrial trade unions in the establishment of the off-the-job staff, as well as by the county or urban areas above the leading organs of the trade unions organized by the full budget management of the institutions in the establishment of the staff.

The temporary workers, seasonal workers, part-time substitute instructors of the institutions organized by the trade unions, as well as the staffs of the trade union institutions which are under differential financial management and self-supporting management are not entitled to public medical treatment.

Fifth, belonging to the units entitled to public medical care, approved by the long-term recuperation due to illness of supernumerary staff, long-term support and to be assigned to the over-established staff.

VI. Revolutionary disabled soldiers in the countryside who are subject to long-term pension and those in the correctional institutions for disabled soldiers and the Invalids' Home.

VII. Retirees belonging to units enjoying public medical care, retired employees working in the military without military status.

viii. Employees of administrative institutions who are not entitled to publicly-funded medical care, and those who are in line with the retirement scheme of the State Council and whose pensions are issued by the civil affairs department after retirement.

Nine, the state officially approved the establishment of ordinary schools of higher education (excluding military colleges and universities) plan to enroll the ordinary college students, graduate students (excluding commissioned training, self-funded, cadres, students) and approved by the sick leave one year to retain the student registration, as well as graduates of higher education can not be assigned to work within one year due to illness.

Fourth, due to surgery or critical illness after hospitalization for recovery, short-term convalescence or rehabilitation treatment, the original treatment unit recommended by the unit agreed to the medical expenses approved by the competent authorities of the public health care; non-surgical or non-critical illnesses during the recovery period of convalescence or rehabilitation medical treatment, recommended by the designated hospitals, agreed to by the unit, the competent authorities of the public health care approved by the drug costs.

Fifth, because the original treatment unit does not have the drugs, must be purchased (refers to the national medical stores or other medical units) and accompanied by a hospital certificate of the cost of drugs.

6. The cost of medicines transferred to overseas medical units (national and collective) for treatment according to the regulations.
