Measures of Hubei Province for the Safety Management of Hazardous Chemicals

Chapter I General Provisions Article 1 In order to strengthen the safety management of hazardous chemicals, prevent and reduce hazardous chemical accidents, ensure the safety of people's lives and property, and protect the environment, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production, the Regulations on Safety Management of Hazardous Chemicals, the Regulations on Safety in Production of Hubei Province and other laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the safety management of the production, storage, use, operation and transportation of hazardous chemicals within the administrative area of this province. Article 3 The safety management of hazardous chemicals shall adhere to the principles of safety first, prevention first and comprehensive management, establish and improve the mechanism of unified leadership by the government, supervision by departments according to law, overall responsibility of enterprises and social participation in supervision, and strengthen and implement the main responsibility of enterprises. Article 4 The people's governments at or above the county level shall strengthen the leadership over the safety management of hazardous chemicals, formulate and organize the implementation of the safety development plan for hazardous chemicals, and set the annual targets for the safety production of hazardous chemicals.

The safety management of hazardous chemicals shall be under the responsibility system of the chief executive of the people's government, and the main person in charge of the people's government shall take overall responsibility for the safety management of hazardous chemicals. Fifth people's governments at or above the county level shall take the safety supervision and management of hazardous chemicals as an important part of the annual assessment of the target responsibility system for safe production, and implement administrative accountability for units and individuals who fail to implement the responsibility for safety supervision and management of hazardous chemicals. Article 6 The people's governments at or above the county level shall establish a joint meeting system for the safety supervision and management of hazardous chemicals, support and urge the relevant departments (hereinafter referred to as departments responsible for the safety supervision and management of hazardous chemicals) to perform their duties according to law, and coordinate and solve major problems existing in the safety management of hazardous chemicals.

Township people's governments and sub-district offices shall strengthen the publicity and education on the safety of hazardous chemicals and assist the departments responsible for the safety supervision and management of hazardous chemicals to implement supervision and management. Seventh departments responsible for the safety supervision and management of hazardous chemicals shall perform their duties in accordance with the following provisions:

(1) The safety production supervision and management department is responsible for the overall work of safety supervision and management of hazardous chemicals, reviewing the safety conditions of newly built, rebuilt and expanded construction projects for the production and storage of hazardous chemicals (hereinafter referred to as hazardous chemicals construction projects), issuing hazardous chemicals safety production licenses, hazardous chemicals safety use licenses and hazardous chemicals business licenses, and registering hazardous chemicals and organizing accident investigations.

(2) The public security organ shall be responsible for the public safety management of hazardous chemicals, issue the purchase license and road transport pass for highly toxic chemicals, and be responsible for the road traffic safety management of vehicles transporting hazardous chemicals. The fire control institution of the public security organ shall supervise and inspect the compliance of units that produce, store, use, manage and transport hazardous chemicals (hereinafter referred to as hazardous chemicals units) with fire control laws and regulations.

(3) The quality supervision, inspection and quarantine department is responsible for issuing production licenses for industrial products of enterprises that produce dangerous chemicals and their packages and containers (except large fixed storage tanks for storing dangerous chemicals, the same below), supervising the quality of their products according to law, and inspecting the import and export of dangerous chemicals and their packages. Special equipment inspection and testing institutions shall conduct inspection and testing of special equipment of units involving dangerous chemicals according to law, and bear legal responsibility for their inspection and testing results and appraisal conclusions.

(4) The competent department of environmental protection shall, according to the Catalogue of Hazardous Chemicals under Key Environmental Management published by the Ministry of Environmental Protection, conduct environmental risk assessment of hazardous chemicals under key environmental management for enterprises that produce and use hazardous chemicals, and be responsible for environmental management registration of hazardous chemicals and environmental management registration of new chemicals; Investigate environmental pollution accidents and ecological damage incidents related to hazardous chemicals according to the division of responsibilities, and be responsible for emergency environmental monitoring at the scene of hazardous chemicals accidents.

(5) The competent department of transportation is responsible for the license of road transport and waterway transport of dangerous chemicals and the safety management of means of transport, supervising the safety of waterway transport of dangerous chemicals, and determining the qualifications of drivers, crew members, loading and unloading management personnel, escorts, declaration personnel and on-site inspection personnel of dangerous chemicals road transport enterprises and waterway transport enterprises. The competent railway authorities are responsible for the safety management of railway transportation of dangerous chemicals, and for the qualification examination and approval of carriers and shippers of railway transportation of dangerous chemicals and the safety management of their means of transport. The competent civil aviation authority is responsible for the air transport of dangerous chemicals and the safety management of air transport enterprises and their means of transport.

(six) the competent health department is responsible for the management of toxic identification of dangerous chemicals, and is responsible for organizing and coordinating the medical and health rescue work for the injured in dangerous chemical accidents.

(7) The administrative department for industry and commerce shall, according to the permission of the relevant departments, issue business licenses to enterprises that produce, store, manage and transport dangerous chemicals, and investigate and deal with the illegal procurement of dangerous chemicals by dangerous chemicals management enterprises.

(eight) the postal administration department is responsible for investigating and handling the delivery of dangerous chemicals according to law. Article 8 The principal responsible person of a hazardous chemicals unit shall be fully responsible for the safety management of hazardous chemicals in the unit.

Dangerous chemicals units shall meet the safety requirements stipulated by laws, administrative regulations, national standards and industry standards, carry out standardization construction of safety production, establish, improve and implement safety management rules and regulations and post safety responsibility system; In accordance with the relevant provisions of the extraction and use of safety production costs, to ensure safety production investment, pay safety production risk of mortgage or take out safety production liability insurance; Conduct safety education, legal education, accident emergency training and on-the-job technical training for employees, and provide qualified personnel for positions with qualification requirements according to law.

Dangerous chemicals units shall be equipped with corresponding occupational hazard protection facilities to provide employees with labor protection articles that meet national standards or industry standards.

Hazardous chemicals units that produce or import hazardous chemicals listed in the Catalogue of Hazardous Chemicals shall register according to law.
